Just a quick update on the parts we ordered for your system. We received one of the items today and anticipate the arrival of the other component shortly. As soon as the second part arrives, we will reach out to you to arrange the installation at your convenience.

For your reference, here's a summary of your recent service history with us:

    * **June 2019:** New unit installed.
    * **December 18, 2020:** Yearly maintenance performed.
    * **December 9, 2021:** Yearly maintenance performed.
    * **2022:** No service visits or maintenance performed.
    * **December 8, 2023:** Yearly maintenance performed; issue identified requiring condenser replacement.
    * **December 21, 2023:** Condenser replaced under warranty.
    * **January 4, 2024:** Freon levels checked and confirmed to meet manufacturer's specifications.
    * **March 26, 2025:** Routine maintenance conducted. Please note that yearly maintenance was not performed in 2024, which is necessary to maintain your warranty. During this visit, we also informed you that we do not undertake ductwork due to the presence of water lines in your attic.
    * Our records indicate your ductwork was replaced by another company on May 1, 2025.
    * **May 6, 2025:** Service call; our technician found and corrected an incorrect thermostat configuration for a two-stage system instead of your unit's modulation system. We are unsure when this setting was changed, possibly by yourself or the company that did your duct work.
    * **May 19, 2025:** Our technician found the front panel of your unit detached and the float switch bypassed. We want to emphasize that your system operates at a high voltage and incorporates advanced technology. For your safety and to ensure proper functioning, it is crucial that all work on your unit is performed by qualified, licensed professionals. Improper handling by untrained individuals can lead to significant safety risks and potential damage. We strongly recommend entrusting all future service and repairs to licensed technicians.

There are two items on order for your system repair.

BBB is unable to locate the business.
On April 29, 2024, for about $11,600, the company installed at my residence a Daikin heat pump system. The total included almost $1,200 for extended warranty. When the contract and other documents were signed, the company did not provide me the warranty document. In spite of my emails, the company declined to send me the original warranty. Further, the company declined to provide the necessary repairs to eliminate water dripping onto the filter.Since installation, I have observed water dripping from the coil area of the air handler directly onto the air filter. This dripping has resulted in two symmetrical rust-colored bands forming on the filter. In late October 2024, the company replaced the coil and, at that time, I found the filter completely saturated with water. The filter was replaced.During a maintenance visit earlier this month by the company technician, the newly installed filter was not saturated (likely due to cooler weather and sporadic system use), but fresh ***** bands have again appeared in the same pattern on a new filter, along with moldy spots, indicating that the underlying problem persists.I contacted Brevard Cooling and Heating and was told that the reason of wet filters was that the filter was placed at the lower tray, and should have been placed at the upper level (an inch difference). I thought it defied logic; the problem is dripping condensed moisture, not a filter position an inch higher or lower. In spite of my emails, describing the existing issue, the company refused to take any action to fix the problem. Instead, it offered me to buy for $1,000 some sophisticated electronic filter, that would solve the problem. The heat pump manufacturer does not make nor recommends such devices. According to the contact, the company was supposed to fix any problems within the first year without service call fees. I suspect they did not not want to provide such service. I will not pay the fee now; it should have been done long time ago.

A complimentary preventative maintenance performed on your unit on April 22, 2025. As you know, the evaporator coil, which was part of the unit purchased in April 2024, was replaced under warranty in November 2024 due to a defect.

During the recent maintenance visit, our technician observed that the air filter was not positioned correctly within the filter rack. This incorrect placement caused the filter to be drawn into the evaporator coil, resulting in dampness from contact. The filter rack is designed with rails to prevent this from occurring, and the technician advised that the filter should be placed correctly within these rails.

At the time of the maintenance, the technician inspected the coil and did not observe any signs of dripping. He mentioned the ************************** as a potential option for future consideration if you have any concerns about potential growth within the system.

We want to emphasize that since the initial installation in April 2024, we have not requested any payments from you for service calls or other expenses.

    Complaint: 23268906

I am rejecting this response because I found it evasive and unsatisfactory; you blame the filter position placed in lower as opposed to an inch higher tray for condensed water dripping from above. I reviewed Daikin EEV Series Air Handler installation Instructions, and I failed to find any reference to the preferred filter position at either tray. One could question the air handler design with two trays, if one results in water dripping from the coil onto the filter. Further, on page 26 of the Air handler Installation Instructions, under Replace or Clean Filter, there is no such instruction either, recommending either tray for the filter insertion.  Apparently, it does not matter.

Your two different technicians, one who replaced the coil in late October 2024, and the other who performed the annual maintenance in April 2025, placed the filters in the lower tray.  Apparently, it does not matter.

Please note that both trays have identical rails, holding the filter in the same positions.

You also claim that your technician performing annual maintenance found no condensation on the coil.  I reviewed again his System Efficiency Report dated 4/19/25 and I could not find any reference to the dryness of the coil. I doubt your technician relays to you any additional reports, not shared with your customer, beyond the impressive list of Full System Check List.

