      I applied at Elea Apartments on 5/25/2024, I paid application and administrative fee. I was denied for apartments and was supposed to receive my administrative fee back. The manager and his staff plays games. Telling me to come get a gift card or they will mail check but neither happens. I even asked them to send refund ******* to ******* because we would both get a receipt. Nothing. It's been 3 months and I feel like they are just trying to keep my money, I need help.

      I am very sorry for the delay in receiving your refund and the inconvenience it has caused you. I am also sorry for the communication regarding this. We try the best we can at the site level to do everything we can to prevent these situations from happening, but there are certain things that are out of our control, such as issuing checks and delivering the checks to you. The initial check went out to you on 6/4/24 but was never received or cashed. Our accounting team has voided this check and reissued another one to you. We had this sent *** with tracking, to ensure it did not get lost in the mail system this time. The tracking shows that it has been delivered to you.       My son and I are relocating from ** to ** and completed an application to rent an apartment at ******** at *****************, *********, **. Our move in date was selected and we were given a total due to move in. I secured a certified check from my bank as instructed in my email from *******. I received an email from ******* on our move in date requesting an ETA, we responded that the time would be approximately 6:30 PM, based on the *** as we experienced accidents, stopped traffic, moving truck issues and a sick dog. My son doesnt drive and I physically couldnt drive any longer the night before. Anyway ******** responded that the office closes at 5:00 PM and if we were not there the contract would have to change the move in date which also increased the monthly rent over $200 and wouldve required me to come up with about $4000, instead of the check I had for $3800. Responded back that I cant afford higher rent payments and she said she has another unit that has not been renovated/upgraded that she can give me for the same amount of the contracted unit. I responded that no one would take the only two offers she is giving me and that she is leaving us homeless. I requested the administrative Fee my son and I each paid be returned to us and she said that fee is non refundable and is for holding the unit. We are each out $125 because I couldnt get there on time. Well here is what ZRS Mgmt. cost me: Hotel fees: $390, Bank Fees: (certified check made out to Fairways) $10. Fed Ex Fee: (send check back to bank to be redeposited in my account before I can pay another security deposit) $10, Truck Rental Extension: $68 (our belongings are in a 16ft Penske Truck. So ZRS gets to keep my hard earned money and doesnt give a s*** about who was effected by their actions. I requested my money from them with no response of course, My disabled son and I worked hard saving for this move. ZRS made their property unattainable.

As you saw in our online system when you applied, the pricing changes daily and is all determined by the date of move in that you choose. Unfortunately, when switching move in dates that also changes the price as well. We understand your situation but we can't honor the price just for you and then not honor the prices of everyone else that has changes to their move in dates. However, due to the circumstances, we can refund you the app/admin fees of $410 as you requested. Can you please confirm the address you would like this to go to?

      I was a resident at this complex for two years. when it first opened they did great after the first year management changed and the complex began to decline. I moved out two months ago June 2024 thinking there would be no issues. Unfortunately that has not been the situation. When i received my refund for my security deposit the bank returned the check for insufficient funds. i contacted the property who reissued another check, I this time took the check to the issuing bank ***** of America) who also could not cash this check due it not being registered to the account. A third check was issued and again not cashable. it seems like the company can take your money but not refund it to you. The bank has tried calling the company and they do not answer the phone. For running a luxury complex and charging 1900 for a 1 bedroom apartment it is unacceptable that the company seems to be scamming residents. There is penalty for issuing fraudulent a checks as well as cashing checks that are returned.

      I was living at The Brookhaven Collection (managed by ZRS Management) from June 2022 to June 2023. Upon vacating my apartment, i constantly tried reaching out to the local office requesting my security deposit be returned to me. It is almost impossible to get in touch with them so I also visited the office. Every time i did visit the office, I was told someone would get back to me, but no one ever did. This went on for three months until I gave up. In April 2024, I randomly received a check in the mail from CF Brookhaven I LLC in the amount of $1159. I was in shock that the deposit was finally sent. Unfortunately the check bounced when I tried to despot it due to insufficient funds. When they finally did (last month) it bounced when I tried to deposit it due to insufficient funds. I was then back at square one trying to get in touch with someone at the office and constantly calling and following up while no one was ever getting back to me. In June 2024, I was finally able to receive the email of one the administrators and started an email thread. On June 13th, I informed ***************************** of what I was experienced via email and she responded to let me know that they will be sending me a replacement check over night. On June 26th i received the replacement check and to my surprise it was for $159 (instead of the original $1159). Again, i have been reaching out to Loutricia to help solve this issue but they have not been helpful as of late. My last communication (July 8th) stated that I would be seeking legal action if this is not resolved within the next two weeks.I reached back out to them and they sent another check, but it was missing $1k. The new check was for $159 instead of the original $1159.Now they are refusing to help further and not responding to me. Is that reason for filing a small claims case?

