    On 9/6/24 the business performed tree removal and trimming according to a contract (Proposal #****). Their agent, a crane company, parked a crane on the premises that was leaking fluid. The onsite manager, ****, was aware of the leaking and the potential damage to the paver driveway. The manager negligently attempted to prevent damage to the driveway by placing wooden boards under the crane. ****, stated that he knew it was leaking but did not want to cancel the job. The company has attempted to blame their agent and not accept responsibility for the damage.The crane leaked this fluid onto the driveway pavers, causing serious and unrepairable property damage. The entire driveway needs to be replaced.Damage to Pool Screen:A hole in the pool screen is directly below where they working. The screen appears to be pushed in from the top, and it was not there before this work. This screen will need to be replaced. Failure to Complete Work:The contract calls for prune suckers and deadwood within property lines, from oak in backyard. This was not completed. The employee admitted this was not done and said he would complete this when he returned to the property. He did not. The Arborist/Salesman ****** ********, said the crew would be back out to finish the job. They did not. The contract calls for them to blow off roof and gutters. They did not. The roof and gutters have more tree debris than before the job was performed. The contract stated, Tampa Bay Tree Service, LLC will attempt to minimize all disturbances to the customers lawn and surfaces. They did not. They did as much damage as possible to the lawn.Their equipment was in such poor repair, that the trailer they used to bring in equipment broke so they were unable to remove their equipment and left it on my lawn until Monday.

    On 9/6 We completed a Tree removal job via crane at Mr. ************* The third party cranes hydraulic line did start leaking onto the the drive way and we were not aware until mid job. **** our lead foramen gabbed the plywood boards and placed them onto the ground to stop any further damage from occurring.  ***** ***** employee did not seem to be concerned as this is something that happens from time to time with a large crane like this one. The job was completed and Mr. ***** refused to pay us stating drive way was severely damaged. (See images below) . The job was completed and it states in the contract that we would blow off roofline and or gutters from the debris that we create. I believe he expected us to clean them  out like a gutter company but still not a big issue. Tampa Bay Tree service's top priority is that we always put our customers and will recodifying any situation to make them happy. We tried to call Mr. ***** several times. Finally we got ***** on the phone and told him we acknowledge the crane was leaking and will take the first steps to fix his issue.   ***** ***** sent out a professional pressure washer twice and Mr. ***** was still not happy with the results. (see after photos) He also stated that part of the work we did was not completed. We let him know that we would get him on the schedule to finish any remaining items he needed to be finished. We also let him know that since we was not happy we would now move on to hiring a professional paver company to come out and give us a quote to fix his drive way.  The next morning Mr. ***** had already contacted our insurance company prompting a claim and he sent us an email with our insurance on it telling us we would no longer be allowed on his property and neither would ***** *****. By doing this he stopped any chance we had at fixing the situation. Moving forward during this time period we witnessed two devastating hurricanes where Mr. *********** is located and was hit the hardest. After the storms were over he conveniently stated that now he had lawn damage and his pool screen was ripped but never let the company know at the time of the job being completed. Below it states desired resolution $5000 but at the time tried to get $50,000 claiming it would be that much for everything. It also helped that he is a lawyer so Mr. ***** used his power to harasses the insurance company by sending people letters who work for the insurance company to their personal homes. The insurance company paid him $20,000 which he already signed for and received even though the damages totaling did not come near that number.

    Their response misstates the facts. In addition, their response violates the settlement agreement that we entered into with them. Unfortunately, I cannot respond because I honor my written agreements.