As your office suggested in an earlier email, I placed the filter in the upper tray and, perhaps, the secret trick will solve the problem of water dripping onto the filter. The hot Florida days have not yet arrived, the heat pump works for a limited time each day, and it is too soon to determine whether the problem has been solved just by placing the filter up, an inch closer to the coil.

I will check the filter periodically and I wait until, lets say, mid-June and, if the filter shows no absorbed moisture I will be delighted and thankful for your such simple advice.  However, if it is wet, I would expect your company to expeditiously and permanently correct the problem.  I believe the problem of water dripping onto the filter should have been resolved within the first year of installation, without a service fee, as per our contract. Thus, I will not  pay any service call fee. If that is acceptable for your company, please state so in your response.

    Sincerely,

    ****** Charminski

Just to clarify regarding the filter, there is a designated space for it within your unit, as our technician noted. He also confirmed that there was no evidence of water or moisture dripping from the evaporator coil during his visit. Had he observed any, he would have investigated further to identify the cause. The original issue was that the filter was being drawn into the evaporator coil, resulting in a moist filter due to contact with the cold coil.

As your evaporator coil was recently replaced in November 2024, and your system is currently operating and cooling correctly, there is no indication of any problems with the coil itself.

Please also remember that while your system benefits from a 12-year warranty on both parts and labor, this warranty does not cover the service call fee. This exclusion is clearly outlined in the labor contract and was also communicated verbally at the time of purchase.

Should you experience any further issues, please do not hesitate to contact our office, and we will be happy to schedule a service call for you.

    Complaint: 23268906

I am rejecting this response because despite multiple communications and attempts at resolution, the company has refused to acknowledge or rectify a material issue arising from the installation. Notably, the unit has been leaking condensed water onto the air filtera problem that compromises the performance of the system and raises questions of durability and hygiene. Brevard Cooling and Heating proposed an inadequate solution: relocating the filter one inch closer to the source of moisture. This "fix" is not recommended by the air handler manufacturer. A second proposal, offered in writing, was to install another filter at an additional cost of $1,000despite the fact that the issue falls within the scope of the extended warranty provided at the time of purchase.
Brevard Cooling and Heating failed to provide a copy of the extended warranty agreement at the time the installation was completed. It required three separate requests over email before I was finally provided with a legible version of the warranty terms and conditionsa year later.
Moreover, the installation of the exterior heat pump unit was substandard. The unit was placed on a pre-existing concrete slab, frequently flooded during typical Florida rain events. The installation also lacked hurricane brackets, a clear violation of applicable Florida building codes. As a result of these deficiencies, the City inspector refused to approve the installation. It is hard to believe that I have been dealing with a solid and reliable HVAC company.
I previously submitted a good faith offer to resolve this matter amicably. Unfortunately, Brevard Cooling and Heating has not demonstrated any willingness to comply with their contractual obligations or the warranty protections they sold me. The companys pattern of evasion and noncompliance has left me with no choice but to seek external assistance.
I remain open to a fair and equitable resolution that includes honoring the warranty, correcting the installation deficiencies, and addressing the dripping water issue in a manner consistent with manufacturer specifications. Water still drips onto the filter placed in a higher tray.

    Sincerely,
    ****** Charminski

A service call visit was made on January 31, 2025. During this visit, our Senior Technician discovered that his HVAC unit had been previously serviced by another company, and unfortunately, they left it with cut copper and damaged evaporator coil. Due to the damage caused by their actions, we are unable to take responsibility for the necessary repairs. While we do not follow diagnoses from other companies, our service technician did offer a service call and leak test during his visit, which Mr. **** declined. Mr. **** refused to pay a Service Call or authorize a leak search; instead Mr. **** asked for a quote to replace the unit which was emailed to him the very same day. Please see attached signed invoice stating the above. This unit had not been maintained since 2016 by Brevard Cooling & Heating.

I am rejecting this response because:

Brevard Cooling and heating (BCH)'s attachments and response do not make any sense, and do not support the fact that BCH breached the contract and refused to honor 12 year labor warranty signed on 7-24-2015. My complaint is regarding the parts and labor warranty coverage for my Daikin AC unit, which was installed and offered by *** in July 2015.

I purchased a Daikin AC unit from BCH for $6,517, which included a 12 years labor and parts warranty. Since then, I had purchasing a box of filters from *** in 2016. Until recently, I had not requested any warranty-related repairs since 2015. However, when I contacted ********** multiple times in 2023 and again in 2025, I was repeatedly informed that there were "no service records" for my unit.

Such false response raised concerns about whether Brevard Cooling was intentionally avoiding honoring the warranty or not. Eventually, ******* from *** team acknowledged my status and informed me that maintenance must be performed by a certified, licensed contractor. To comply your requirement, I hired a certified technician from licensed contractor to conduct a leak search. After this, I reached out to your office again and scheduled an appointment for an evaluation. On January 31, 2025, your technician, ******, visited my home.

However, the response I received afterward was alarming. In an email, *** stated: "No matter what, the labor warranty is void with us due to the damage of the unit. The manufacturer warranty may still be valid, but that would be up to the manufacturer before anything is replaced. I would check with the company that came out previously."

