On October 9, 2024, I received a text message and email with direct threat of lawsuit from **** ******* with a company called, Payroll LLC.He has a contract with digital signatures using my name, signed on August 4, 2023 using my email address. It is also signed by other names to which I am not familiar such as ****** ******** and ******** De La *********** this paperwork, they allege they will be collecting employee retention credits. During this time, I did not have W-2 employees that would be able to earn these credits. My initial company on the agreement is no longer in business. The other companies on the agreement never had employees either.Payroll LLC alleges I am to pay them a percentage of **** received, yet nothing was ever received and to my knowledge, Payroll LLC, never actually did any work for myself or company.On their agreement in section 3a, it states, The term of this Agreement shall be effective on the Effective Date and shall continue for shall continue until PAYROLL LLC has received all Payments due for services (Term),unless earlier terminated in accordance with the terms and conditions *************** were never performed. **** never received. Therefore, above and beyond this is not my signature, the agreement should be discontinued. In an email to me personally, **** ******* stated, While we have sued over 400 companies already, for lack of payment, and have not lost a single case. This is a direct threat with zero funds to collect. On August 15, 2023, I was contacted by ***** ********* in regards to this same matter. He threatened collections when I stated this was not my agreement. He also threatened a litigious path.I am writing to request your assistance in having this fraudulent organization cease and desist all communication and actions against myself and any organization I may operate. I have no legal agreement with them. They have never done any work for me. They continue to threaten me.Initial Complaint

Payroll LLC contacted me in regards to the *** credit. I went with them and never received an *** check. Just got served papers today that they are suing me for $ ******* which represents 25% of the credit I was supposed to receive. Problem is I never received any money. I have not heard from them in months now a lawsuit shows up at my door. Tried to contact the company and goes to voicemail which is full.Initial Complaint

This company assisted in filing for the *** rebate from the **** was supposed to be direct deposited by September. It has yet to be recieved and the email I had, as well as the phone number are no longer working and no one is responding to my multiple emails.Business Response

Payroll LLC continues to send emails, and the unsubscribe link is not working. I've made several phone calls, and they will not remove me from their list. Hi ******,Here are the 2 documents submitted to us and they both have the same IP address on the last page to provide a finger print of where it came from. We do not submit fake agreeements to ourselves and don't appreciate the libelous comments. If she continues, she will be sued for lible.As for the agreement, yes, we will legally pursue payment if she gets her ERC done elsewhere. I have received multiple emails from Payroll LLC regarding ERC tax credits. After receiving the first email, I replied back (to ***********************************) asking that my email be removed from their list. Today I received another email following up on the first email she sent. The screenshot of today's email is attached. You'll notice there is no unsubscribe link on this unsolicited email. My request to have my email removed from their list was ignored. If the concern is not to listen to customers, what is their concern? (could it be that the lucracitve 20% fee on any collected ERC refund makes it worth the risk of making people upset?)Per the link inside the email, the company president is ***********************.Business Response

Hi ******,Here is the reply to this complaint. You can see below that while the client DID email us back to remove them, they did NOT use the unsubscribe link at the bottom of the email they initially recevied. It find it "convenient" that the screenshot offered by them does not show the entire email we sent and the unsubscribe link is intentionally not being shown. WE received 50 unsubscribe requests from that same link from the same bulk email that went out to this BUSINESS owner.Please tell them to stop wasting everyone's time.Thank you for your consideration,***********************

I am rejecting this response because:It shouldn't matter whether I request to be removed or use the unsubscribe link. While the unsubscribe link may be more convenient for the business, the requirement is the same. I don't care if there is an unsubscribe link, I sent the request via email reply so I could document my request (which was ignored).
The business owner complained that I was "wasting everyone's time" by filing my complaint, yet his company Payroll, LLC is the one sending unsolicited emails to what I assume is thousands if not tens of thousands of businesses. If he is so concerned about wasting everyone's time, maybe he should reconsider his own "business acquisition" methods that waste far more time.

I am rejecting this response because *************************** response was HIGHLY UNPROFESSIONAL. The email I received was NOT automated, nor was there an "Unsubscribe" link in the email. Telling me to click a non-existent button and "stop wasting everyone's time" is an incredibly hypocritical response coming from a company who sends out emails that waste people's time. I suggest that **** take some courses on how to behave more professionally when faced with a negative response.
