    **** ******* *** ******* ******* *** ******** *** bid out a concrete job for a garage foundation and attached spa pad. The concrete priced the job at $17,200.00 which was paid in full. On December 2, 2022 **** ******* * ******* ******* ******* * ******** *** poured a concrete foundation with an attached 13ft x 24ft concrete pad (spa pad). A residential patio (spa pad) falls under the category of an “impervious surface within 10 feet of the building foundation” in the International Residential Code (IRC R401.3) and Florida Building code, requires a minimum slope of 2 percent (equivalent to 1/4-inch per foot) away from the building foundation. As a note the building code does not alter its requirement for a sloping pad when the pad is covered or uncovered. Furthermore, all discussions/instructions regarding the attached pad referenced the slope requirement. In less than 10 days on December 10th, 2022, I noticed the attached pad held pooling water. On December 11th, 2022, I sent a text to Roberts Masonry & Concrete LLC / **** ******* ** ***** ******** with a photograph showing the pad held water near the foundation of the attached building and proof the pad was not sloped per code. I was told via phone conversation after a few text messages that the pad would be corrected. I was told this correction would be completed before January 4th, 2023 and allow for enough time for the correction to cure and be prepared for a 12,000 LBS spa. On December 26th, 2022, eight days prior to the spa delivery, no correction had been made nor any contact instructing when the correction would be made. I sent a text to Roberts Masonry & Concrete LLC / **** ******* ** ***** ******** requesting a timeline for the correction given the known delivery deadline. At that time, I was told “I’ll try to get to it”. Given the delivery deadline and the lack of commitment to fix the code violation, I set a deadline of 10 am December 28th, 2022, to be provided a date for correction, or without a specified date it would be an explicit refusal to correct the code violation. I also provided a general cost with the expectation of reimbursement for having to personally alter the pad to keep the wood-encased spa from sitting in water due to the pad not being poured to code.
