      I am rejecting this response because: you stated According to the *** contract, the maximum allowable term for a covered loan is 84 months. The length of Ms. ******* loan exceeds 84 months, so the *** contract is unenforceable. Because Campus erred in offering *** coverage for this particular loan, Campus refunded all premiums to Ms. ****** and applied the refund to the loan balance.  With this being said, had Campus not Erred in offering this *** coverage, I would not have purchased the unit without *** so I would not be in this situation. It should not be my responsibility to pay for the remaining balance because of an Error Campus made in the terms of ***.

      en put late payment remarks on mine and my husbands credit report and we have never been late on this previously. The payment was not made due to a representative stating the next payment would be due in June.

      To Whom It May Concern:

      Campus USA Credit Union (Campus) is in receipt of the complaint submitted by Campus member ******** ****** on March 7, 2025. As stated in the complaint, Ms. ****** has a loan for a travel trailer financed through Campus.After a hurricane caused severe damage to the trailer, Ms. ****** contacted Campus regarding guaranteed asset protection **************** When dealing with insurance claims, it is common practice for Campus staff to extend loan payment due dates temporarily up to six months. Such an extension provides ample time for all the insurance coverage to be applied without requiring  the member to make a payment. Once all insurance payments are applied, Campus notifies the member of the remaining balance, if any, and the next payment due date. In this case, Campus sent a letter to Ms. ****** on November 22, 2024 indicating the remaining balance and a new due date of January 25, 2025. Campus is unaware of any other due dates provided to the member.

      Ms. ****** further mentions that she was not covered by ************* and wants to know why she was offered this insurance. According to the *** contract, the maximum allowable term for a covered loan is 84 months.The length of Ms. ******* loan exceeds 84 months, so the *** contract is unenforceable. Because Campus erred in offering *** coverage for this particular loan, Campus refunded all premiums to Ms. ****** and applied the refund to the loan balance.

      Ms. ****** also states that her credit report and her husbands credit report were negatively impacted when she failed to make a payment on or before the January 25, 2025 due date. While Campus notified Ms. ****** in writing of the January due date, Campus has decided to remove two months of late payments to put her back on track with the repayment of the loan. Ms. ******* credit, nor her husbands credit will be affected as of March 2025 credit reporting.

      I am rejecting this response because:

      ****** THIS IS MY RESPONSE TO CAMPUS USA

       

      My view of the response to my complaint by there attorney ** **** *******, there lead attorney I might add, sends a message in itself don’t you think? 

      The response from campus USA in my opinion was a lot of words about nothing.

       

      First of all I have never ever heard of a bank doing this sort of practice and 99% of bank regulators do not allow there banks to do this, it’s illegal. 

      Campus USA belongs to none of these.

       

      Even the Florida Office of Financial Regulation that campus USA does belong to is going to investigate this case for me as well as they are not comfortable with how these events went down.

       

      I will never stop my fight for my money, this was a total violation of my rights and for ** ******** a campus USA employee who actually did this withdrawal and made jokes about it is appalling. 

      I disclosed to him about my bankruptcy otherwise they would have never known, he then called the bankruptcy clerk in ******* county for information and called me back yelling at me about it being withdrawn which I didn’t keep that a secret , all within a matter of 5 minutes while I was still at the bank, how tacky a action that is coming from a lower level employee.

       

      Campus USA is huge financially organization.

      Banks have in place policies within there bank organization to cover any credit card loses by there members  with the high interest rates that they charge.

       

      Even the Fair Credit Billing Act (FCBA) which protects consumers from unfair credit card practices state “rules that banks cannot seize funds deposited into a bank account to pay off there credit card”

      THATS COMING FROM WASHINGTON DC because if this is not resolved that’s where this is going to be heading. 

      Then it’s going to become political item in the Capital.

       

      DOES CAMPUS USA THINK THEY ARE ABOVE THE RULES OF BANKING ?

      I think yes you have a president/CEO who now refuses to discuss this with me as a member of campus USA for over 8 years, the CEO being ** ***** ****** maybe does not know it’s a credit union owned by the members me being a member.

      I tried twice by going to the main office to make an appointment with him.

       

      I also went to the branch manager in the ******* branch to discuss this large deposit as soon as it was done  and was assured that my deposit would be safe overnight but was not, even  money was also taken and put in my checking account as well which was in a investigation over a dispute with a vendor cashapp.

       

      So in closing I’m very disappointed but I guess someone’s got to pay for there huge office complex on Newberry road, that looks like a palace.

      They need to do the right thing that’s a huge loss for anybody in one go 

      after what I had just been thru over the last two years.

      TWO HUGE LOSSES IN ONE DAY.

