On January 11, 2023, I received an “NSF – ACH Reversal Fee” for a $65.15 ******* payment. My balance was $106.04 on both January 10 before the posting, and after they returned the charge on January 11 (according to online banking). Later that evening, I purchased food for $58. That debit purchase cleared. My salary, ACH credit, was the final transaction of the day. I wanted clarification on why the ******* ACH from the morning was returned, but the debit transaction from later that evening cleared. I know ACH debits and credits post immediately, unless there is a manual process.

I’m hoping their processes are reviewed by the State (OFR), and regulators (NCUA). Frankly, their processes are antiquated, unfair, the definition of UDAAP, and predatory. They are actively setting their members up to fail while benefitting from junk fee income.

We already provided the attached documentation to FL-OFR who reported to NCUA.  We do NOT intentionally post debits before credits as those ACH files come in multiple times a day.  We have no control over that process; however, we do offer Early ACH Postings up to 2-Days early at a minimal fee of $10.00 which only the member can do, NO Employee can do for the member as we have no control over that process.  They can access the Early ACH Postings via online bank (It'sMe247) or via OcalaCCU App.  Again, completely in the member's control.

Also note:  It is illegal to authorize a debit to come out of your account before the funds are in there (available).  Courts let the Banks & Credit Unions charge a small NSF fee to avoid going to court.

I would recommend Mr. ***** keeping money in his Checking Account or sign the Auto Transfer Form authorizing the system to transfer funds from his other accounts to his checking, as we've offered multiple times in past to avoid this issue from happening again.

Mr. ***** has the right to close out his account with us and take his business elsewhere as I see he is now residing in Jacksonville, FL where we do not have any branches to assist him there.

    Thank you,

    Steven N******, President/CEO
