    The contract was signed in July 2023. Materials were delivered and installation started mid January 2024. Installation was almost finished mid-April 2024 however all doors needed adjustment. While trying to adjust they broke the bottom wheels on one set of doors. The others still need adjusting. The office stated that SERVICE from the manufacturer will come and do the repairs. They claim that it is out of their control. Doors are allowing hot air to penetrate and the request to try to close the gap is being ignored. I have sent pictures and called several times but without response. Our AC is working constantly because of the hot air coming in. In addition, the job needs to be finished and the final inspection is overdue.

    In July 2022 I entered into a contract for replacement of hurricane windows/doors at my 10th floor condo in ********. I waited for the windows with little communication from the company (Americas Window and door, ********************* DBA) General Contractor License ******* *************************************. Installation began December 2022. Windows $27,000 plus $5000 installation. One of the windows was not accessible from a deck and I asked them if they needed the building to provide the gondola for access, they said they did not. The installation/replacement required removal of all the existing windows and the exterior hurricane shutters. The workers left hurricane shutters and an uncaulked window that did not have deck access. ************* said I would have to pay a separate $800 bill to an outside company to have the exterior shutters removed and windows caulked (he also said he would take $800 cash). Shutters removed by 2 unknown men (separate company) several days later. They hooked up a harness the building rooftop, removed the metal hurricane shutters and caulked around the window.**************** building inspector came for a second inspection, could not see the "attachments". No representative of the company was on site to answer questions.The inspection failed.The concrete around all the newly installed windows was damaged during installation, doors/windows needs repair and there are multiple other problems. ********************* is demanding I pay the $800 separately for the outside service providers who caulked and removed the one window that did not have deck access. I do not have a contract or license on record with my building assoc., as required with this outside company as required by my building association. I was/am willing to pay Americas Window but they have refused any communication with me. Head of ************ ****************** *************, and he said it is not my responsibility to pay for this directly, and that the windows cannot be permitted as they are.

    Please allow this to serve as our response to the BBB complaint by ***********************:

    We entered into an impact window and sliding glass door sales and installation contract with the client. Our contract did not include removal of shutters as it was not necessarily required for our window installation.  The permit that we obtained from the **************** did not include any services for the removal of shutters.  The client then requested that the shutters be removed as she would not be needing them any longer. Client wanted Americas to remove the shutters but that is not in our scope of services.  Our salesperson, **************, simply gave the client a phone number of a person who may be interested in doing such work. Americas was informed that the client had hired said person for the removal.  Americas did not need the shutters removed, Americas did not enter a contract to have the shutters removed, Americas did not include the shutter removal in its permit application, Americas did not receive any compensation for the shutter removal, et al.  Whatever transpired between the client and any third party individual in regards to the shutter removal Americas is neither in knowledge of, nor was a party to.  We have passed our Framing inspection with the City with no issues, other than the city requested photos of the sliding glass doors covers, which were provided, and obtained a approval on the Framing inspection.  FYI: there are only 2x inspections on this type of **************** and Final).

    All work has been completed in accordance with the Florida Building Code (hence the Framing inspection approval) and we are awaiting the scheduling of the Final Inspection. I have spoken directly with ****************** and those were not his comments.

    We would also state that the client has been up to date on her payments and that no monies are due at this time  to Americas, until after the Final inspection is obtained.  Simply sated, Americas is not responsible in any manner for the shutter removal services.

    I am rejecting this response because:

    I said that I could not have a separate bill without license and insurance, but that I would pay. They had hooked up a harness at the building rooftop, removed the hurricane shutters and caulked around the window. **************** building inspector came for a second inspection, coul not see the attachments. No representative of the window company was on site to answer questions ( or provide photos). The inspection failed. The stucco around the window was damaged during installation and needs repair. Stucco repair is part of the contact. Multiple other problems as well. I was later sent a bill for $850., not $800, plus$650. I am willing to pay Americas window to get job done and the permit closed. They have refused communication with me. The windows cannot be permitted as they are.
