    I hired ***** Environmental Services on 7 February to do a septic location survey on a lot that I am trying to build a home on. The company specializes in assisting home builders in filing septic permit paperwork with the Florida health department. My check for $720 was cashed on 21 February. On the second sight survey of the property conducted on 22 February, the owner of the company Brad ***** instructed his surveyor Posha ********* to stop the survey without discussing the matter with me for reasons unknown to me. The survey is incomplete and ***** Environmental is in breach of contract do to the fact they already cashed the check for no services rendered.

    Attached is a .pdf document outlining this process.  I apologize this did not get attached in the first response.  As stated in the attached document, we came to a conclusion that we could no longer assist Mr. ******* in his septic system permitting process.  We exhausted all avenues with Mr. ******* that would meet the minimum required rules of the State of Florida in septic permitting throughout this process.  I also consulted with the director of Walton County Health Department / Environmental Health regarding Mr. *******'s main concern, the wet ditch located in the front of his properties to ensure.  As stated in the attached .pdf document, I mailed all completed paperwork and partial refund to Mr. ******* on 2/22/23.  Please let me know if you have any questions and if you do not receive the attachment this time.  Again, after my conversation with Mrs. ********* while she was meeting onsite with Mr. *******, it was my understanding that Mr. ******* was also good with this action and the partial refund.  We have been in business for a long time and have never had a complaint.  We always strive to do the right thing for all of our clients.  If Mr. ******* is still not satisfied with the resulting action, please let me know what would make him satisfied.  I appreciate it, Brad.

    I am rejecting this response because: As Mr. ***** stated. I agreed with a partial refund, but the refund was $210.00 out of the $720 I paid. I think a 75% refund would be more appropriate considering the fact that Mr. ***** refused to draw the plans that I requested based on their assessment of the land after a week of rain. After measuring the dimensions and offsets myself, my final sight plan request met all the requirements we were looking for but was denied over a phone call between Mr. ***** and Mrs. ********* based solely on a recent man-made terrain feature that collected water after periods of rain but is dry the rest of the year. Essentially a puddle not "standing water" or a "drainage easement" as they called it. Had they inspected the property after a few dry days as I requested, they would have seen that it remains dry. When hiring a private environmental company to do a survey, one expects the company to also act as an advisor to help the customer make the right decisions and achieve the best possible outcome. Mr. ***** and his team's solution was to take up two parcels to build a single septic system. Effectively making two waterfront lots unusable and unsellable in the future because they would both have a septic tank in the middle of the usable building offsets for any future home sights. A $500,000 plus loss in potential land value. In summation, it is my opinion they failed to do their job on this project.

    We did not refuse to draw plans for Mr. *******.  I mailed him the completed paperwork, which included a scaled plot plan per his initial request during our first onsite visit.  After all paperwork and field work had been completed per Mr. *******'s request, he requested that we do not submit for septic permit.  We then had several phone conversations with him discussing other options for the septic system location.  He then requested we make another onsite visit to do the field work for only lot 2, knowing this would be denied for permit, but would allow him to enter the state variance process.  It was at this onsite visit he had changed his mind again regarding the septic location.  All surface water measurements that were taken were based on the State of Florida requirements.  I also confirmed this with the director of environmental health at the health department.  We are required to work within the requirements of the State of Florida.  I do not agree with his negative comments about our business.  We have answered every question he has had and explained the State requirements.  I also do not agree with his comments regarding his analysis of what is and what is not surface water.  They are incorrect per the State of Florida rules. 

    He has stated in his response that he would be satisfied with a 75% refund of his $720 payment.  I have already mailed him a refund check for $210.  I will mail him an additional refund check of $330 today, which will total 75% of his payment.  Per his response, this will satisfy him.
