    Please see the attached documentation that includes copies of email messages to Tropical Bamboo as well as a complaint sent on June 12, 2023 to the ******* Attorney General. To date, there has been no response from Tropical Bamboo nor the Attorney General. I bought 16 bamboo plants f in good faith believing that they would honor their guarntee. Your help with resolution would be greatly appreciated. Sincerely, *************************

    The invoice/sale referenced in this dispute was for ********* **** in October/2022 (invoice attached).  We (Tropical Bamboo Nursery) have email communication with the complainant, *************************, beginning November 21, 2022.  All communication was between ************************* and our employee (*****************), who no longer is employed by Tropical Bamboo Nursery (as of May/2023).  
    ************************* (not ***************************) has requested a refund (per our guarantee)  for live, tropical plants (bamboo) that did not survive the winter in the ******, ** area.  

    This is our written guarantee (also clearly printed on the attached invoice).

    Guarantee:
    Our 90-day refund or replacement guarantee applies to bamboos that have been properly planted, watered, and maintained outdoors in the landscape in an appropriate tropical or subtropical climate. If a plant fails due to, or has a problem related to, a cultural factor here at the nursery, we guarantee against such problems within the 90-day window.  

    ******, ***** is not a tropical, or sub-tropical climate.  The **** climate zone for ****** is zone 8.  The MINIMUM **** climate zone listed on the bamboo species purchased is 9A.  The LOW temperature in ******' winter of 2022/2033 was 11 degrees F.   The MINIMUM, non-sustained temperature for the tropical bamboo plants purchased is 21 degrees F.   
    Our 90 day guarantee is/was no longer valid when the bamboos were planted in inappropriate conditions.
