Subject: Re: Better Business Bureau Complaint Final Notice

I am responding to complaint ID *********

Work to be performed by ironman spray textures inc. Will install electric for fan in living room spray insulation as far as able to reach will sheet rock walls and ceilings will complete both bathrooms will install hot water heater cabinets flooring and paint will also install trim labor only.

The original proposal is as written above.

***** ****** was adding & constantly changing the agenda for the work to be performed.

***** ****** advised me she had most of the fixtures at her house such as faucets, toilets etc.and  all of the cabinetry for both bathrooms. This was untrue.

I was not supposed to have to pick up any materials which I did at the beginning but then ***** ****** had me spending hours upon hours of my time searching and delivering items to her home.

I purchased the cabinets, tile, shower supplies to build it, paint, doors , some trim, all the extra valves and extra plumbing, drywall, insulation, exhaust fans & fixtures.  ***** ****** did reimburse me for these as I  saw in some of the checks that she produced on her complaint.  She declared she was not going to pay me anything additional amount for re-designing  the bathroom & all of the plumbing and electric that goes with it.

***** ****** wanted me to go shopping for her and pick out & pick up her tile. I ended up taking her shopping for the tile  to ***** * ***** and ***** because I did not feel comfortable picking out her tile for her.

***** ****** did not have any cabinets onsite to install. When she finally decided on some that she wanted, she had me driving all over the place into two different counties to different Lowe's stores for over three weeks. This was extremely time consuming.  She did not want to pay any extra for my time.

***** ****** changed the color of the paint which changes the amount of work on walls when matching the original walls and new drywall are involved.

She added three more fans and running electric to them in addition to the one fan agreed upon. I ran the electric for the additional fans to the box This included holes in the ceilings and walls  to run the wire to the box. . She stated all bath hardware was in the unit. Then she upgraded the bathtub  to a jacuzzi tub.  This now needed upgraded electric & plumbing for the tub. I built the jacuzzi frame to level it & moved the drain which is a very time consuming and more expensive change.

The other bathroom was completed minus one  toilet & mirror were not installed.

The agreed upon price for the original contract was 12,500. ***** ****** paid me 9,700 for work performed. As  stated earlier she continually added items and changed the design of her bathroom several times. I did way over the amount of labor for her that was  paid. She was not going to pay me for any of the extra time and labor for much of what I had already done for her.  At that point could not continue the work for her without her agreeing to change the contract. She then threatened to sue me.

I am the one who was taken advantage of. Originally she told me that she had other issues with 2 different companies who supposedly left her 'high & dry'. It appears to be a reoccurring event for ***** ******.

    thank you,

    ****** ** ****
