I first spoke with *** ****** a few days before new years and I advised her not to put a new roof on her house before massive tree work needed to be cut above the roof; and that I would seriously consider not doing any tree work for her if she went against my advisory.In between Jan.1st2023 and the first start day of the debris removal on Jan.19th; we talked several times about my pricing. I explained to her that on anytime that I use my dump I must charge $500; and that is not including the dump fee that ******** charges which was $61.50; *** ******'s debris weighed 3,000 pounds which is the equivalent of 1.5 tons when I took her debris to the ******** ***** ***** ********. (Please view document attached from ******** ***** ***** Dated 1-30-23) *** ****** always remarked that she lived on a fixed income and she always complained about the people who left all that debris in her back yard so when she did not want to pay the 61.50 in dump fees I felt sorry for the way the previous company left her so I didn't push the issue, we talked several times about the front tree cutting and I told her that that would be a separate job altogether that would cost about 3,200 dollars. So on the 17th of January when I came and looked at the mass pile of debris (see pictures attached) in person; I told her that it would be next to impossible to get all the debris out without a bush hog and I would have to rent a jack hammer which she said that she could not afford and that she was happy with all the debris that we took away; and also without a way to get a machine into the tight confined area behind her house; for she had a septic tank on one side blocking and a few trees blocking the other side. I also responded to her asking me to cut the limbs above the front of her house; my initial response was that it would be in her best interest to cut the trees first before placing a new roof under a bunch of rotten limbs hanging over her house; I also stated that it would be really hard to not have a few limbs scratch or dent the new roof that she was wanting to put on before we cut the trees. When I came to get the debris on Jan. 19th, we both had a mutual understanding that there were two jobs that were going to be performed; one job was the debris removal for 500 dollars, and the second job was the tree limb removal for 3200 dollars (plus 200 for rental).
I have all the proof including pictures, receipts, and witnesses that she knew and acknowledged by her signature for these 2 amounts. She was pleased and thanked us for our hard work on removing her heavy debris cleanup. I explained that we normally don’t do demolition work and that we are initially a tree service; however we went ahead and completed the removal of the debris, on January 19th we had a conversation about her only being able to afford 3200 for the entire job; I further explained that she would have to pay in total 3,700 dollars and that was excluding rental fee for lift through ******* *******. I explained that we could not make it anymore cheaper and that expenses were going to be very costly and that there was nothing I could do but charge her for two different jobs which was 500 for the Dump and 3200 for the Tree work. I also explained that if there were any scratches or dents or anything she wasn’t happy with that I could make an insurance claim if needed, she went on to say that she would fix any tiny dents or scratches because we both agreed that it would be next to impossible to not let any tiny branches fall and hit her new roof, that she was intending on putting on even after I advised her to not put the roof on before we cut. I still advised her to let us cut the trees before a new roof placement and she still insisted that she would put on a new roof and asked me if I could cut the trees during the same time as the roofing was being done. I said no. I informed her that there is no way will we work around or above a roofing company. So, I told *** ****** that I was going to back out from doing any tree work for her. She came to me before I left at the end of the day while the dump trailer was completely full with one of the biggest and heaviest loads we have ever took to ******** ***** **********. I went ahead and paid for the dump fee which was $61.50. **. ******* ****** never reimbursed me for this Dump Fee nor did she ever pay for the 200 dollar rental fee which was only a percentage of the rental cost the total rental was $664.00 dollars. She then begged me to go ahead and cut the trees and then she stated that she would cover any damages if they were just minor scratches and dents; she insisted that as long as no big trees went through her roof that she would be happy and there would be no problem with my insurance. I asked her one more time if she understood that these were 2 different jobs with 2 different prices; the debris job was $561.50 and the front tree limbs would cost 3,200 with an extra rental fee that I told her about that I would later show her from ******* ****** that costed another 200 dollars that she never paid me for. I finally got her to acknowledge and accept that there were two different fees for 3200 for the Trees and 500 dollars for the first task of debris removal. I noticed that she would try to remain confused about these 2 different prices for the rest of the job.
Then I had to put her job off my docket schedule for an entire two weeks later due to her wanting to put a new roof on. So she paid me with another personal check for 900.00 dollars when we showed up on Feb. 3rd 2023 to her property to remove her tree limbs. She thanked us for the excellent job on getting most of the Debris that another former demolition company had left on her property. She shown much remorse and hatred for the guys that left the debris there and she stated that she tried to complain and make a claim towards their negligence but found out that they were not even a legitimate company. She brought up my insurance company and asked me if I was Insured and I told her yes, and that I am insured through ********* and **********; I also stated that I cannot do business without being insured.
