    I hired Renovations Home Center and KAS Construction for a renovation project. High-Pressure Sales Tactics:**** ***** pressured us into making a $28,208 commitment payment for kitchen cabinets, claiming we had to act immediately to secure a distant construction start date. He hinted at a possible earlier timeline, which later proved to be ************ and Communication Problems:**** ***** delegated much of the design work and communications to his young daughter, which led to repeated revisions and delays. The designs often didnt align with what we requested, and I had to repeatedly remind him that this was my house. Adding to the delays, ***** frequently left town for his new business in **************************** Progress Made:When ***** terminated the contract via email after I expressed my frustration at the escalating costs, no tangible progress had been made. There were no permits, no architectural plans, no materials had been ordered, not even his specialty of cabinets had been ordered - nothing to show for the months we spent working with him.Broken Refund Promises:******* termination of services email stated at this time I feel we should tear up your contract and Ill refund your deposit. Later he insisted on keeping some money for his time, which ultimately turned out that he wanted to keep nearly all the money. He eventually agreed to a more reasonable settlement, then again reneged and paid nothing. Unfulfilled Refund:We have not received any portion of our $28,208, nor have we received any cabinets or work from **** ******* *************** and Regulatory Actions:We reported the issue multiple regulatory agencies. ***** was investigated for fraud and other potential violations. The Florida State Attorney recently determined that the facts and circumstances as presented do not warrant prosecution at this time. They advised that at this time our best recourse will be through a civil lawsuit.

    **** ***** never signed the settlement agreement, so that isn't a valid legal document. He simply agreed via email to the terms and that I would send over the document for him to sign. Besides I wouldn't agree to those terms at this point because I've since had to pay others to do the things he was going to provide as part of the settlement. 

     

    I have dozens of documents and I know the BBB isn't an enforcement agency so I won't waste your time sending it all. I've attached a few that are relevant. One is a photo of the deposit check we gave **** ***** which was supposed to be for all of the cabinet. As a reminder we never received any goods or services from ***** or his companies. The second is the email he sent terminating the contract and offering to refund our money (the $28,208). The third is a Notice to contractor as required by FL law which ***** ignored. The last is a demand letter from my lawyer outlining our case which ***** also ignored. 

     

    Unfortunately **** ***** will also ignore your inquiry, that is his MO. He didn't care about a government agency inquiry, he won't care about yours. I hope I'm wrong, but a year and a half dealing with him I've learned he doesn't care because new customers keep walking in his door desperate for a new kitchen.

     To Whom it may concern.
    On June 15th, 2023, **** ***** conducted a presentation meeting with ***** and ***** ******* regarding a remodeling project at their home located at ***************************************. During this meeting I presented a written contract, Architectural drawings, 2020 designs kitchen and bathroom designs and a full home sketch up design. The Newmarks requested and were granted time to process the contract document for their review.
    On June 17th, 2023 **** and ***** ******* returned to my office, accepted the contract and drawings as presented and executed the contract including the Non Refundable deposit payment in the sum of $28,208 as required by the contract to secure the purchase of the cabinets needed for the project as drawn.
    On September 21, 2023 after 2 months of continuous design changes and contractual change requests I was pushed to extreme frustration. Mr. ****** accused us of being unresponsive and saying that we were not helping with the tasks he was conducting with ******* regarding the purchase of his windows and door. The suggestion to terminate the contract and start over was based on the fact that the executed contract was supported by the architectural drawing that was presented on June ******* of September 21, the entire scope of work had changed and the line-item pricing presented on June 15 no longer represented the newly requested scope of work.
    Mr.Newmarks accusations of design flaws are unfounded. I am a professional in the industry. The time to make changes to a contract or contract documents is prior to the execution. The markup on the windows was discussed many times. The exact amount of the window and door markup could never be established because the specific windows needed continuously changed. Any change in cabinet pricing could only be due to changes made by Mr. ********************** claims that were was slow during the change period. First off, the change period was services over and above the original contract. On Jun 17th we both agreed and solidified the scope of work to be performed.
    Slow?Between June 17th and September 21st there were 110 emails sent for Mr. ******* and 108 responses. After briefly reviewing time stamps on emails 80 % of the responses from my office were done with in 10 minutes with the longest time between correspondence was around 6 hours. I show as many as 6-8 emails sent with responses made on many days.
    At Renovations Home Center we work as a team, everyone is involved. Mr. ******* referring to ***** ***** as my ***** Daughter to devalue her efforts is appalling. ******** is a leading professional in the industry. She is proficient in Auto Cad,2020 designs and Sketchup. Mr. ******* continuously praised her efforts during the redesign.  
    Mr.Newmarks tools for negotiation were written intimidation, written threats and extorsion. I NEVER DEMANDED anything. I asked on numerous occasions for an explanation why I did not deserve to be compensated for the services that I provided. I presented drawings that Mr. ****** has an intent on using which are a $10,000 value. I completed and managed the development of his window order that has an agreed upon cost of $13,946.
    Mr.Newmarks Mutual release settlement requested that I hand over all drawings,notes, renderings and dimensions that were produced after the signing of the contract. Upon receipt of his Mutual release, I asked why he is entitled to the documents that have no relevancy to the original contract and if it is established that he was entitled to the additional documents I would provide them. Once again, he was unable to provide any reasoning for his request.
    As for any state statute violation that he claims, I made would be the obligation of the state to take appropriate action. I dispute the accusation.
    I remain with the same standing as I did on September 21st. Under the laws governing unjust enrichment I am entitled to compensation for the services that I provided as per the contract documents. Mr. ****** has every intension to use my design and architectural drawings as he requested additional drawings, and he has stated in this complaint. The drawings that he now has in his possession are the property of Kas Construction DBA Renovations Home Center and protected by copywrite law. The window order management has been completed; the installation of the windows was stated in the contract as a separate line item including a fee for installation management.
    In addition to the compensation requests as listed above Renovations Home Center is entitled to full compensation for all additional requested services made after the execution of the contract. At a rate of $125 per hour billed in ******************************* article 3 line 3.8
    In summary, I am obligated to fulfill all obligations as stated in the contract dated June 17th, 2023. Any deviation or noncompliance with the contract documents will result in a breach of contract.

