I Went to Kendall nursery and landscape business on 1/20/2024 looking to buy some palm trees for my front yard I spoke to a sales lady her name was ******* she helped me look for the palm and I found seven palm trees that I thought were pretty it was for $2700.00 for all seven and they required 50% down to hold the tress and since I live in a HOA community I told her that I was going to get approval from my HOA before I make the purchase she suggested that I leave a 50% deposit which I did. Exactly 15 minutes later I found out that HOA was not going to approve this type of palms I went back to Kendall nursery to get my money back she told me that I need to talk to the manager and his name is ************ spoke to ***** over the phone and told him I wanted to cancel the order and get my deposit back he refused to pay me back my deposit He told me that I need to talk to ****** I called her and explained to her what I told ***** and she also told me that I need to talk to ***** and I kept calling back both of them I got no response from them then I decided to file a police report on 1/25/2024 which I did and the number is #PD 240124-027567 police came and witnessed the palms are still there at the nursery also they suggested that I file a complaint with the better business bureau to see if you can help me I didnt get the palm trees neither didnt get my money backBusiness Response

Customer called our ********************** to inquiry about our Palm trees. He had explained the association provided him with certain specs that needed to be met and wanted to make sure our nursery had those Palm trees. He came to the nursery and spent about 3 hours looking at our inventory while he tried to negotiate the final price with our staff. After lots of negotiations, we provided the customer with a discount, and he provided 50% deposit to place the order as our company policy requires.
A few hours later, the customer called the ********************** stating the association had informed him the Palm trees were too small and needed to be bigger. We spent 3 days fulfilling his new requirement and we found all the Palm trees per his new specs. At that point, the customer stated the association had denied his project and wanted a refund. We had met every single specification provided by the customer and our staff worked thoroughly to fulfill his order.
We had tried to work with the customer and accommodate him by offering credit with our company for future orders, but he denied our offer.
Unfortunately, we cannot provide him with a refund as our staff worked numerous hours to several days to fulfill his order. We had met every single specification provided to us and nowhere along all the communications we had with the customer he mentioned anything about the project not being approved.Customer Answer

We never agreed to the purchase before the approval of my *** and the resolution is to get my deposit of $1350.00 refunded. The palm trees were never delivered to me, I did not receive them.

****************** has an invoice that was provided to him when he placed the order. He had tried to mislead the police denying he had placed the order. However, when the police came to the nursery, they looked at the receipt and confirmed the order was valid. Also, the police verified that the receipt clearly states that all orders are final.
Then, ****************** called ***** and tried to mislead them as well. Zelle verified the transaction and confirmed that the payment was sent by ****************** and it was a valid transaction.
Now, ****************** is trying to mislead the BBB by making false accusations about the order he placed at the nursery. Customer did receive an invoice (see copy attached) and the order was placed by him.
We had already provided all the documentation needed to clarify the situation. If ****************** does not stop these false allegations against our company, our legal department will get involved and he will have to pay all legal feesBusiness Response

I am rejecting this response because:I never received a receipt for the product that claimed "all orders were final". He sent a screenshot of a Zelle transaction being received to his bank account. I sent a screenshot of a Zelle transaction being sent to him in my previous message, for the records.
The **************************** verified that the products were at Kendall Nursery.
The initial agreement with the saleswoman, named *******, was in order for us to put a hold on them, we were required to put a 50% deposit while we spoke with our ************************ 15 minutes after I placed the order, I went to cancel my order and get my deposit back because the *** had given me a response that I could not use those trees. I simply want my 50% deposit money back. He received no loss of merchandise or product, they are still planted at his nursery.
They are not operating out of good faith. I hope we can get this situation resolved.

