    Dear BBB,

    My name is ******* ******* and I am employed at ***** Driving School (ADS) as a Class E Driving Skills Examiner. ***** Driving School is A Third-Party Administrator (TPA) certified and authorized by Florida Highway Safety and Motor Vehicles (FLHSMV) to conduct Class E Driving Skills Test and Also the Permit test. The applicant was accompanied by a parent to ********** on the day of the test and the parent waited in the office while the test was conducted by me. Upon completion of the test, the applicant and I returned to the office, and at this point I informed the applicant along with the parent about the result of the examination. The applicant was informed that she violated the traffic laws and signs by driving 40 MPH the 35 MPH posted speed limit zone. The applicant was informed that she also did not come to a complete stop at posted stop signs. Upon hearing that she failed, the applicant immediately challenged the test results and was very disruptive in front of other customers. The applicant was informed that she can retest on the next business day, both the applicant and her parent said that they would not come back to our office, and they also demanded a full refund. They were informed that the test has been completed and as a result there would be no refund as requested. In response to the allegation about the claim that my phone was ringing. There is nothing in the rules that states my phone cannot ring, and while I did not answer the phone nor do I use my phone during Driving Test, I am required to have the phone with me in case of emergencies.

    This complaint is unfortunate because here at ADS, Safety is our top concern, and we cannot, and we will not give a passing grade to someone who violates the traffic laws and signs. We are contracted by ****** to conduct the class E Driving Skills tests in accordance with the Law and we cannot cut corners for anyone person. Based on our contract with *****, I am allowed to share the route information or any other propriety information, but please reach out if you should require any other information.

    My daughter got her driving license the next day and the test results were excellent, I firmly believe that the test results in Ann's Driving School failed in part as retaliation because the instructions for the test were declined since the test has a higher rate with instructions.

    In regards to the instructor's phone ringing, I understand they have to carry it but it should be in silence since this originate a distraction when rings loudly and the instructor look at the screen instead of paying attention to the driver.

    Dear BBB, in response to the customer complaint and response to my response, the Class E Driving exam was carried out in accordance with the parameters set forth by Florida Highway Safety & Motor Vehicles (FLHSMV).
    In the customer response, she believes that she failed the test because she declined to take the 15 minutes preparation session. This is false because many customers have passed their Class E ********************** exam here at our office without taking the practice session.The second point concerning the phone was addressed in my previous response where I stated that I am required to have the phone with me, and I will also add that I did not use my phone. The Class E driving exam is conducted on the public roadways where noise is a constant factor. The instructions given at the start of the test clearly states, " PLEASE OBSERVE AND OBEY ALL TRAFFIC LAWS AND SIGNS". The customer mentioned that they took the exam the next day and had excellent results, and this makes sense considering the fact that the customer took the exam at ***** ******************************************* the day prior and failed because of exceeding the speed limit of 35 MPH. and also not making full stops at stop signs. As a result of the exam experience gained at our office, the customer learned what is required to pass a Class E Driving Exam. We are contracted to conduct Class E Driving Exams, and all tests are carried out *** the FLHSMV rules with respect to road SAFETY and observance of traffic laws. Safety being our top concern. We are very concerned that the customer would challenge the ********************** test results and seek a refund after failing the driving exam. We hope that this reply satisfies all questions and concerns, and we will continue to promote safety by carry out CLASS E DRIVING EXAMS IAW the laws and regulations set forth by *******

    I am rejecting this response because: The two situations described are false, the limit was not exceded and all the stops were full stops.

    I believe this situation comes down to the word of the customer against the word of the instructor having the instructor distracted by the phone.

    Dear BBB, The customer failed the Class E ********************** Exam because the customer did not obey traffic laws and signs as required to pass the class E driving exam. There will be no REFUND to the customer and the results of the test are final. Any future attempts to pressure ***** Driving school to reverse the results of the Class E driving Exam will be considered as harassment and intimidation. As a Third Party testing site, we are required to uphold Florida law when we conduct the Class E Driving Exam, and we cannot make exceptions because the customer doesn't like the results.
