    I paid him to design a pool and he never did the work. He promised a refund for months which never came.

    Im sorry I had spent more than 40 hours on his pool design project. The customer received the project.

    June 8: I hired Kayne to design my pool. I sent him a detailed description of what I wanted with every size, location, and setback described in detail.
    June 22: Kayne sent me a design. The shelf was in the wrong location. The bridge was in the wrong location. The number of bridges was wrong (we asked for 2 and got 4). The firepit was in the wrong location. The lawn was in wrong location. The side setback was wrong. The rear setback was wrongs. We asked for a lawn but got a putting green. The pool size was wrong. The pool shape was wrong. The sun shelf was in wrong location. The waterfall size was wrong.
    July 26: Kayne had not made the changes requested and we were forced to hire another designer. Kayne said "Did you want to go with another designer? I can refund your design fee."
    August 5: No refund received. I reach out to Kayne.
    August 24: Kayne says "I am checking my account. If it is not deducted I will send (the refund) back directly on Square Up today."
    September 2: No refund received. I reach out to Kayne. No reply.
    September 7: No refund received. I reach out to Kayne. No reply.
    September 15: No refund received. I reach out to Kayne. No reply.

    For him to say on October 20 that he spent more than 40 hours on the project and that I received it is absurd. The project he sent was nothing like I requested. This is why he promised me a refund multiple times.

    Mr. ****** ***** feels initialed to have people do his design work free and then get refunded. ****** ***** was set out to have me design him a $800,000 swimming pool and use my ideas and design concept to achieve his goal. He paid the design fee and I was compensated for my work, but to have me refund him the money back stating that my 40 hours of creativity and work was and should be free is not correct. In his business, I'm certain he gets compensated very well to afford a $800,000 swimming pool. He received the design and said it was not good enough even though he most likely is building the same pool. I designed everything he wanted me to do and then fired me asking for his money back, unbelievable!

    We can't get bids on a pool design that wasn't completed, so I don't know where the $800k estimate came from. Regardless, I came up with the ideas and concept myself. Your changes to that design were the problem. If it is not correct for me to get a refund, why did he offer one over and over again as detailed in the dates below? It is not a question of whether the design was "good enough." It simply wasn't what I asked for. I am not building the pool he designed. Luckily I found and paid another designer to do what I asked. I will be filing a claim for a refund and damages. We can let the court decide.
