    I firmly believe that I was a victim of negligence by this company mentioned here. This company recruits people for EB-3 **** applications.Once I secured a position with a sponsor, they submitted an application to the ********** of ****** I had two applications withdrawn due to errors made by this company. I was the one who pointed out the mistakes, and they then made a third application (10/28/22). Because I corrected the lawyers, they were very rude to me. Eventually, a new PERM application was submitted, and after 11 months, the *** audited my case 09/25/22.To this day, I don't know if they responded to my case. I have a message confirming that the sponsor company (Westgate Shellworld) would respond to my case. Without any proof, I had to accept this. In December, I questioned the delay in my case and was informed that there was no update. Since then, I have been repeatedly questioning this company without success. The response I get is that the lawyers are following up. On May 20th 24 the ********** of ***** updated the information for Q2, and that's when I discovered on my own that my PERM was denied in January 24. It was very frustrating because on Friday, May 17th, MCC sent me an email saying that they had not received any response from the ********** of ****** I was ignored for months, and at this moment, they are refusing to provide my formal denial letter. After I threatened to file a complaint, they refunded the $5k I had paid as part of the advance to cover the process costs, a contract totaling $22k. But now, I want the company to send me the formal denial letter. This letter contains the reason why perm were denied. I asked the president and he told me I should look for lawyers. What lawyers if I signed a contract with you and you blocked me from the only means of communication I had with him, which was LinkedIn. After my case, I discovered several other people who went through the same thing but are afraid to report this company for their negligence.

    We understand the frustration on ***************************** situation, however, there are a few points to clarify on the complaint.

    On one hand, it is not true that ************** had three different applications for her EB-3 process, she did have three different forms drafted and the final one being submitted on October 28, 2022 as she correctly pointed out. On August 24, 2023 the ********** of ***** determined that ****************** application was being audited. On January 26th, 2024 the final determination made by the ********** of ***** on the application was a Denial, which is a lawful determination by the DOL. 

    It is unusual but likely to happen that the U.S. authorities make their determinations but do not communicate them promptly, we understand it is frustrating but there is something that goes beyond our control, despite our best efforts. So, it is not true as ************** claims, that we are not willing to deliver her such letter with the determination. Moreover, it is not true as ************** claims, that our only communication channel with our clients is LinkedIn, we have a customer service platform (Zendesk) where our clients can communicate with us regarding any matter, we are sorry to hear that ************** was not willing to use such platform.

    As per the agreement signed between our company and **************, and given the determination made by the **** which was a denial of her application, we refunded the full amount that we received from ************** and said agreement was terminated, said refund was not made by the so-called threats by ************** but in accordance with agreement signed.

    On the other hand, the Sponsoring Employer that ************** quotes in her complaint is not related to us at all.

    I believe MCC is missing the point here and trying not to provide what they are supposed to send me (Denied letter). My process was denied, and I want them to send me the denial letter from the *** department. Why are they hiding this information from me? The denial letter is the key to understanding why my process was denied and whether everything was done correctly or if I was scammed. Once again, I want the denial letter from the *** department. Additionally, they are saying they did not filed three processes under my name, wich is not true, and indicates a series of major errors in this process, see attached documents for three of these processes, and we can easily check this public information on the *** department website.

    case two: CASE NUMBER: I dont have the number but I cant see it was withdrawn (school info wrong)

    case three: Case Number: 22301-48053 (witch was denied and I want the Denied letter)
