Smith and **** charged me $3,000 for helping me to lift the ***** Act off my son, ***** Elghorab. My son called me and requested to come home and I said yes, so we talked to the Social Worker Manager ****** ***** at the Lakeland Regional Health Behavioral Health Unit to lift the ***** Act and discharge him and she agreed on October 21, 2024. As a matter of fact, my oldest son, Sharif Elghorab, texted the lawyer ******** at about 1 pm the same day and told him my brother will be discharged at 3:45 pm the same day. He said that is okay. My son came home the same day. The lawyer ******** ********** at the law firm did not do anything to lift the ***** Act. He made some phone calls to speak to us and he prevented the Lakeland ***************** from coming to the facility, but he did not do anything to prepare the papers for the court. The amount of work that he did does not justify the $3,000 paid on October 19, 2024 and the transaction showed up on my bank account on October 21, 2024 and we believe we should be reimbursed and only pay for the time he spent making phone calls. We called the firm and him and left messages, but they did not return any phone calls back. They are happy to take my money for minimal work. He did not send me a statement to itemize the work and time he spent on my problem. Also, the contract does not match the ***** Act and it is a boiler template.

We were hired to represent in a ***** act and we were successful. Not sure why they are complaining. This should be a positive review instead of negative. ***** acts require emergency action and require immediate work for hours of our time . I find it incredibly unfair that we are retained , the job was completed successfully and now there is somehow a complaint and attempt to get money back for services successfully rendered.

      Dear ***** *******,

I still want a refund because my son was discharged by the facilitys doctors on October 21st 2024 and the ***** Act was lifted and removed the same day before the Smith and Eulo Law Firm started their first step. Mr. ******* *****, a lawyer from that firm, called us on Friday October 18th 2024 asking us for $2,500. On Saturday October 19th, he insisted on charging on $3,000. The difference of $500 was for his visit to meet my son in the facility the next day and he never did! The transaction of the $3,000 showed up in my bank account on Monday October 21st 2024. So, this lawyer made sure he was paid first. They did nothing before 10/21/2024 the day my son came home from the facility. I demand a written report from the assigned lawyer ******** ********** to prove his successful work. The work was 100% done by the facility, Lakeland **************** Center Behavioral Units doctors. Please, have him itemize his big achievement, how many hours he spent on the work, and the charge per hour. I disagree completely with this law firm that uses a boiler template they call it a contract. This contract has no word about ***** Act! In fact, Mr. ********** should get paid for the phone calls he made. There was no court cost, no trial, no preparation, and no paperwork. The facility made it so easy for him. Is that not nice? $3,000 is a lot. I want my money back.

      Best Regards,

      ***** ****** (mother)

Hi, unfortunately we really don't know what else to say. Hiring a lawyer in an emergency situation that results in a successful result is not a reason for a refund. Thousands of dollars go into supplying a lawyer in an emergency capacity to go to work for you on a case like this. Whether you think it was needed or not needed in hindsight is not a reason why our firm should be required to refund $3,000 for lawyer services that were provided, and provided successfully. There is not basis for a refund here.

      Customer Answer

      Date: 12/18/2024

We are not asking for the full refund.

We understand that the lawyer did work and should be paid for that.

We requested an itemized breakdown of the scope of work and the charges for them.

We hired the lawyer to remove the ***** Act, but it was resolved without any action on his part between me (mother) and youngest son.

It also turned out that the Lakeland ***************** as well as the ****************************** were planning to visit my son at the **************************** for Behavioral Wellness and the lawyer did his part to block them.

We are requesting the lawyer to provide the scope of work and charges for each item and refund the unused time and money.

      Thank You.