**. ******* ****** still owes my company 661.00 dollars with I/ ******* **** ****** *** All Trees Management excluding the rental fee of 200.00 dollars. I received 1700.00 from *** ****** on February 5th 2023. This took place right after we removed massive tree limbs and entire trees from her front yard for 2 days once on the 3rd and once on the 5th; when we were finally done, I immediately took a picture of the roof and I had noticed a tiny scratch that was on the side of her roof and there was also a dent in one of the shingles and I asked ******* ****** if she would like me to call ********* and ********** and report a claim from the pictures that I took of her roof and **. ******* ****** said no. She said no that she already explained that she would handle anything minor so I said ok fine then I won’t call the Insurance company, and then stated further that we had a misunderstanding about the price; and then I said no I have been up front with you about the price and what jobs I have charged you for upon your signature as well, (please read receipt documents attached) and then she asked if she could make a payment for the other 600 dollars that she realized that she owed on the first week of March and then I said, well you’re going to probably need me to come and get the pile of wood but that will also cost you because I have not entered that task into the equation of the job. Please keep in mind I had previously asked **. ******* a few times in January about how she would want me to take the limbs and trees that were left at the end of the tree limb job, and that it would cost another 500 for each additional dump and she stated that she didn’t have the extra money for me to make another dump. *** ****** asked me to throw all the wood over the fence and I said no; I replied, that I did not want to do any littering of anyone else’s yard and, also; that this was a part of a national park named ******* ******* and I could not do that to a natural resource, and then; she said that I could just make a pile in front of her fence; I told **. ******* that it would cost more for me to make another trip with the dump and she then said that she would work it all out when she got more money on the first week of March. We had this discussion in front of 2 of my employees whom of which worked very hard for *** ****** during those 2 days. I finally agreed to accept her payment and I told her that I understood that she lives on a fixed income.
Five days later on February 10th she sent me a picture of her on her roof, with her hand; that had apparently pulled off about 50 shingles (please see pictures attached). She first asked if I would call my insurance but I told her that it was too late that I had already left the job and that she tampered with the evidence leaving the repair nonredeemable. It would have impossible to make a claim at that point and she continued to be upset. She texted me several times in a negative tone talking down to me saying that she knows that me and my friends want the wood and that we can come get it for free; on my cell phone *** ****** sent all these pictures with her hand pulling down a section of the roof and complained and stated further that I should come get the wood for free and that she got up there and seen it and then tried to repair It herself. She texted me and said that I needed to pay for a repair of 1100.00 dollars and I told her no that as soon as she got up on the ladder and tampered with her roof that there was no claim that could be made. I later called *** ****** and she also stated that she would just try and resolve the issue herself. I asked her if there was anything she needed me for and she said no that her real concern was about the people that had did business with her previously and that we had did a good job. This complaint does not make any sense because she was happy when I left the job. I am assuming that *** ****** has many financial problems and that she cannot pay what she owes me. I understand also that her making this complaint has perhaps helped her efforts in not paying the bill that she owes me. However, I am very busy and I cannot spend time taking someone who is elderly to court so I am cutting my losses. I think this response is enough to warrant a refusal of any further complaining through the BBB for I have all the evidence and witnesses and If I really wanted to get paid for my services I could just go the police and file a lawsuit; however I do not intend on doing that. I helped *** ****** the best I could and overlooked many of her shortcomings but I will not tolerate any more slander over this matter. Also ********* tried to give me these dining room chairs I feel in a form of payment but then she said that she would pay the 600 that she owed my company on the first week of March and she never did. 5 days after her telling us that she did not want to me to call my Insurance company on Feb. 10th ********* sent me a bunch of hateful negative tone text messages and then sent us pictures with her hand pulling a bunch of shingles off of her roof and stating that she was going to have it repaired herself and in one of the pictures she sent you can see her hand and her dog waiting on her to come down from the ladder. (See pictures attached) The pictures that I last took only shows a tiny scratch not several shingles damaged so as soon as she tampered with the roof by her own hand; I could not report it to my Insurance company which nullified any chance of my Insurance covering the scratch.
