    Aconcagua Windows and Doors was contracted to install new windows and doors for my home. The owner then lied that he was a GC and could do other work on my home. I paid him:- $5,127.65 was paid to you on 2/24/23 for architectural designs - $28,674.90 paid to you 6/2/2022 for the initial deposit The owner Jerry ******** lied for nearly a year and a half that he was going to do the work. We asked a number of times for him to start and show proof that he purchased the materials to start the job, he never provided that information. I have in writing that he said he was going to pay us back and he never did. No work was ever done, and Jerry stole our money.

    Deposit was for replace impact windows and doors.

    The Home owner make change to the project 3 time, we have to cancel material order to make change, 

    3 changes and 3 time we cancel the order.

    that is why took 2 year

    see attach copy of the permit from city and copy of permit fees paid to the city

    the owner decide to cancel all work 1 week after I got the permit.

    we agree to refund part of the money after windows and doors sold for others project.

    owner agree, then got a lawyer to lawsuit (meeting with jugde 1 agust 2024) called miami dade contractor and filing a complain

    now with BBB

    this customer is a property manager who work with me for more than ******* on sales on 2022.

    that why the hire me for her house.

    and that why I accepted so many change on the project without any extra charge on my extra time. or write contract.

    home owner claim on credit card charge for ***** dollares he got back already.

    I dispute the credit card, credit card accepted and return the money to me.

    now credit card want to get money back, since they paid back to the credit card holder / home owner

    I got for collection ***** from the credit card, 

    No available to sales with credit card anymore. loosing a lot of sales.

    I will update you after court hearing.

    I am rejecting this response because:

    Deposit was for doors and windows and we made one change that was never billed to us. The original payment for for the material of the windows and doors. The owner lied that he was a GC and after further investigation by the city of ***** they informed me that he is only licensed to do windows and doors. The owner of the business then lied to us that he submitted a change to the original plans to the city of ***************** for the completion of an enclosed garage. 1 - the owner is not permitted to do this work. 2 - when going to the city, there were no plans submitted to do any of the additional work. So even if we made changes, we asked the owner to start installing what we PAID for and he lied for 2 years that he can't start and then he would disappear for months at a time. Please see attached file Gmail - Jerry 2, explaining that the money we gave him for a permit did not exist with the city after the owner claimed they were submitted. 

    The permit that Jerry ******** is providing is the original payment and permit from 2 years ago solely for windows and doors - After 1 revision, he claimed he needed to get new permits, which he never did, but I paid for. 

    The owner claims that he purchased materials with the down payment. We asked a number of times to show proof and the owner never could. And if he did, we would like those materials. 

    Even much so, on January 26, 2024 - after the owner lied about starting the work, he said he would "I will be today getting all the paperwork to show you what I did. and my record of purchase." - Please see attached Gmail - Jerry 1 for reference of July 26, 2024 Jerry ********. 

    Jerry never provided anything and went dark again. 

    Jerry claims that "the owner decide to cancel all work 1 week after I got the permit." - incorrect statement by Jerry. We decided to cancel working with Jerry because after going to the city we saw no revisions were made, no proof of purchases were given, and he failed to show up to the worksite multiple times when he said he would. jerry also illegally submitted a plan to the city with incorrect information regarding my house with a garage door already built out. There is no garage in our house and this was his way to bypass having a GC permit to complete the work without a permit. Please see attached text messages and emails with dates. 

    Jerry agreed to pay me in full because this is "the second time this has happened to him and he doesn't want trouble." we complied with this request and gave the owner the opportunity to start paying us back. He claimed he would begin payments on Monday February 19th. Please see attached text message IMG_1648

    Once again, the owner went dark and we advised him to communicate with our attorney for a payment plan. Jerry never responded to the letter with any payment plan. 

    Jerry was not a vendor of mine, he was a referral by a company that used him with work through my wife. 

    We were left with no other option but to take legal action. Any sales lost by Jerry are his own fault for being dishonest. The city of ***** is asking me to take criminal charges which I have not yet decided on what to do. The **** is not involved in the investigation. Jerry is not taking this situation seriously and dodging court hearings as well.
