    Went into contract with said contractor in December to perform French drain replacement, tree ***** grinding, and hard landscape work (river rock) after all finished. ********** wanted 50% job cost upfront and the remaining 50% at job completion. I paid him the 50% job cost in January. Since then he has asked for more money and failed to appear to do the work at the job site for the past 2 months. He has repeatedly committed to start dates and then was a no show. I informed him that the final start date he gave would be it and if he did not show up on that date, the contract would be cancelled and I would be demanding a refund of my money. He did not show up on the date he said he would nor communicated since then. He also has not refunded my money for services never provided. This guy is a complete scam.

    I am writing to formally complain against Make It Rain, LLC. I entered a contract for retention/drainage systems required by the ************* (June 15, 2023; see attachment). My complaint is that he failed to provide the service and misled me into believing he had the experience and the team to do this work. I hired him to build a retention /Drainage pile system consisting of a trench (2-6 deep and 4-4wide), gravel backfill, two rock fielded bubbler, and ADS drainpipes. He reassured me that he could get it done within one week. Two weeks later, he told me that he needed a 50% deposit before the commencement of the work (June 16, I paid $2534), which I thought he was to start the project per the contract. The next day he told me he could not do the job at the prices and increased the value by 3 x the original cost. I felt he took advantage of my depressed state and pressure to get this done because of the closing date of the house. I thought about what he had said, but I wanted a refund of my money, and for one week, he did nothing to move forward with the project. But he made excuses and refused. Two more weeks, he returned to me and asked for more money, and I believe he was committed to doing the work. I made a second deposit (June 25, and I paid $4,000) with concerns because he promised to deliver the service this time. For two weeks, he was getting prepared. The week (July *****) that he was to start, he had nothing ready to dig out the trench. He complained about the irrigation system and told me he was not liable for any damages. On July 11, he did not have people, no diggers or no dumpers for the dirt. He makes excuses for not showing up prepared to start work and asks for full project payment. I told him he would get his final payment once he passed the city inspection. He said he would start until full payment and continue to make excuses about not having people available.

    As you see, I have a signed contract in BOLD lettering with his initials beside it. I also have the estimate that he approved with the terms and conditions. As it was printed in both documents and approved and signed and initialed by Mr ******************* I cannot and will not give a refund. It was known very well of the conditions of the job. I came into this project apprehensively because the project seemed to have many issues. So I'm upset even further being I have done nothing but **** over backwards to try and help this guy. I'm really taken back that he is trying to pull something like this. So my answer is NO. The materials are all sitting ONSITE.

    I am rejecting this response because per the attached contract I signed dated June 15, 2023, for the drainage system,it is estimated at $4428. I made the first deposit of $2,534 on June 16, 2023.Soon after, he told me he would charge over $16,000. He continued asking for more money and tried to convince me he was trustworthy.  I felt I had to make a second payment of $4,000 (see attached receipt), hoping he would do the project. So that everyone can understand, he has $6,534.00 of my military pay,and all I have is a hole in the ground (see picture) and in the wrong location.He is trying to intimidate me and take advantage of this Army veteran.
