Nicklaus Design created the golf course which my property is located. The design of the hole with the changes in technology for the average club golfer has made my house be repeatedly hit by golf ***** breaking windows and roof tiles. Damaging metal gutters and creating an unsafe area for any person or pet to be during the daylight hours. Over 2 years ago, the * Nicklaus Design team were here overhauling a sister course and I asked the club leadership to have them look at this hole to see what could be done. The course club leadership said they would but never did. Then, that leadership changed and I have repeatedly asked the course club leadership to do something and they are telling me nothing can be done. I am tired of paying for broken windows and roof tiles and not being able to be in our backyard and I am asking the *. Nicklaus Design team to look into what can be done to change the design of the hole to help mitigate golfers damaging and putting people, property and pets in ***** way. I did contact * Nicklaus Design in Palm Beach and the person tht I was directed to initially will never answer any emails or calls.

Please accept my apologies for the delay in responding to the original notice.  ************** has assumed other duties at our company, and referred this matter to me for response on behalf of Nicklaus Design.

I am rejecting this response because:

When a manufacturer creates a product that later is found to be a safety risk for people, the companies with integrity take responsibility and have a recall or repair of the product to ensure safety.  The design of this hole is not safe for people, pets and property and while I dont personally know Mr. *********************** I want to believe he lives his life with integrity just like the recent Golf Digest article about the lawsuit with Nicklaus Companies stated.

Yesterday, Mr. ********************** was commentating for the Memorial tournament and made 2 statements repeatedly that I believe apply directly to this situation.  He said more than once that golf courses/holes need to be modified or changed due to how they are played.  The hole that I live on needs to modified just like Mr. ********************** stated.  I have asked the Club to look at what can be done and they state they can not alter the design, that **** ********************** ************** has to advise and endorse.

Mr. ********************** also said more than once that he doesnt want anyone hurt on a course of his design.  So far, a person hasnt been hurt, yet, but the increase in occurrences of ***** breaking windows and roof tiles and the force of which the ***** are coming into the yard and hitting the house increase the probability that someone is going to be hurt.

I tried repeatedly to work with the Club when Jack ********************** Design teams were here to have them look at the hole and advise, which would have been no additional cost to your company.  But, this never happened even though I was repeatedly assured by *************** that it would happen.

I am not a golf course designer, but I am a golfer and I believe there are simple options that can be implemented to help move the direction of ***** being hit errantly from the back tee boxes.

In closing your company that uses Mr **********************s name can ***** responsibility just like the golfers who break my windows and wont take responsibility, but I dont believe that is what Mr.. ********************** would want associated with his name.

    Sincerely,

    *******************************