****************** called our facilities on various days asking about Palm trees.
After our initial phone conversation, the customer came to the ********************** and walked around for several hours. We answered all the questions he had about our Palm trees and after lots of communications he finally decided to purchase the Palm trees.
****************** sent a deposit to procure the Palm Trees via zelle and an invoice was given to him to reflect his purchase (please see attached). *** the customer provided his deposit we told him all sales are final as the invoice clearly states.
A couple of days after making his purchase, ****************** came to the nursery to let us know the *** told him he needed to upgrade the size of the Palm trees. We then had to procure a different set of Palm trees from the original order but we did it to accommodate his new request.
On Saturday the customer called to make sure we were looking for the Palm trees he requested lastly.
On Sunday, we communicated with the customer and we told him we were still in the process of searching for the Palm trees he requested to fulfill the order.
On Monday we called ****************** to let him know we had all the Palm trees he requested and the order was completed. We also let him know we would hold all the Palm trees at the nursery.
He wanted to negotiate the price because he said he found the palm trees cheaper somethwere else
On Tuesday he called and stated he did not want to do the purchase anymore. He said the association canceled the project. However, he did not provide any proof of documentation in regard to this.
****************** was given the option to receive merchandise credit for future purchases in several occasions but he refused all the options we gave him.
Unfortunately,up to this day, Mr. ******* continues to provide false information and accusations about this transaction. He had lied to lots of different entities and has failed to provide an accurate picture of the whole transaction. ****************** called the police to fill out a report stating that he did not authorize the purchase. The police confirmed there was a valid invoice along with a valid zelle transaction made by him. They also noted that the invoice said all sales are final, no refunds, no returns and they advice him there wasnt anything they could do since there was a legal transaction.
****************** then called zelle and provided them with false and fraudulent information. He stated he did not authorize the transaction, when in reality he did. ***** has conducted a thorough analysis of the transaction and after a long investigation they determined ****************** had made a valid transaction and closed the case.
Mr. ******* has been trying to hurt our business in any possible way by lying and providing false accusations and allegations. We had provided all documentation needed to support our way to conduct business.
After many unsuccessfully attempts to damage our business ****************** called the BBB and your department to continue to fabricate false accusations against our business.
We take our business very seriously. As such, when a customer provides a deposit, we hold the plants and we dont sell them to another customer. If we were to do that, that would be consider a fraudulent transaction. At Kendall nursery, once we receive a deposit from a customer we understand the items the customer is purchasing cannot be allocated nor sold to anybody else.

I am rejecting this response because:My mistake on my previous response, I wrote an error that I did not write correctly. The date that I showed up to the facility was Monday January 22, 2024. I am a senior citizen, please bare with me.
To Begin,
I did not spend several hours walking around at the nursery looking for palms. There was only ***** small palms to pick from in the first place. On Monday, January 22th, 2024, my first time ever going to this place, named Kendal Nursery, I was there for maybe ***** minutes. All my communication was with the sales lady; her name was ******* and another gentleman who only spoke Spanish (which I do not speak). This is why all of my communication was with *******. The individual writing this fabricated story was never at the nursery at any point in time. I never met him. I have never seen him. I dont even know what he looks like. I have only spoken to ******* when picking the 7 palms that I did at the nursery.
******* understood that I needed to get my *** approved for the palm trees in order to complete the purchase. She still said that I needed to put a 50% deposit down. I was not told anything about my deposit being NONREFUNDABLE. And I quote *******, she said, that it should be no problem receiving a refund on my deposit, should I need to.
This individual writing this response, claims that I took a couple of days to let the nursery know that the *** had told me to upgrade the size of the palm trees. This is false. I placed the 50% deposit the day I came to the nursery, On Monday, January 22th, 2024. They did not procure anything. The palm trees that were originally on site, were still in the same exact place in the ground. The police VERIFIED this, when I filed the police report on January 25th, 2024.
Another false series of statements. How logical is it that I would put a 50% deposit on 7 palm trees without seeing them in person. He is claiming I made the deposit prior to January 22nd, when indeed the 50% deposit transaction was made the same day I came to the nursery. ***** minutes after I made my 50% deposit, I asked for my refund. I asked for my refund because the *** did not approve of the Palm trees I claimed through Kendal Nursery. When I went back to get my deposit, ******* was shocked the manager refused to give me my deposit back. She said it herself, that it was not right and that it is unfair business done for a customer. To be honest with you, it is unbelievable that someone who did not provide me product, is so resistant to giving me my 50% deposit back after literally 15 minutes of placing it. Mind you, this is me requesting the deposit back from his saleswoman, *******.
This individual is claiming that I called the police to file a report that I did not authorize the purchase. This is yet ANOTHER false statement. I filed a police report because he refused to give me my 50% deposit back. The police were on site and confirmed that the palm trees were at Kendal Nursery. The policeman told me he was going to ask the nursery to give me my deposit back, he spoke to *******. After being denied by the nursery to give me my 50% deposit back, The policeman filed a police report about his failure to give me my 50% deposit back. The only receipt for the transaction was the Zelle transaction that I initially sent to him when I made my deposit. Nowhere on this sheet, does it say, that all sales are final, no refunds, no returns, This is yet ANOTHER false statement.
The policeman told me that if BBB needs verification about the report, to please give the policeman a call. He will gladly vouch for what he has seen transpire at Kendal Nursery.
Unfortunately, he claims he takes his business seriously, and that I am hurting his business by making false accusations. To be quite *****, he is hurting his own image, by refusing to simply give me my 50% deposit back for a product I never received and he never procured. It was very obvious those palms had never moved from the Nursery (the police verified this). For all I know, I am likely not the only individual he does this to and this is not honest business. It is a scammers mentality. What he is doing needs to be stopped. Please understand my frustration from the level of fabrication and lengths this individual went through his imagination, to make such an elaborate and false storyline. Please get your facts right.
I have never received any products from Kendal Nursery. I do not want any credit to your nursery. This isnt $20.00. This is $1,350.00. I want my money back. I never received any product from kendal nursery, I asked for my deposit back within 15 minutes of paying it, on Monday January 22, 2024.