      We apologize for any confusion. The resident's deposit on account was $1k. The resident had a balance of $170.98 as of June 30th and then received the final utility billing of $93. The correct deposit amount should be returned should be $736.02. If the $159.40 was cashed, we can re-issue the remaining balance $576.62.

      My name is *************************** and on January 16, 2024. I was supposed to move in ******* at ********* in unit 11 E. I paid an application fee was approved but could not move into the apartment due to the nastiness the filthiness, the mold, and water damage of the apartment, Miss ****** whom I assume is the Assistant Property Manager works at the ***************** (**************************************************************** stated she did a walk through the unit before I got there. Long story short there was always an excuse on why I couldnt see the unit and the day I was supposed to sign my lease it was unacceptable and I couldnt move in and they didnt have another unit to give me. ************************* (Property Manager) stated a check would be at the office to pick up because the first one was never received. Shortly after that email ****** calls me and said it would take 45 days to receive another check after the other check is cancelled. It is well past 45 days and no one ever answers the phones or response to emails at any of the properties. I need my money like agreed.

      My check was wrongfully not paid out. I have proof attached that the first check was never cashed. I explained that the original check didnt come til after the second check. The business manager **** lied and said they have my signature endorsed on the first check knowing it was never cashed. The only check endorsed was the second. I even told the complex Bayside at ********* I could give them the first check. ****** at the cove at peninsula said the first check would have the stop payment and this was done for them to send out a second check. I am owed $105.00 if this cant be resolved this way. I will seek other ways to be compensated what Im owed.

      I am rejecting this response because:

      no refund was paid out because the 1st check WAS NOT paid out. Your business and accounting team clearly didnt do their job correctly. Ive attached the email showing she said the second check was canceled. If it was canceled it wasnt paid. The first wasnt paid. So that mean NEITHER was paid out. The slip shows when it canceled which was 8/29/2024. Look and your system with the first check number tell me where you see it was cashed.. you cant because it wasnt. The second wasnt paid out either. If this isnt resolved with a check for $105.00 which owed by 10/30/2024, I will be filing a small claims suit and requesting you guys pay it only the $105.00 Im owed but court cost as well. Do your investigation because Ms. ********** said the first check was signed and it wasnt. On 10/31/2042 if not resolved I will submit all evidence including a LEGAL DOCUMENT from my bank showing that the check didnt pay out. Have a blessed day. Once again its ok to have an oversight but do the right thing and not be greedy when you know Im owed my money.

      In July 2023 I negotiated a modification of my lease changing the due date of my rent from the 1st to the 15th of each month. I have paid all rent due on the 15th of each month. In December 2023 there was a change in ownership and management companies the new management company refused to acknowledge the modified lease due date and started charging late fees. Before I could get any resolutionI in April 2024 there was another change of management companies to ZRS management. Despite numerous emails I have yet to receive any response from ZRS . In addition *** has apparently refused to deposit my June and July rent checks despite assurances to the contrary from the property manager ****************************** appears that ZRS is attempting to create an artificial default on my part in order to charge additional late fees and a negative reference if I attempt to move.Please have someone at ZRS contact me to get this resolved.       After receiving the paperwork from ******************, we followed up with our attorney.  A reasonable accommodation request based on payments and changing the lease document is very rare.  We will be following our attorney's recommendation and will honor the request; however, we will be requesting a new reasonable accommodation be submitted on our form for our records and Mr. ******** benefit. As far as the rent checks all of his payments have been submitted to the bank for processing and no checks were being held.  Due to the recent takeover taking manual checks to the bank slows the processing at the bank. If ****************** wishes to avoid delays in his payments being processed, then we again invite him to sign up for our resident portal where he can set up recurring payments.  At this point we will be removing late fees from his account but if payments are not received on the 15th of each month, then late fees will be assessed per his agreement.

      As of today, ********************** account only shows his current rent due.  All late fees have been removed per his request.  We have also granted for his reasonable accommodation to remain in place which allows him to pay on the 15th.   ****************** needs to be aware that our system auto charges all late fees on the 6th of the month so we will manually remove his late fee each month.   I believe we have satisfied his complaint regarding his reasonable accommodation and late fees.  Additionally, all previous payments he has given to our office are showing on his account and been processed by the bank.  He is welcome to reach out to us with any additional questions he may have regarding this matter.

