On 8/17/24 I paid ******** $3,000. He was to start work the following Monday. He did not start until Tuesday. Complained about my AC not working, which he knew about when he did the walkthrough for the quote and took my deposit. He taped off 2 floors Tuesday and left. AC was fixed Wednesday, he did not show up again until Thursday, he then called and told me there was water underneath the plastic on the floors he taped off prior. He requested I come to the house to see the issue. When I went, he started telling me about his issues with police the night prior. He laid plastic on 1 more floor that day, but didn't tape it down, then he left. He had told me that removing my closet doors, as well as texturing inside the closets would each cost an additional $700, even though they're in the sq footage of the contract. He verbally told me he would work the weekend even though it was not normal business days because he missed multiple days that week. Sunday at 3pm he had still not been back to the house since that prior Thursday. I had a flooring expert come out and look at my flooring. He told me ********** plastic had compromised my floors and advised to remove it immediately. I did, and then called ******** and told him I'd like a refund as he hadn't done any work in 8 days of having my money and key to my house, besides taping plastic on 2 floors and laying plastic on one more. He verbally became aggressive and denied me a refund. I paid to have my locks changed and left his belongings on my back porch (which he never came back for). He never touched any ceilings or floors in the duration of having my deposit and keys, his contacts had different time frames for completion, as well as his scribbled out wrong date he wrote. All of those criteria legally void a contract. I will be taking him to court if this isn't resolved outside of it, I'll be seeking criminal charges against him for grand theft, as well as flooring costs and legal fees, my lawyer is extremely confident.Business Response

On August 17th, contract signed and execution of agreement to start August 19th, 2024. We noticed during the walk thru that the ** was not working, he told me the ** would be repaired on Monday 19th.
Could not start on the 19th, Monday, as the ** was being repaired.
On August 20th, I went to client's house and had almost all floors covered with plastic, realizing ** was still not working. I called ******* and he said they didn't repair it. I could not work in high 80 degree weather and left.
On August 21st, Wednesday, client texted me at the end of the day that the ** was working. I told him I was doing a patch, as I could not be waiting on stand by while he resolved his ** issue and told him that I would be there Friday. We agreed that the new start date would be Friday 23rd.
August 22nd, Thursday, I stopped by client's house to check on ** and saw water under floors covered with plastic. I informed client and he said not to worry as he planned to change the floors.
Friday and Saturday, I had issues with my work truck and had service at the dealership and due to the fact that ** was not working delayed the original start date a whole week.
August 25th, Sunday, client called me late in the afternoon, screaming and being aggressive and told me he wanted to cancel the contract. I made numerous attempts to ask him to let me finish the job as it was going to be best for both of us. He refused. He broke contract and service agreement in multiple ways.
Business days are Monday thru Friday. This is unfortunate and I wish ******* would have let me finish the job.

Complaint: 22542819First and foremost, I'm not sharing all of my proof here, as BBB doesn't have any authority to force restitution. I'll save everything I have for court, and the judge can decide and levy property if he refuses to repay when he loses.
I am rejecting this response because:He claimed he would start Monday after contract was signed Saturday, knowing Saturday that the ** was being handled under warranty. It says nowhere in his contract that my ** must be working, so him delaying the start was his choice. He didn't start Monday due to it being "his birthday and needing to service his truck", although he didn't mention that when taking my money. He claims he almost completed taping the entire house off, I have pictures to prove what he actually did and didn't do. He came Tuesday and taped off 2 floors, as original pictures show. No show Wednesday, laid plastic on one floor Thursday. He never showed up again after Thursday, although he claims Friday was the new "start day". Why didn't he show up Friday if that was the new start day? Had to "service his truck"... again. His own friends on ******** don't agree with what he says, contradiction after contradiction, which I have proof of. Another blatant lie is that I had any other contractor here, or that I entered the premises, without him asking me to come. Ring cameras can prove that fact, as well as which days and times he was or wasn't here, and believe me I have that all documented as well. Not to mention, he himself says he had "almost all floors covered in plastic". His contact states "Once 321drywall has assembled ALL protective materials, nobody is permitted on site". He himself admits to not having completed ALL of the prep, therfore even if I were to have been on the property (which i wasn't and can prove), I didn't break any contractual agreements. You also cannot legally deny entry of a homeowner to their own property, no matter what your little piece of paper says, that's Florida law, which trumps a printed paper. Any reputable drywall company wouldn't run ** while doing major drywall work or they'd risk damaging the ** handler with dust, and cause debris to buildup in the ductwork. He just wasn't comfortable with the temperature, and I believe he didn't plan to do the work to begin with. Also, he claims to be licensed and insured on his website, yet no license numbers are provided, nor can we find him licensed with ***, ********, or **************, nor can we find him registered with any general liability insurance with the county, or city he lives in. This all means, he is potentially practicing unlicensed and uninsured work, better hope not. He claims I called him screaming...I never called him, he called me in fact. I fired him via text, as the text message shows. He called me being irate, and kept talking and yelling over me (on speaker phone), at that point my father took the phone and chewed him out. The text I've provided shows that, as well as the fact he felt the need to make a snark comment to conclude our talks, if that gives you any idea of the person i was dealing with. I know he's not willingly going to offer any type of refund, but I'd advise him to learn Florida law, as I paid more than the required 50% stated in his contract, so that right there wins the case in court. I have much more proof and backing arguments, but I'll save those for court. Funny how he has screen shots of certain things, yet nothing to prove anything about him not showing up Friday. He also stated it was his decision not to start on time due to him not being comfortable. Contractors work in houses that don't even have ** installed yet, that's a privilege, not a right, and certainly nothing your contract outlined as a necessity.

