      Prestige Homes LLC in *********, ** performed fraudulent activity in regards to our contract with our bank. We have a construction loan.Our septic cost per contract with Kings Septic, *********, ** is $5,250.00. The invoice from Kings Septic to *************************** General Manager was $9550.00 with no change order for us to sign and agree to this amount. We requested a refund of $4300.00. This issue hasn't been resolved and won't per ***************************, General Manager. We agreed to the contract amount of $5250.00.

      There is no fraudulent activity by Prestige Homes. ************************** is incorrect with his description of the transaction.There was no Contract with Kings Septic for $5,250. On the Purchase Agreement with Prestige, there was an allowance, added to the Purchase Agreement, for $5,250. This was done so that the loan the ************* were getting, would have money in it to pay for the septic tank. There was no septic permit at the time the Purchase Agreement was signed by the *************, so the septic allowance was an estimate, at that point. When the Permit tech met with ************************** on the property to do the site evaluation, ************************** gave him the site plan and the septic permit. Prestige did not apply for a septic permit. However, the septic permit was for a different home and had been applied for when the ************* were buying a home from a different retailer. That sale was cancelled, and they decided to purchase from Prestige. The Permit tech sent the floor plan for the new home from Prestige, to the ************ to get the permit revised. Ultimately, the septic cost was a little higher than the allowance after ************************** had the septic tank moved after it was already installed. Fortunately, the allowance for the driveway apron was not necessary, so that money was used to cover the $2,750 shortfall on the septic, resulting in no additional costs to the *************.

      I am sorry that you disagree with the account of the facts in your transaction, but that is what happened. We cannot come up with a better story than the facts provide.

      I am rejecting this response because it's not factual information from Prestige LLC.  We're requesting a refund of $4300.00 because we didn't sign a change order or give Prestige LLC the authorization to pay Kings Septic $9550.00.  We authorized $5250.00 per contract with UHM bank. The bank agrees with us on this issue.  We won't be satisfied until we receive a refund.  Closing will be postponed until we settle through the court system.
