      I am the treasurer of a professional society, the ******************************************* (************). We had our annual meeting in *****************, from July *****, 2024. We had hired Fireworks Over Miami to provide entertainment for the evening of July 12. We provided $5000 on May 14, 2024, then $375 on May 15, 2024. We then provided the second part of the payment on July 1, 2024, $5,375.00 via Zelle to ************** (Lutgardo "******" *****). We learned a day or two before July 12, 2024 that the organization, Fireworks Over Miami, had not secured the necessary permits from the city, therefore the fireworks display was cancelled, and we had to scramble to arrange an alternative entertainment. We requested a full reimbursement. On July 23, 2024, we received $5375 via ACH to our society's bank account. We requested the second half of the payment, but despite multiple attempts to reach the organization, they have simply stopped responding. We engaged a collections company, but the fireworks company will not respond to them either.

      Dear Ms. Mitchell,

      Thank you for reaching out. Attached, please find the original signed invoice for the Fireworks Over Miami (FOM) event, which was to be held on July 12th. Note the handwritten note by the representative for FOM the FOM would obtain all needed permits. They do have a note that cancelling the event would result in a 50% refund, but the Limb Lengthening and Reconstruction Society (LLRS) did not cancel the event, it was canceled due to the failure of FOM to obtain the needed permits.

      I am sorry for delay in answering  had very difficult.  .personal time .

      This customer was paid back in a zelle paymemts.  Please have him check his records  . And I will try and find the pay. 

       The issue was a draw brige in Miami Beach prevented  boat captain from get to location on time . We tried  and shoot from the beach and the firemarshal  prevented us from doing so . 

      But the refund was made in full by zellle

      I am rejecting this response because Mr. Perez either is very forgetful/confused, or is obfuscating. I have included the email chain between him and our executive director, Karen Syzdek. She continued to press him for a refund after his services could not be rendered because he had not gotten the necessary permits to do so. In email after email (and there may be a few that I do not have myself, but can access them if needed), he states that he has mailed a check or some other way provided the payment. His ploy was apparently to pay half of what we paid him, then pretend that the other half was lost in the mail. But, at the top of the attachment, I have included the only payment we received as reimbursement - a wire transfer of 50% of the amount we paid. Eventually, we passed the issue on to a collections agency. To our surprise, he stopped responding to them, without providing any sort of excuse or explanation. That is when we reached out to you.

      We greatly appreciate your help in this matter. At the very least, we want future perspective clients of Fireworks Over Miami to know that they may not be dealing with a forthright and trustworthy company. I look forward to what further news you may have, and would gladly provide more information as needed.