On 9/17/22 I purchased a palm tree from Kendall Nursery. They agreed to deliver and install the palm tree at my house on 9/21/22. On this date, they delivered another palm tree to my house, not the one I had chosen. They went back and brought a palm tree somewhat similar to the one I chose. They installed it and left. Now, 3 weeks later the palm tree is almost dead, most leaves have dried out and I pulled from the middle of the tree, rotten leaves that are full of maggots (picture attached). They purposely sold me a sick palm tree and refuse to replace it. Their solution is to buy a new one and they will install it for freeBusiness Response

The above mentioned customer came to the ********************** to select a palm tree. He placed the order and chose the palm tree of his liking.
On the day of the installation, the customer didnt like the palm tree that we had brought him that he picked out himself. We had to go back to the nursery and bring another one. The customer inspected the palm tree and approved it. Weeks later, customer calls saying that the tree was dying. He sent a picture of the tree and we noticed that he trimmed the whole palm tree himself. Also, it looked that the palm has not been water for a while. We can not warranty a plant if the customer does not have a professionally sprinkler system, which he did not. Also, he should have trimmed the palm tree himself as we advised him. We gave him a solution out of courtesy, to not charge him for the delivery or the installation and he still wasnt satisfied. 1. I do have a sprinkler system installed
2. Youre explicitly stating you brought me a sick tree because the one you brought me the first time wasnt a great one either, so because you had to go back to the nursery to get a new one, you took revenge by planting a sick tree.
3. It only takes 3 minutes to go through your ****** reviews to see that this is common practice on your part, you knowingly sell sick trees to honest and hardworking people. Almost $800 I gave you and yet you have the will to come here and play the victim.4. After contacting a pest control company, they confirmed my tree has a weebil infestation. Trust me, this does not happen in the 2 weeks this palm tree was planted in my home.

At the moment of the installation, customer did not have a sprinkler system. As stated in the previous response we brought the customer 2 palm trees. He approved one of them which we installed at his property. He inspected the palm trees, approved the job and was satisfied with the outcome.
We have limited warranty on replacement of plants killed or damaged by pests, insect infestation, abnormal weather conditions, hurricane, severe storms, or other conditions beyond our control, nor will we replace plants experiencing seasonal die-back, when pruning and proper care will restore them to health.
