I hired Florida Home and Dock Life to rebuild my seawall and dock in August of 2021. Since that time, they have promised the work was to be completed in two months. I have not had any of the construction fully completed even though they have asked for money up front to "order materials". Davin Erickson has kept making excuses about why the project has not been completed. I am being strung along and told that if I pay more money the project would get more of their attention. They completed part of the dock project and used inferior material for the deck screws which have started to rust. Davin has refused to replace the defective screws even though the manufacturers representative of the screws tested the screws and confirmed they were the wrong type to be used in that construction location. My dock is unusable and has been for almost a year. There is still scaffolding in place preventing the use of the boat house. The sea wall repair they did is not structurally sound and has started to crack already. Davin has refused to address that problem also. I had not had any communication for over two months. After contacting his office on 1/30/2023 I received and email stating he would have the project done in February. I do not have confidence in Davin or Florida Home and Dock Life to complete the project as promised. I have paid over $41,000. so far and I want a refund of $16,000. to cover the repair of the work they did and the materials and work I never received.

    ******
    I am
sorry you feel this way. We have gone up and above and put up with a lot with
this project. Since the first moment of signing contract, on initial deposit,
you shorted us payment and dragged your feet.  On every single billing,
you shorted us as well.  Your contract specifically states payments to be
made when 5 days or penalty’s will be billed.  We never once did that.
We had a good working relationship for the most part.

Your contract total for the two not including change orders comes to $73,600

Total paid to date is $56,850

You constantly kept changing what you wanted, but I obliged and made things happen for you.

    We
proceeded to demo finally and found your wall was in major need of repair.
We were not able to just do the concrete cap.  Your tie backs were
compromised. We offered a solution, and you did not want to pay for the work.
So, we did the south end connecting to the neighbor's new wall and ran a
mantaray deadman and sealed up wall and poured a lot of concrete. We repaired
cap on North end and fixed that. We built your dock as well and completed that
and added more sq. Footage on top of your contract.

    As
far as the screws. A hurricane came through and submerged your dock completely and everything we built was under water.  Saltwater at that. ***** *** ***** lumber company supplies every single marine
contractor in Brevard County with the same exact screws. Unless otherwise stated in contract, we used stainless steel.  We use those screws
all over and never had a problem. The ******* rep stated they should be 316
grade, but we use those all over as 304.  You beat us up on price originally and wanted cost down as low as I could go.   I
apologize and never once said I wouldn’t replace them, evenn though I used stainless steel as per contract.  I was willing to
eat the cost.  I have never had a problem.

    As
far as your job, when payments are not made in its entirety or delayed for a
period of time, it is hard to run a project.  We do not finance
jobs. Constantly holding monies when they were due because you did not have it readily available was not fair.

    We
have done ALOT of work to your property and a substantial amount of monies Is
still left on the contract.  Your basis of us owing you any monies is
    false.

    Only
thing left on your job is a beamless deck ramp and to wrap up you lift.

    Please
understand, if you would of paid your bills as they were billed and not what
you want to pay, the job would of ran smoothly.

    Your
contract specifically says if your have a dispute, arbitration and mediation
will take place.  Your communication to remedy the situation was non
    existence.

    I
work hard to be a good builder and do what I can for customers.  I brought
in a load of dirt and paid a guy to wheel barrel it for you.  This was not
in our contract.  Added more square footage to land side over concrete.
Never billed for that. Have already installed new boat lift pipe and
brackets.   We dug up your entire wall at Dick and inspected as well as
seal up any openings that we could.

    Through
this Covid pandemic, employee shortages have hindered us.  Then these last
two hurricanes. I’m not looking to upset you or have I’ll will. We want to do
your job.  Your claims of 16k is false and we have documentation regarding
    said monies.

    Your
contract was almost 60 or  70k total with all the changes.

    I
hope that we can remedy this amicably.

    Customer Answer

There are so many lies in the response, I don't know where to start.  Every contractor that has come out to bid on the repair job to fix what FH&DL was supposed to do, has said they have heard multiple complaints about Florida Home and Dock Life not completing the job and taking money on deposit after abandoning the job. Also the lack of quality work by FH&DL has been an issue they hear a lot. Even the work crew that did the work on the dock would complain about their boss (Davin) and how disorganized and absent from the jobs he was.  He never supervised work at the job site that I ever saw.  He showed up once to fix what his crew messed up and actually damaged my property, which he had to fix. There is also another complaint to the BBB against FH&DL that is similar to mine.

My confidence in the ability of FH&DL to finish the job with quality work as promised, has disappeared along with my money they have for work that has not been done.  I'm still seeking $16,000 to complete what FH&DL has not finished and fix substandard work on the dock and seawall. The amount will probably be twice that amount when work is finished.

The change notices they reference were not initiated by me they were made by FH&DL because of bad planning.

As far as the billing, they use a shell game called (progressive billing), that is hard to follow and almost impossible to figure out how much is owed and when payment is due.  Their own secretary told me in person that she has many complaints from customers because of the billing practices of FH&DL.

This project was started almost two years ago and during that time I have heard every excuse I can think of why there was no one working on my project.  After abandoning my project for two months I decided to fire FH&DL and get an honest and reputable contractor to finish the job.

I don't want to waste more time trying to go through every lie in the FH&DL response.  I am done with this dishonest and incompetent contractor (FH&DL) and will continue to pursue legal action.  I hope other consumers see this complaint, and the others, so they don't make the same mistake I did.

I entered into a written agreement with Florida Home & Dock Life in October of 2020 to build a new dock and paid 10% ($3141.87) of the price at that time. The agreement has a provision that the dock shall be completed by September 14, 2022. The owner of the business, Davin E*******, has made several commitments to start on the new dock over the past several months but has never followed through on any of these commitments and nobody from Florida Home and Dock Life has been onsite for over 90 days to work on the project. He has made no attempt to complete the dock by the due date and appears to have simply abandoned the job without ever obtaining a permit. In the 22 months since the contract was signed, Florida Home & Dock Life has failed to obtain a permit, supply requested drawings per the contract, start work on the new dock or deliver any material for the dock. Despite receiving 60% ($18,851.20) of the total project cost ($31,418.65), all they have done is mostly remove the old dock 8 months ago in December of 2021.

We so very apologize for all the delays. Between major price hikes with inflation, lack of staff and supply chains. We have had severe struggles meeting demands and communication. We are diligently working on getting ahead and servicing our clients. We have mobilized and started setting poles this week and will continue to move this project forward. I have been overwhelmed and just not enough staff. We humbly apologize for all the delays. Your lift has been ordered as well as materials and will get this job completed as soon as possible. We appreciate letting us work through this to complete our agreed contract.
