    On On February 4, 2016 I purchased a standalone/perpetual software aka ************ Catcher and its license *************************** from **********************, LLC., for $39.95 Almost every subsequent year or so Applian LLC., blocks the software and demands to pay upgrade charge of $14.95 to be able to use the software. Since 2016 *************, has repeatedly extorted additional amounts from me and I have been forced to pay $14.95 to keep my software/license active. On July 13, ***************************, LLC., again started to block the software and demanded additional amount of $14.95. when I refused to pay and not upgrade my software, Applian, LLC., permanently blocked my software. My request for a refund was also ignored. **************** completely stopped responding to my requests. Not only that, Applian, LLC. added a disclaimer after my complaints on its website to cover up this scam The subject software was never offered or sold as a subscription, but as a onetime paid standalone/perpetual license. This company has duped too many consumers with this scam and continues to do so.

    The software is sold as a license to use the version the customer purchased on original purchase date. Updates are included for either one year or two years for free depending on which term the customer purchased. Once this term expires the software will no longer be eligible for upgrades or extraction engine updates for free and therefor we offer a modest renewal fee in order to continue to receive these upgrades and updates.

    I am rejecting this response because:

    At the time of the software purchase on February 4, 2016, Applian had no such policy, nor was I made aware of this policy and moreover I never agreed to or signed on such agreement. In fact, Applian started and even posted this policy online after numerus customers including me, complained about it.
    Applian maliciously starts to block the software and strong arms a consumer to pay for the upgrade even when the current software is working fine and even if a consumer does not want to upgrade.
    So far, I have been forced to pay 4 times for the upgrades although I never wanted to and as I am not contractually obligated to do so. I would like Applian to either unblock my software (which I have already over paid for) with full functionality or refund an amount of $99.75.

    The cited software firm in my claim, "Applian LLC" also known as "Applian Technologies", breached ******************* (End User License Agreement) when they abrutlly and without notice discontinued to validate all my licenses/registration codes of all my previously purchased applications. With a pop up message stating: Your registration code XXXXXXXXXXXXXXXXXXXXXXXX for ************ Catcher has expired. In order to keep using the latest version we suggest that you upgrade your license. The same corresponding message now appears in all my previouly purchased applications, which were working correctly with all their features and are now all truncated to only "Demo Mode" operation, despite having been purchased as full applications with no limitations and ******************* does not state any time period and/or date limitations. Thus the **** has to be considered perpetual. I do not claim that they have to provide perpetual technical support, but they do not have the right to stop validating my purchased licenses/registration codes, to inhibit the full feature operation of my applications, in a process that can be considered an extortion, where they ******* refuse to solve the issue, stating that one has to either "upgrade", if not loose the full operation of all previouly purchased software apps. The only explanation they have provided has been with mentioning issues with Windows 10 & 11 as subterfuge, when that is not the case, it is their servers and validtion processes that are inhibiting my application from fully working. They good very well stop thier online proceedures of validating the legacy software very time that it is run. Which would equivalente of the application running offline without any Internet access. But then they would not be able to intervene to inhibit to operation of the software of their client base, forcing all to purchase new versions or upgrades. Attached please find my emails with them, covering these issues.

    I am rejecting this response because:
      My complaint clearly stated that the software applications I previously purchased from the firm Applian LLC, in no part of their **** does it state that there is a limited time period or expiration date of their license. Thus, their offering to extended the license for additonal year, is a null proposition, since the softare I have previously purchased from them and is the issue of this complaint, can be considered as having a perpetual license.