    I am rejecting this response because as he has done for nearly two years **** ***** misrepresents actual facts. What this comes down to is **** ***** took a $28,208 deposit for cabinetry. To date I have not received any cabinets from he or his companies. All of the other things he is claiming are both untrue and irrelevant. He is the one who wrote that he is terminating the contract and would provide a full refund. To date I have not receive any money back. He can't take money I paid him for cabinetry and arbitrarily assign it to time he claims to have spent. I got absolutely no value or usable work product from what he is claiming to have spent time on, so he can't charge me for it. I offered to settle with him in exchange for his work product and he refused, so I had to hire other professionals to provide those services. **** ***** remains unethical, arrogant and a truly bad business person. I'll get my money back in a civil case.

    Everything that I promptly provide regarding Me Newmark is 100% factual and supported by the contract documents and past communication. He has not received any cabinets because after 3 months of making changes Mr. ******* never provided the information needed in order to order the cabinets.

    Can you please provide any documentation supporting the claim that any of my statement is "Untrue"? The relevancy of every one of my claims is to be evaluated by the person or persons evaluating my claim, NOT Mr. ****************** claim of termination of the contract by Mr. ******* is affable. It's evident that Mr. ******* is not privy to contract law. No party of a contract can say "I don't want to plat no more" 

    He is not deserving of a refund for many reasons. First off it is stated in the contract that his deposit is nonrefundable. He was not provided physical drawings until he paid a deposit. this is so my efforts, knowledge, experience and expertise.

    My designs are very unique and one of a kind. Not only did I provide my design as stated in the contract $10,000 value, my office also continued with making changes for 3 months. after the execution of the contract which accumulated countless billable hours. 

    Mr. ******* committed copyright infringement by theft of intellectual property.

    Mr. ******* offered to settle if I would provide him with all of our services that were executed after the executed contract that he signed and excepted. Our contract stated, "Provide Architectural, working drawings" We did this only to have Mr. ******* give them to an outside architect. 

    How am I "Unethical?" have done NOTHING Unethical. Please direct Mr. ******* to the Contract documents

    Arrogant? Every person or regulating body has determined that there were no grounds for any further actions against myself or Renovations Home Center. 

    I have been in business for over 30 years. I have produced thousands of satisfied customers, and I continue. 

    Mr. ******* has the right to take any avenue that he would like to support his claim.

    I will continue with my #1 goal and that is customer satisfaction. Unfortunately, Mr. ******* holds no value in a contract or contract law.

    When the contract states, "Remove and Reconstruct walls as drawn" That was refiring to the drawings presented NOT drawings that will be created at a later date 

    When the contract states "Provide Architectual drawings for $10,000" That is the drawings presented at the time that the contract was executed.  

    When the contract states, "Contractor shall have the discretion to provide labor, materials and supplies as needed that are outside the scope of work at $125 per hour" and Mr. ******* continuously requested additional design services for 3 months after the execution of the contract. These services are billable.

    Mr. ******* entered into a contract that he was not ready to except.
