Horribly disappointing experience with ***********************. Being a victim of a natural disaster is uncontrollable. Being treated poorly by the insurance company after the damage is bad enough but when you HIRE a company and the owner / representative for that company, ***********************, tells you everything you want to hear, about how he will "go after" the insurance company, "fight" for you, be your voice to get you the maximum amount for your claim...and it's an easy case. Then over the course of almost a year, I and an attorneys office repeatedly prompts him to get involved and fight for my claim, make some effort, work, have some interaction as my adjuster with the insurance company... no answers, little to no involvement, for almost a year, finally, the claim is "is***d", but not before *********************** illegally signs off on my check and endorses it, after holding it hostage, forcing me to pay his 10%, only to have the check confiscated by the bank, Then, lies about why he signed it, doesn't know why they confiscated it, doesn't know anything apparently, but he will have it :reis***d"...I reverse the 10% payment through my bank, he then immediately gets involved, texting, messaging, submitting documentation all of a sudden...proceeds to threatens to *** me and "come after me legally". Immediately sends me to collections illegally (because the check wasn't even is***d) and as if that wasn't enough be then hired a lawyer to collect his 10%...again illegally because, I still have not been paid for the claim... So he told me I would benefit an additional $150K for hiring him. He did nothing for my claim. I did not and will not receive more than the insurance company originally offered prior to me hiring him to fight for me.... He did not fight for anything. He attempted to collect a 10% fee ($2400) illegally, then threatened me, sent me to collections, and then a law suit against me to try to collect his "fee"...all while, the claim hasn't been is***d....

My services were retained on March 21, 2023, and the claim came to a resolution on November 22, 2023, that resulted in a $24k new money settlement. The settlement amount was declared by the independent appraiser who inspected the property. The client received an undisputed payment and is referring the appraisal payment as the same payment he received initially. However, these are two separate payments; the second payment was a result of my involvement after I was hired that was acquired after the appraisal.
The claim went to appraisal, and I paid the appraiser *******************, who represented the claim which is the responsibility of the insured. I am at a negative amount with the appraisers payment and my fee because of your credit card chargeback. My contract, specifically says payment must be owed once services are rendered, which they were. The contract signed with us explicitly says payment is due regardless of the claim status, in this case appraisal. The estimate created for the claim serves as a negotiating tool, however, the appraisers assigned to your file have to make their own determination to make outside of my opinion and estimate. Which resulted in the amount that was settled for, you are unable to dispute it unless hiring an umpire which the client did not want to do.  I recommended the insured to give them time to let them resolve the claim and not alert them that they were attempting to sell the house. Not following my advice, the appraisers signed the preliminary amount to finalize the claim.Although I believed your claim was worth more money in your homeowners claim does mean you will receive the full amount. It is up to the insurance company and appraisers to decide based on policy limits. Also, the insurance company initially made their coverage determination, and after I was hired, we recovered $24k new money for his claim.
My services were rendered, and payment was owed regardless of the clients discontent with the settlement. I am attaching the claim information below.

I am rejecting this response because:

Yes I did retain ****************** as my public adjuster on 3/21/23 however, what ***************** says and promises and how he acts and performs as a public adjuster with his fiduciary responsibilities are completely polarized. ( I can submit proof). ***************** assured a certain amount for the claim, then fell short on his responsibilities. Never kept me updated on my case. Never negotiated as he claimed he would. Never knowing what was going on. Fails to respond. When asked for invoices, settlements, detailed info regarding the case, he had no information. The attorney he set me up with too... had no idea what he was doing or what was going on with the case. ( I can submit proof for all of it, if needed) Resulting in a loss of 10's of thousands of dollars to me, his client. (I've now, 3+ months later and over a year since the hurricane damage, had to hire an attorney to combat his neglectful duties)  He may think his $24K was some reward but he assured me it would be ~$150K not $24k. My attorney's office had to push him along the entire time as he was not informed on my case. Then once the less than favorable ~$24k check arrived ***************** held it hostage for his 10% payment. Which as disappointing as it was and because ***************** did not act accordingly, as he stated when I hired him, I still paid his 10% fee on 12/21/23. However, because ***************** is apparently greedy for his 10% fee, he decided to endorse that check from the insurance company (perhaps attempting to ensure he got his ***** 10%) , rendering it worthless to which the bank confiscated the check. Then when I informed him he told me to mail the check back to him and he'll reissue it. I informed him I could not as the bank confiscated it. He then informed me he contacted the attorney he works with and who also was handling my case and he would have him reissue the $24K check. Over a week passed when I reached out to that attorney and he had no idea. ***************** did not in fact prompt the attorney to reissue the check. The attorney verified he had not heard from ***************** and he would then contact the insurance company to reissue the check but it could ***********-8 weeks to be reissued. It was then.... after almost 8 weeks of lies and scams that I finally contacted my bank on 2/13/24 and had the charges reversed. ( I can submit proof if needed) ******** agreed whole heartedly with me. I informed ****************** I would pay his 10% fee when the actual check came because as he stated and on the contract, the client only pays if there's a reward. Since it was clearly up in the air at that time.. (and here it is an additional 3 + months and the check still has not been re-issued). Then to add insult to injury ****************** tells me he didn't make enough money off of me. He only made ~$800... after he lost 10's of thousands of dollars of mine because he failed to act fiduciarily. Am I suppose to be sympathetic to a business owner who tells his client he didn't make enough money off of when in fact he lost thousands? What type of business owner does that? He then also continued to threaten me and send me immediately to his attorney/account collections firm and that attorney then threatened and baited me to hire an attorney and pursue legal avenues. Which I have and what prompted me to file this complaint and the complaint to the public adjusters "ethics" committee.   I offered to pay the attorney $50 payments until the $24k check arrived... which was more than fair, under these circumstances. The attorney would only agree if I removed my yelp/google reviews, and only if I would sign a non disparaging / NDA  agreement which in my opinion seems like this may be a typical procedure for ******************. (I can submit proof)... In doing my research after the fact, other clients have accused ***************** for doing similar acts to them. It's important that the public be made aware of ***************** and All Service Adjusting's business practices/ protocols/lack of ethics/fiduciary duties and how he treats clients after he fails to perform for them as he promises when he is hired.

I used All Service Adjusting to assist with insurance after the storm. I received my claim from insurance and the adjuster signed it and lost it. Over the last six months he has done nothing to get our check reissued. I researched myself. Found the individual to reissue the check. Now he wants a %. He did nothing. Not one correspondence with FIGA to get our money. They returned the original % for losing check and the headache. Now they want a percentage. They should stand behind their commitment. L

      Hello,

I am attaching the email thread of All Service Adjusting trying to have the check reissued for the insured. Prior to the carrier declaring bankruptcy we conducted a check exchange via mail with the insured, however, the check was lost in the mail by this time the carrier had gone into receivership. Since the carrier went down, out of generosity and kindness I felt it was right to reimburse the insured what she had paid to All Service Adjusting, and I did pay the insured. As soon as **** took over the *** claims, we had been calling and emailing countless of times and have tried to get the clam reassigned to a new desk adjuster to get this payment reissued. We have escalated the situation to two different supervisors and have left countless of voicemails to no avail.

      Thank you,

I am rejecting this response because he is a liar.  He can not produce any correspondence showing he tried to get our check reissued.  He had an over inflated claim.  And over inflated others claims also.  I have reported him for this.   After talking with FIGA they have NO documentation of correspondence.  All he cares about is his 10%.  He waived his commission after losing check and costing us money.  Now he wants to be paid.  Run. Run from this business!

      Sincerely,

      *****************************

Attached are email logs attempting several times to get this claim re-opened and settled. Client simply wants to avoid payment after 8 months worth of work. Unless the client can produce evidence from the desk adjuster showing or stating that we have been negligent, this complaint is Null. We are providing proof