I hired 321 Drywall specifically because they had five star reviews. I have since been told that a lot of contractors have people randomly call them and offer five star reviews in return to be paid money.
Everything started off fine, estimate was given. Signed contract. The first day Johnathan said he had car trouble. No big deal that happens to all of us. The next couple days they showed up and did work and everything was fine. After that things got strange and uncomfortable. Johnathan said they would show up at a certain time and then two hours later wouldn’t be here.
He also within a seven day stretch didn’t show up three different days.
The last excuse was that he had the city of Melbourne at his house, and he needed his guys there to clean something up.
The attendance is something I can work with as I understand a lot of contractors run multiple jobs at once. No big deal.
The problem was before he was finished for the work. He said he was giving me an estimate of the work that he had finished and wanted to be paid for it. I explain to him that the math was wrong on the estimate. Then he started yelling at me in my house, about why wasn’t I going to pay him for the work he finished. That’s when things got very uncomfortable.
I explained numerous times that the math wasn’t adding up, he didn’t care. He gave me a hard time until I wrote him a check, which ended up being over the contract price.
Work never got finished. I paid over the contract amount. Many other issues. Had to new contractors come in to estimate fixing and finishing and it’s going to be at a minimum of $3200. Both contractor said the work was horrendous. My time has been wasted. My money wasted and having to fix my locks on my door that I never had any problem with until I hired these contractors.Business Response

To provide complete context for this complaint: An initial walkthrough was completed with the client on 09/26/23. A written estimate and service agreement was created which detailed the services desired by the client. The service agreement was signed by the client on 09/26/23 and a nonrefundable deposit was made on 09/26/23. The contract's signature indicated satisfaction with the price estimate and scope of work to be provided.
Non-contracted work was requested after signed contract (e.g. installation of closet doors and bedroom doors, framing header for bi-fold closet doors for AC closet, attic access in enclosed garage ceiling, painting of baseboards and crown molding, and the completion of additional drywall patches, skimming the walls smooth in laundry room to match the walls, I redid in the enclosed garage). The work estimate was discussed accordingly to reflect additional work-hour and materials costs, and a new price was presented to the client which would be reflected on final invoice. In an attempt to maintain client satisfaction, the price for additional work was greatly discounted from the standard hourly rate. This information was explained clearly to the client. At this point, the client was happy and agreed to pay me for the services already completed, as she kept adding more work which was going to add to the timeline. Client was unsatisfied when I told her that I could not change my schedule and I needed to finish her job as we were already delayed by the drying of excess mud necessary to skim her walls; she restricted entry from an in-progress work site, breaking the terms of the signed service agreement which requires access to the property for on-time service completion. Many attempts were made to finish the job and uphold the services detailed in the service agreement, but the client was ultimately unwilling to proceed.
Addressing individual, unwarranted claims in the complaint:
1) 321 Drywall does not condone or participate in the creation of fraudulent reviews. There is no evidence to justify this claim, and many of our customer reviews contain job site photos and other unique personal information.
2) An estimated completed time was provided as part of the initial service agreement. All tasks were scheduled so that initial work would be completed by this time. The job was left unfinished due to client’s termination of the service agreement.
3) An additional item was expressed by the client on a similar complaint published to Google Business Reviews on 10/20/23: "I did tell him I was going to hold his tools until he paid me back for the unfinished work." After breaking of the signed service agreement, technicians were restricted from completing a job site cleanup and retrieval of their personal tools. This behavior was found to be unprofessional and inappropriate.
4) During the in-progress phase of the job, the client indicated that several exterior door locks were greater than 10 years old, we noticed they were not rated for exterior use, causing them to be fragile/problematic. See photo.Photos attached, please review. Work site was done properly, prep work was done to ensure cleanliness, and job was cleaned on each stage. All initial contracted work was done except for the priming and painting and the additional work was still needed to be performed (e.g still needing one piece of trim for attic access, still need to finish hanging doors, only one closet door was installed, still needing skimming walls in laundry room smooth). Additional work that was performed, attic access, 3 additional patches, installation of one bi-fold door, framing of header for bi-fold door for AC closet.

