I am rejecting this response because: that is untrue. They had the vessel all week to determine any mechanical issues wrong with the boat. They have a mechanic on site in order to be able to assess the boat and determine if the boat is safe and ready for the water. They had the boat for almost 2 weeks. When selling any type of item that is something someone drives and can put their lives or others in danger is the responsibility of the dealership to do a full assessment of the vessel so the buyer understands what they are buying. Even if the vessel is as is the buyer should be informed every single flaw that is able to be assessed in order to prevent harm or any dangerous surprises when the vessel is purchased. The fact that land o lakes marine did not care to inform us or were too lazy to do an assessment of the vessel is unethical business, and therefore should be held responsible. I should have been informed of every single thing wrong with that vessel. The mechanic I took it to was able to assess the vessel in minutes to show me things wrong with the boat and the lack of safety it had in order to take the vessel out on the water. Land o lakes marine told us the horn was working. Which is also a hazard in itself if the horn is not working. We found out by the mechanic we took it to, since we cannot trust anything Land o lakes marine says, the horn was so corroded and in no way working condition. Which is another hazard we encountered. See pictures attached. You tell me that is a working horn and can live with that? Again, putting my family and others in danger because of not doing a proper assessment of the vessel. This is bad faith dealing and unacceptable. Land o lakes should be held accountable in some regard.

    Sincerely,

*********************** the stereo wasn't working. We were able to get it in gear. Then, we went just a couple miles out to a sandbar(since it was a new purchase did not want to risk going far) and when we went to leave the sandbar it was fully stuck where we could not get it out of gear. We had to call a tow which costed us $400. I asked LandOLakes Marine to please let me know if anything needed to be fixed and I would get it done and leave it with them to get fix and pay for whatever it needed. They confirmed it was safe to take out and they would just do the trailer springs next week. All I want is to be reimbursed for my tow fee since it was NOT safe to take out. We were terrified, had children with us and were stuck for hours. I am not asking much and only for the tow fee of $400 since they had it all week to tell me if something needed to be fixed but ensured there wasn't. They did NOT look the boat over like promised.

    Business Response

    Date: 06/04/2024

In response to the claim that we were aware of any issues other than the ones discussed at closing and accepted by the buyers, we had absolutely no knowledge of anything wrong with this vessel. The fact that the day of delivery, the customers did a thorough on water demonstration in which the pontoon performed flawlessly. This is all we can do as a dealership to make sure the vessel is water ready. As with anything used (10yrs old) boats can have wear and tear and deterioration which is impossible for us to be aware of unless there is a malfunction. We offered to give the ****** credit for their tow against the repair bill and were informed that we were not trusted so they took the vessel elsewhere. We are empathetic to the fact that the first time out they had an issue and would have worked with them to get the boat repaired at the lowest cost possible. unfortunately, they chose to take the boat to another facility. As stated on the purchase agreement clearly the boat was purchased in AS-IS basis. Thank you for your platform so both sides can be heard.
