On November 2nd I paid Ajs custom complete upholstery **** dollars cash at my residence. The fee is **** the owner who I dealt with requirement, half up front. He was to provide a service of re upholstering a *************** and two dining booths. The agreement was him and a ***** of his were coming on November 4th to uninstall the furniture and it would be completed by the 10th of November. He has not showed up to do the job and has not returned my calls or texts messages. He has stolen my money. I communicated through phone contact message that I did not appreciate the way he is handling our business agreement and demanded a refund. I have not heard back. I do have an electronic receipt for the payment of the ***** dollars I payed him. I believe him to be a fraudulent business stealing peoples money.Business Response

I disagree with the complaint me and ************************* spoke on Saturday the 12th of November in text messages and he came to my shop seen how far I was with the job stated he wanted me to finish he was going out of town to attend his mother that needed his help before he left my shop stated to me that he would like me to finish and when I'm done with his to call him and let him know and he would be by to pay me ! he stated that my work great and he was excited for it to be done. After November 12th approximately 745pm at my place of business is the last time we spoke and communicated .I asked him twice before he left my shop if he wanted me to continue and have done he said of course and that we will talk and he said again before leaving we will talk.
the job has been done since November 14th I would love to resolve this and be paid for what I did to his seats he seems like a nice guy and I'm not in business to steal from people I have a passion for what I do and do my best to make every costomer happy with my work and do my best to have done in a timely manner if me and *** had some miss communication I think we can put that behind us and get these seat back to him and again they are done and have been here in the shop ready for his pick up
I have video from my camera and text messages available from the 12th at 745pm if needed

On November 3rd **** the owner of Ajs custom complete upholstery gave me his word that the job would be completed by November 11th which he communicated through text to my phone.On November 4th he again assured me that his last job was completed and I was up. That he cleared the whole week to get my job done by the 11th of November as we spoke about and agreed on. This also is in writing his words through text.On November 7th he guaranteed me again through text that the would be completed by November 11th.Then on the 8th of November **** sends me another text saying the job will definitely be done by the 11th of November.I explained to ****, Ajs custom complete upholstery, on the 2nd of November that I had to leave Naples to go to ************* by November 12th to care for my elderly parents and that if the job could not be completed by the 11th of November i could not hire him. On the 12th of November struggling to get responses from him and upset because he failed to complete the job the day before as agreed I told him I was coming down to his shop to see what work has been done. He said come on. When I arrived with my son as a witness there was only 4 back cushions upholstered. The dining booths and couch were not done and the fabric had not even been cut for it yet.I was so disappointed with the deception and trickery from this business all I could do is hold my head down and walk out.Now I am unable to return to get my furniture and gave a thousand dollars to Ajs custom complete upholstery in advance as it is the owners policy to give half up front.I have been majorly unconvinced by this business and now have no where to sit in my home. I am a disabled veteran with back issues and because of this had to increase my medication for pain having to lay and sit on the floorI demand a full refund of my thousand dollars cash I gave in advance or will pursue further action. **** should be ashamed of his business practices and clean his act up.Business Response

Again seats are done have been done for weeks now Im not holding seats hostage and I need to be paid for the job you asked me to do I have screen shots of our text messages loaded up showing we were on good terms after the complaint was filed I want this resolved immediately were you belonging are taking space in my shop we spoke on veterans Day and a update over the phone was discussed and you were happy also have text messages from that day which are loaded up to the site we spoke on the 12th were you came to the shop with you son and said you loved my work and wanted me to continue to do the job we have not spoke since the 12th you have not called or tried to come get the seatsCustomer Answer

I heard of him through some other customers and was warned to be careful that he does not finish jobs and makes it very difficult to get them completed. **** was days late getting my job done as we agreed on also knowing I had to leave to go take care of my elderly parents no later that November 13th. **** failed to provide the service that was orally agreed on and via text message. He did not keep in touch with me or do the job on my terms like we also agreed on when I first told him I wanted a refund. **** the owner was not following through to begin with and I told him I wanted a refund. He pleaded with me to let him do the job and that it would be on my terms. I said yes he could but I wish I hadnt of because he failed to do the job in time. I have all the proof and specific documentation to prove my case beginning on November 2nd to November 12th of what actually took place. Ajs custom complete is a dishonest company and then lies when attention is brought against them of their business practices. **** never even called me once to inform me that my furniture was ready even though it was to late past the agreed deadline.Ajs custom complete needs to do the right thing and refund my ***** dollars for their negligence in providing the service agreed on in a binding oral contract.

Furthermore, specifically on November 7th I clearly stated how I didnt
appreciate how the owner **** was not following through with what we agreed
on and requested my money back then. He said if I could find it in my heart
to allow him to complete the job that he would have the time to complete the
job by the November 11th. I stated I was scared to chance him because of all
the excuses of personal issues putting him behind but if I let him finish it
he must keep in better touch and that it must be done on my terms. He
specifically said Im absolutely right and it should be done on my terms.
****/ Ajs custom complete upholstery stated he felt terrible what took place
and he wanted to make it right. He said I give you my word the job would be
************** November 11th installed and done that he was willing to sign
an agreement to that the job would be completed by Friday November 11th or
all my money would be returned to me that very same day sent to me from his
phone.
By his own testimony the job wasnt done or even close to being done on
November 12th. So where is my refund. Untrustworthy, uncommitted,
undependable and taking advantage of the public with the half up front
policy. Dishonest business through and through.
In litigation after the evidence of what was actually said and how ****
handled things I feel very confident in a simple victory. If **** is
unwilling to make it right like he guaranteed me by refunding my full
thousand dollars there is nothing more to say. Dont say your not a *****
and then be crooked. Do the the right thing.