The client has provided additional claims about 321 Drywall, LLC that are not backed by supporting evidence. The attached image file, titled ************ depicts that screws were missing from the client’s exterior deadbolt lock (i.e., the lock was previously tampered with) during the in-progress phase of the job, owing to its fragility. The client has also chosen to withhold any evidence and/or documentation to support the claim that an additional contractor was hired. The photographs provided by the client ****** **************, depict a clean, in-progress work site, with plastic-lined window and floor surfaces providing protection from all-purpose drywall mud that was sprayed using a texture machine. ************* depicts an attic access door that has been opened slightly and surrounding trim covered in a protective masking tape. ************* depicts an HVAC duct termination that has been sprayed with all-purpose drywall mud texture. This material is water-soluble and can be removed during the cleanup phase of the job. This phase of work was not reached and was refused by the client. Image ****************************************************** depicts a damaged corner seam in an area with original popcorn ceiling (before any work on this area had commenced). ************* depicts crown molding and wall/ceiling during the in-progress phase of the job and before any caulk/joint compound was to be applied.
Ultimately, the client broke the terms of the service agreement signed and dated 09/26/23. Even after the service agreement was broken and 321 Drywall, LLC was dismissed from their contractual responsibilities, due diligence was undertaken to complete the job and clean up the job site. However, the client refused entry and the completion of any remaining work/jobsite cleanup. A refund was offered for remaining expenses from this point onward, but client did not accept. Then, client tried to tell me a week later that she wanted $5,000. If required, dated text messages from the client can be provided, but this correspondence has been withheld with consideration for the client’s privacy.Customer Answer

I never asked for $5000. I took a video of the lock, because when I found out that both locks were broken, and had been previously working. The locks were snapped. Both of them. Also, Johnathan went back-and-forth about coming to finish the job, yet he kept saying stuff would come up, and that he wasn’t able to make it. I provided a video of the door locks that were broken. I also provided text message of him saying he was going to Pay me some money back for the unfinished work. He never paid anything back and he never finished the job. And it got to a point after the locks were broken and going back-and-forth that I did not feel safe having him in my house. I would like my money back for the unfinished work that he did not do. I had to pay someone thousands to finish it. If any proof is needed from text message I can provide. I also know of other people who have been scammed by him who are currently going through issues as well and are getting an attorney. I’ve had people reach out to me that have said that they had work done by this company and got totally scammed.

Me and my husband signed a contract for popcorn removal and painting the apartment with 321 Painting, LLC and paid $2,000.00 deposit.
Contractor ( Jonathan T*******) knew that we needed additional insurance for condo and agreed, but now he is refusing to sign and made some terrible accusations toward us because of that request, he thinks that we want to take advantage of him.
Also, after payment was made he asked us to file a Notice of commencement saying that it's required by Township. I called township and because we don't have to pull permits that is not a requirement for us and we don't want to sign it.
Also that is very few pieces of furniture in the apartment and he asked us if he could move them to the garage and we said yes, but now he is asking us to hire someone to do it.
Lastly, he wrote in contract that people will not be allow to get in the apartment while he is working and now he is saying that we are also not allow to go in. I am the owner, I need to access property to verify that things are going well as promised!
It has been very hard already working with him and he is not doing what he promise by contract, he also said that there is not way for him to agree on insurance and that he will not do anything without the letter of commencement.
We asked him then to refund us the $2,000.00 deposit since he is the one that is refusing to do the job and he is breaking contract, he is refusing to send money back with the excuse that contract said " no refundable".

In lieu of clarification, our company is registered as "321 Drywall, LLC".
With regards to this complaint, the following events took place:
Client and 321 Drywall, LLC had established a contractual agreement - via written consent on 10/03/22- for a job that we were to perform on her property. Agreement had multiple conditions; one of them being a $2,000 non-refundable deposit. Deposits are designated to all contracts to secure job start dates.
Before proceeding with the job, client requested additional services (not included in original agreement) to be performed on her property while unwilling to pay for these services.
Additionally, she was not satisfied when informed that we needed the space to ourselves, in an uninterrupted capacity, to perform our duties (safety concerns) even though these clauses were explicitly documented in our original contract.
We did provide her an opportunity to renegotiate conditions. We went as far as adding a five year workmanship warranty, as well as, release of any/all liability, as courtesy. Client asked that she be listed on our insurance policy which we were not willing to comply with. These disagreements led us to ask her to provide a Notice of Commencement letter, as this job was being excessively prolonged. She refused.
We fulfilled our obligations of the contract and held start date until 10/24/22, Monday. Client canceled on 10/21/22, Friday. Client emailed us stating she did not want to move forward, forfeiting her deposit.