Seeking clarification and confirmation, my last question for *** was "Are you willing to honor the labor warranty and repair or replace the unit as needed? If not, what is the legal basis for your refusal?"  BCH responses suggests a refusal to honor the 12-year labor warranty, which was a key factor in my original purchase decision. Instead of addressing my concerns, *** sent a vague and dismissive response stating: "We decline any service for your HVAC system. Having another company come out and damage your system voids the labor warranty with Brevard Cooling and Heating."

BCH statements lacks any evidence that another company caused damage, yet it was used as "ground and accuse" to void the labor warranty but made profit in 2015. Fortunately, not all **** businesses operate this way. A reputable local family-owned company has stepped in to assist us, even waiving labor charges to ensure we have a functioning AC unit as seniors.

Dear Mr. ******************* we discussed previously, we initially offered you a service call for $75. However, upon inspection, our technician ****** discovered that your evaporator coil had been damaged by another company. As explained to you, this damage voids our labor coverage, as we are not responsible for the work or damages caused by other companies. You acknowledged and documented your understanding of this.

Based on the damage, you declined our offers for a service call and a leak search, and instead requested an estimate for a full unit replacement. Which was provided to you on the same day as our visit.

I am rejecting this response based on the facts as below. Subject: Breach of Contract and Warranty Obligations

    Dear Brevard cooling and heating:

Brevard Cooling and Heating (BCH) has breached its contract by refusing to honor the 12-year labor warranty included in my original purchase. In 2015, I purchased a Daikin AC unit from *** for $6,517, which explicitly included a 12-year labor and parts warranty. Since then, my only additional purchase from *** was a box of filters in 2016.

Until recently, I had not required any warranty-related repairs. However, in 2023 and again in 2025, when I contacted BCH multiple times, I was repeatedly told that there were no service records for my unit. This false response, particularly from office staff like *****, raised concerns that *** was intentionally avoiding its warranty obligations. Eventually, ******* from *** acknowledged my warranty status and stated that maintenance must be performed by a certified, licensed contractor.

To comply, I hired a qualified technician from a licensed contractor, who conducted the recommended leak search as instructed by *** in an email. I then scheduled an appointment with *** for a second evaluation. On January 31, 2025, BCH technician ****** visited my home. However, the response I received afterward was deeply concerning. **** email stated:

"No matter what, the labor warranty is void with us due to the damage of the unit. The manufacturer warranty may still be valid, but that would be up to the manufacturer before anything is replaced. I would check with the company that came out previously."

This claim is not factual. *** falsely stated that ****** discovered that your evaporator coil had been damaged by another company. There was no damage caused by anyoneonly the standard welding and cutting of two metal pipes required to conduct a leak search. ****** did not perform any work; he simply took a few photos, which BCH attached.

I then directly asked ***: Are you willing to honor the labor warranty and repair or replace the unit as needed? If not, what is the legal basis for your refusal? ***'s response again refused to honor the 12-year labor warranty, a critical factor in my original purchase decision. Instead, *** provided a vague and dismissive reply:

"We decline any service for your HVAC system. Having another company come out and damage your system voids the labor warranty with Brevard Cooling and Heating."

*** has failed to provide any evidence that another certified technician caused damage, yet they are using this unsubstantiated claim as a basis to void the warranty.

    Additionally:

*** has not provided any documentation where I acknowledged or declined an offer to repair the issue under my 12-year labor warranty. **** claim that you declined our offers for a service call and a leak search is entirely false. I have consistently sought **** commitment to honor the labor warranty, not additional service calls or leak searches that would not address my warranty coverage.

***'s refusal to honor its contractual obligations constitutes a clear breach of contract. The warranty coverage for labor and parts was a fundamental part of my purchase agreement in 2015. **** attempts to void the warranty based on baseless accusations and without evidence are unacceptable.

As our records indicate, you had an appointment scheduled with Brevard Cooling & Heating, **** for January 27, 2025, which you canceled two days prior. Despite your cancellation, we made multiple attempts to reschedule and provide the requested services. Unfortunately, you either declined and then cancelled your appointment.

Subsequently, you hired another company, whose work resulted in damage to your HVAC unit. While we empathize with your situation, Brevard Cooling & Heating, **** cannot be held liable for damages caused by another company.

    Business Response

    Date: 03/13/2025

Brevard Cooling and Heating, Inc. provided a clearly signed invoice stating that we would not be responsible for the repair to the coil and line set. This was due to damage caused by another company. The customer acknowledged this (with his signature) and declined our service call and leak search, opting instead for an estimate on a full unit replacement, which was provided on the same day. The customer ultimately chose to have the repair completed by another company.

We believe further discussion regarding this matter is unproductive, as the customer made an informed decision to proceed with another company.

I am rejecting this response because: I have state all facts that clearly indicates *** breach the contract by refusing to honor the 12 year labor warranty and using unacceptable story, unrelated and false info to confuse others, such as, latest "proceed with other company" that cannot prove and defend your refusing to honor the contract as the fact.

    Sincerely,
