      - May 17 - Towing charges - Charging more than the allowed about my the county - Charging a lien release fee to get car back but there was never a lien on my vehicle - no record of lien on ****** or state of florida legal records, company cannot provide proof there was lien filed

Once a car is towed it is under Lien ( do to money being owed) a charge of up to $250.00 can be charged when releasing the vehicle under State statute 713.78

      Customer Answer

      Date: 06/04/2025

      Complaint: 23418628

I am formally rejecting this response. Under Florida Statute 319.27(2)(a), a lien release fee may only be charged if a lien was lawfully recorded against the vehicle. No such lien was ever filed, and as such, there is no legal basis for imposing this fee.

Additionally, Florida Statute 713.78(4) requires towing companies to notify the vehicle owner and any lienholders by certified mail within 7 business days. I received no such notice, and your refusal to provide documentation confirming that a lien was filed or that notice requirements were met only further indicates that no valid lien exists.

I expect this charge to be refunded immediately.

      Sincerely,

      ***** ********

319.27 is if i am enforcing a lien to sell the car and also we had possession so this statute would not apply. the lien(the money owed for impound) was satisfied before the letters had to be sent. (lien i mean under lien)

      Complaint: 23418628

I am rejecting this response because:

Your "interpretation" of FL Statute ****** is incorrect. Possession of the vehicle and the existence of an impound fee do not, in and of themselves, constitute a legal lien unless the proper statutory process is followed and a lien is actually filed with the ***************************** Safety and Motor Vehicles.

According to Florida Administrative Code 15C-21.003(4) and Florida Statute ******, a lienholder must file for a lien to recover storage or towing charges, and a lien release fee can only be charged if a lien was formally recorded. There is no record of a lien filed against my vehicle, and your own admission confirms that the charges were satisfied before any lien letters were issued. Therefore, no lien existed, and no lien release fee can be lawfully charged.

The transaction occurred on march 24, 2025. Firstly this company had no right to tow my vehicle because I was shopping in the mall that owned the parking lot I was parked in. Secondly this company charged me $576 to retrieve my vehicle which is way above the county limit. Thirdly they were trying to charge me $50 to retrieve my wallet from my car which is in my name. Fourth this company towed my vehicle in a way that actually broke the barring on my front passenger side wheel and now I must get this fixed. And finally fifth they have done the exact same thing to numerous other people I know and there are plenty of reviews from other unhappy people.

Car got towed from ************************************* to ***********************************, which is a 5.8 mile drive. According to this link: ***************************************************************************************** (I uploaded a picture), the maximum milage rate they can charge is $3.12 (My car is a class 'A' wrecker), meaning they should have charged me a maximum of $18.41. However, these scammers that run this tow company charged me $59.02. So unless the tow truck driver decided to drive in circles to run up the bill, there is no way I should have paid that $59.02. I did the math and I should be compensated $40.61. Also, how is it possible to charge $56.25 for a gate fee? Is that even legal? I should also tell you that the people that run this place can be very rude and unhelpful. If you guys can get my $40.61 back somehow ill be happy. I uploaded a picture of the reciept I was given.

      Business Response

      Date: 03/31/2025

THE MILAGE GOES BOTH WAY TO AND FROM. NOT ONE WAY AND THERE ARE MANY FACTORS IN THE WAY WE DECIDE TO DRIVE TO GET TO DESTANATIONS.

I am writing to request a resolution for incomplete services and a refund from Kendall Towing and Recovery. On December 28, 2024, Kendall Towing and Recovery returned my vehicle to me via tow truck, fully aware that it remained unrepaired and unsafe for driving. Since that date, I have made multiple attempts to contact Kendall Towing and Recovery Mechanic regarding this issue, yet I have not received a response outlining a timeline for the necessary repairs for which I have already paid. On January 6, 2025, at 12:13 PM, I received an email from Kendall Towing and Recovery stating, "good afternoon as i states anyone with a repair problem would have the truck brought back to the place it was repaired. We towed the truck back to you for liabilitypurpose as in if we wrecked it while driving it would be a problem but if towed we are covered. i have forward all document of the parts replaced to your card company and as of the unsettled payment i have that recourse of wrapping up the bill all together condersideing the truck never left my shop that is camraed and can clearly see all repaires being done on your truck please pay your bill thank you" I wish to bring to your attention that the vehicle is currently unsafe to operate due to Kendall Towing and Recovery's incomplete front-end brake replacement. I have been billed $615 for parts and services that were not adequately provided. Given the circumstances, I no longer possess confidence in the integrity of their business practices. Additionally, I have requested an itemized receipt and proof of purchase for the replaced parts, but these documents have not been provided. I have formally requested a full refund of $615, comprised of $500 paid via credit card and $115 paid in cash directly to Kendall Towing and Recovery Mechanic ***** ****** on December 28, 2024.

Kendall Towing towed my car around 2pm, July 16th 2024. Per the county's official records, the price break down would be as follows: $114.23 maximum base rate, $3.12 + $0.50 mileage and fuel rate, and $24.40 outside storage. This adds up to $205.23 for a 9.2 mile tow. Yet, just an hour later, upon calling the company, they informed me that recovering my vehicle today would cost me $429.

      Date: 08/19/2024

good afternoon there is a new fee the state has put out in the tl26 as of 04/28/24 that we can charge what they call lien release fee of $250.00 on top of those charges which the bill is right on point.