      I paid a deposit and my company did not apply it to my move out. They have HINDERED MY CREDIT SCORE AND I CANNOT MOVE. I shouldve been penalized for ONE month of move out plus and damages cleaning then also MINUS my deposit. Ive lost a job opportunity because of this. *** tried speaking with the company they refuse to talk to me and they said they applied my deposit to a rental charge in 2022 WITHOUT MY consent. That is UNFAIR that they used my deposit to pay for a past due balance a year prior. At one point they told me I didnt even have a deposit, when I have proof I paid one!!!!!!! A lump some for past due rent was paid in 2022 so there should be no reason WHY I wouldve owed, this company has scammed me. I cant even get in contact with the collection agency because they are so rude. Please help me. Please. Also this company I rented from went through a new management so everything is messed up. I provided my lease I signed when I first moved in. And Im thinking the old company didnt apply my deposit or something when the new company became managers. Im not sure what all occurred but I need the price adjusted to the correct amount. Please please help me

      Just moved into unit 2604 that I leased at ****** in downtown ****** that is managed by ZRSManagement. The condition of the apartment was absolutely unacceptable.Not only was it not cleaned properly it felt like they didnt even try/care. From breadcrumbs still there from previous tenant to a wash cloth left in dryer from previous tenant, stains from who knows what in cabinets, grease, ***************** in spaces around appliance, paint stains on blinds, in tub, corner of doors, switches, towel racks, etc., it was horrible & not cleaned properly. However the worst part is all the damage in the apartment&unacceptable condition of appliances etc that they also dont see any issue with.Hole in door of storage by kitchen, rust on tub, sink, door holders/screws in bathroom, also rust inside dishwasher in kitchen, fridge with inserts broken in corners & disgustingly dirty moldy *********** dispenser thats quite literally a health hazard & not something anyone would ever want to drink water from or use ice from including whoever decided that should be an acceptable condition for a new tenant, also oven with burned parts inside & damage to cooktop that cannot be cleaned/fixed, not to mention open cracks & chipped spots on countertop, deep very visible scratch on drawer thats been there since like 2018 according to an old video of apartment where it was visible. I was shocked. I have NEVER been given an apartment in such a bad condition. Management refuses to do anything, has me running around with my newborn baby chasing them, not showing up to appointment I made to see them. On top of it, my AC didnt work either & its been 3 days. My baby cannot be in a hot apartment as babies cannot regulate their body temperatures properly yet & it puts them at risk for SIDS. They at least are working on that but resolution is taking too long. I cannot simply jump up & go somewhere else with a new baby.There isnt enough space here to describe all I had to deal with.       ************************** is a business of lack of organization, lying, and deceptive advertising. I visited the apartment to view it and when I visited the apartment, they had me sitting outside the office for 45 minutes after my appointment time, with shock that I had made an appointment to view the place. The model that I had a seen does not resemble the apartment I was given at all. The application process was a pain because the complex does not answer the phone but does not want to respond to emails so that their is no paper trail of their mistakes. I was told that I needed to add a gaunrantor because I did not meet the income requirements which did not match my calculations and the company could even tell me how far off I was. When I asked, I was told I don't know the exact amount. After getting everything approved, I was sent a welcome letter and that ended the contact until the day before I was supposed to move in when I received a call stating that the apartment was not going to be ready. This was ridiculous because this was known by the company days prior and they refused to say anything until the very last minute. The say they would call me back around 4 to see what do. They offered another apartment that they stated was ready but it was not at all. The apartment I received has mold, mildew, ***** residue in the fridge, burn marks on the floor, water stains in the ceiling, unstable stove, range doesnt work, multitude of buts everywhere, peeling on the counter tops, holes in the screen on patio, holes in the wall, and so much more. The company went on to tell me that this was normal wear and tear of an apartment which is unacceptable. They sent the maintanence guy to walk around pretending like he was doing something so he could mark off that things were fixed. I made sure to take pictures of stuff being in the exact same condition before and after his visit. They lied and said there was no way to contact corporate so I am coming to BBB for help.

      I am rejecting this response because as shown in my proof, on the same exact day that I seen the apartment, I sent in a response to the company about not accepting that crappy excuse of apartment that you wanted me to transfer to. The proof is right there. This apartment complex is a scam along with its agent. You will either produce an apartment that meets proper standards, refund my money to me or I will take further legal action. 

      I am tired of the lying by all the leasing consults and tired of the run around. This company is very unprofessional. The other unit you showed me was the same quality as my current unit and you can smell and see that all they did was come put a fresh coat of paint on the tub. I look forward to your response with a better solution and less lies because I come with the proof.