      *** ****** has alleged in his complaint that Campus USA Credit Union did not have the right to apply funds that he had on deposit to his credit card debt with the credit union. Generally, when a borrower is in default on a loan or credit card, the lender does have the right to apply any funds that the borrower has on deposit with the lender to the borrower's defaulted debt. This is known as the right of setoff and is set forth in Florida Statute 657.033(4):

      "The credit union shall have a lien and right of setoff on the shares, deposits, and accumulated dividends or interest in any member’s individual, joint, or trust account for any sum due the credit union from that member."

      This right of setoff is also clearly explained in Campus USA Credit Union's credit card agreement and credit card application. On the Campus USA Credit Union credit card application, directly above the applicant's signature, is the following statement:

      "You understand that the use of your card will constitute acknowledgement of receipt and agreement to the terms of the credit card agreement and disclosures. You grant us a security interest in all individual and joint share and/or deposit accounts you have with us now and in the future to secure your credit card account. When you are in default, you authorize us to apply the balance in these accounts to any amounts due."

      The Campus USA Credit Union credit card agreement has the same language in bold print on the first page of the agreement. This agreement also explains that a borrower will be in default if the borrower files for bankruptcy and that the entire unpaid balance of the credit card will be due immediately. 

      In this case, when *** ****** filed for bankruptcy he defaulted on his Campus USA Credit Union credit card and his entire balance was due. Campus had the right under Florida law and under the terms of the credit card agreement signed and agreed to by *** ****** to apply any funds he had on deposit with the credit union to setoff against his defaulted credit card balance.

      Campus acted within its lawful authority when it applied the funds on deposit to Mr. ******** defaulted credit card. This authority is set forth under Florida law and under the terms of the credit card agreement signed by Mr. ******* as explained in the credit union's first response to this complaint. This is standard practice when a borrower defaults on a debt owed to the credit union.

      On 9/5/2024 around 3:03pm i contacted Campus USA credit union asking for a Overnight Address which would be a Physical address so the Auto Loan i have with them can be paid off as i traded in the vehicle for a New vehicle with a new lender the representative a Male I didnt catch his name provided we only have a ** Box to accept payoffs I told him hes wrong can you please provide me a Physical address to send this ********* he insisted we only have and accept Payoffs at the ** BOX I called later that day and spoke with a Lady to cancel my auto pay she advised that there should be sufficient time for the payoff to post and not affect credit I called on 9/13/2024 to check on the payoff posting still hasnt posted asked the question do you have a physical/ overnight address to send payoffs she advised yes they do because of this lack of communication and professionalism of this company this now has me in a state of financial distress as I now have 2 loans open to this date 9/17/2024 I called again to check on the status of my loan and still the loan hasnt been paid off Im attempting in good faith to work with the Lender but causing much stress

      Thank you for the opportunity to address this complaint and concern from our Campus USA Credit Union (Campus) member, ******* ********. In his complaint, Mr. ******** states on September 5, 2024, he requested Campus' overnight mailing address to send a payoff for an auto loan. During the call, the representative assisting Mr. ******** provided the standard mailing address, which is a post office box, instead of the physical address used for overnight mail. Mr. ******** called several more times and spoke with other employees and a supervisor who explained that our representative made an error by not providing the physical address during Mr. ********* initial brief call. Campus apologizes for this error and any miscommunication regarding the correct address. On September 18, 2024 Campus received and processed Mr. ********* check for the auto loan payoff. Campus effective dated the payoff check for September 15, 2024 and closed the auto loan. The member did not incur a late fee or any additional charges related to the auto loan payoff. Campus affirms Mr. ******** is a member in good standing and considers this matter resolved.

      On 5/28/24 I went to Campus USA to open a checking bank account with the institution. The institution did not inform me nor did I give consent to do a hard pull of my credit report. Once I received notification that my equifax report had a new hard inquiry by Campus USA. I called and spoke with the representative that made the inquiry, her name is ******. She informed me that all banks do a hard pull of new customers credit report with new customers and that practice was standard with most banks. I explained that I did not apply for credit, I simply applied for a bank account and a soft pull of my credit would be understandable, but a hard pull negatively affects my credit and I did not give consent nor was I made aware of the act. I have multiple bank accounts elsewhere and neither of those institutions ever pulled my credit report. She said that basically a hard pull and a soft pull were the same and she’s worked at other banks before so she knows. I asked that this be rectified as this is not okay and she said there is nothing that can be done as that practice is standard and it’s done with all new customers. I know this to be false and would like this corrected on my credit report. I have since closed my account with the institution.

      I was getting unknown bills paid for out of my checking account from camp *** so I contacted campus *** paid the outstanding balance so my account will not be overdrawn and then went into the office and closed the account since then I have taken campus *** off of my Apple Pay but they continue to pay for these charges that I have no clue about Even though I have closed my bank account

      Campus USA computer system games transactions in which it holds my deposits longer than withdraw transactions that were placed on the same day. This continues to cause erroneous over draft or "courtesy pay" fees. When the money would have been in the account had it processed the transactions as they were submitted.
