    I spoke with ****** about a car my son wanted to purchase a total of 49 emails and 14 phone calls over 3 week period. My son is adult but deemed legally incompetent and I his guardian due to auto accident resulting in 5 brain surgeries and I had made ****** very aware of this. However ****** never once mentions the car had been totaled and has salvaged title or I would never purchased it after almost loosing my son once from accident. He waits until money is deposited in his account and all papers are signed then gets my son to sign off to side about title. The car makes it 7 ****'s from car lot and leaves my son stranded . This was October 27 22. My son ask me following day did car stop working because the titles salvaged, this is how I found out. My son doesn't comprehend what salvaged title even is and ****** knew this. The ac don't work and I plainly explained my son has heat seizures and ac a must. When I asked if any issues with car was told no it only has ***** ****'s on it. The car won't crank or run it had be towed home after we paid $10215.00. we paid for tag but didn't get one ****** just attached my son's old tag that had been suspended to vehicle. He won't answer my emails or calls . He committed dealer fraud, exploited the disabled , and should be closed for his business ethics.

    We have received your letter regarding case mentioned above for ******************************* and *************************************. On October 19, 2022 we received an email lead from *********************************** stating Guardian ********* from ********** ******* sent out a cashier check in the amount of $10,215.00. On October 20, 2022 *********************************** called our office regarding the 2010 ****** Maxima Vin # ***************** for her son ***************************. She said she and ****** was trying to contact our office but was not able to get through and she was having signal issues. ****** at that point called her and asked her who is the sales person she's dealing with regarding this vehicle, she said she checked out online and online it gave the estimated numbers. So he explained to her he will verify the numbers and will let her know, she said she been trying to get in contact with us 2 days now. ****** told her he did get an inquiry from ****** also about the vehicle. She said her son ****** saw the car online and he wants it. ****** explained to her that this vehicle does have a branded rebuilt title and was involved in an accident. She said she is aware of the vehicles history since she always does her research before buying used cars and ****** needs a vehicle for him and his 12-year-old daughter. She said she won't be able to come since she's in ********* not in ******* but she will have a family member come with ****** to check out and test drive the vehicle at the dealership and finalized the paperwork's. She told him she and ****** will be having a cashier check sent from ************** *** located in ********** ******* which is a trust company, she stated ****** is normal to look at but he had an injury from a car accident but is able to sign documents. ****** told her he will call her back once he verifies the numbers. Again, on the same day, ****** did call her back and told her the numbers $10,215.00 will work. She said she had the trust company send out a cashier check for the vehicle. ****** explained to her that he would prefer her to come in and check out the vehicle before she sends any money. She said she and ****** already checked out the car vehicle history and they are okay with it, and ****** loves the car. They went back and forth with many phone calls and emails because there was a delay in the mail for the cashier check. It was then received on October 24, 2022 but it was a check not a cashier check from Guardian Trust. ****** called ***** of this and she said ****** and his sister will be in to check the vehicle and sign the documents and if there is anything else we need before they get there let her know so all they have to do once he comes in is check out the vehicle as well as test drive it and sign the documents and leave. ****** told her that he needs ****** drivers license and insurance. She said she will send it because she wants to have everything ready before he gets here. ****** told her that since it is a check and not a cashier check we have to wait till the check clears the bank before they can take possession of the vehicle. ****** called ***** and couldn't get through so ****** emailed ***** on October 27, 2022 before ****** came in and asked if ****** was able to read and sign documents because ***** insist the vehicle be placed in ******'s name. She never responded via email but she did call and said that ****** has a learning disability. ****** told her if he is not competent to fully understand the paperwork's we cannot have him sign any documents. She insisted she wants the car in ****** name and he can understand the documents and his sister will be there with him to explain it too and she understands everything about the car already and there is nothing else that should stop him. She also said she have documents proving he can read and write. ****** came into the office on October 27, 2022 with his sister who is an adult and is well and competent along with her 2 children and checked out the vehicle. ****** then again verified with ****** and his sister that they are aware that this vehicle is a rebuilt title. They said they are aware, ****** then stated that he loves the car and him and his mom checked out the history already and he is aware of it. After ****** took the car later that evening, we got a message from ***** stating the car was over heating and that he drove the car ***** miles. She called the next day said the car was over heating and she took it to her mechanic and he stated the car was low on radiator fluid and because of this it damaged the thermostat and she shouldn't have bought this car because it is a rebuilt title. I'm not sure how she could have taken the car to her mechanic if she is in ********* as she had stated to us prior. She begins to tell us that she isn't aware of the history and how ****** is not capable to sign anything, which might or might not be true however his sister was there with him while he was signing the paperwork and while he checked out the vehicle. ****** told her that she did tell us she had the vehicles history report on the vehicle and she's aware of the history and ****** told her he loves the car. She stated how we took advantage of her disabled son, which is not the case. We did explain everything to ***** and when ****** and his sister came in, we did explain it to them once again before he signed. We were under the impression, according to his mother *****, that they are aware of everything prior to coming in and that is the reason why she had the money send out. Also, how can she claim the ****** can write his name but is incompetent and can't comprehend anything when he's able to operate a motor vehicle. I would think that in order for someone to operate a motor vehicle on the road they must be fully able to do so because of road signs and safety for both the driver and everyone else. It is a safety concern if ****** is not capable to comprehend and yet he is on the road driving. It is not our intention to deceive anyone however Ms. ***** is implying false allegations against us. There is 3 pages stating this vehicle have a branded rebuilt/salvage title in which was explained to ****** and his sister when they came and to ***** previously. If there was an issue why didn't the sister say something at the time and called ***** to verify. We would have gladly cancelled the sale at that time and provide a refund had they not been satisfied. We've sold numerous branded rebuilt vehicles and have always disclosed it to every one of our customers as it is our company policy. We have always had our paperwork's in compliance with regards to the rules and laws. We never hide any of this information to any of our customers.     Because no one ever mentioned the car being totalled or it having a salvaged title or a past history report being done on the car. I asked them after it broke down leaving the car lot if I could get a copy of the inspection they claimed to have had done but never received it. The car was purchased from my son's special needs trust fund overseen by guardian trust *** and the courts. If any one of us had known about a salvaged title the request to purchase the car would not of been approved. I have contacted my cell phone service provider and sent a notorized request along with my picture I D. To them so they can send me the certified transcripts of every telephone conversation between ************* and myself. This will PROVE this dealership is lying straight out that there was NEVER any discussion of the car being wrecked, a salvaged title and it will also prove that my daughter dropped ****** off at the dealership but was not present while he was signing the paperwork as the location off various towers with date and time will provide. She had to return to be at work so could not of been there at the car dealership and driving back to lake city at the same time. These people are liars and took advantage of a disabled boy. I request this complaint remain open and active 90 days to give me adequate time to receive transcripts to prove this and then request there dealership lisence and criminal charges be brought against them

    I'm sorry but I have already responded to this complaint. I have all the paperworks in which ****************** signed which stated the salvage/ rebuilt title. Like I stated before, how could he not understand the paperworks but is able to operate a motor vehicle and read and understand road signs and what is going on.
