    The substitution of the steel doors specified in your contract was necessary due to sizing limitations, and we upgraded to custom fiberglass doors to meet building codes and quality standards. While we regret not informing you about this change earlier, we want to emphasize that these doors were chosen for their suitability and were more costly than the original steel options. According to the Terms and Conditions of our Contract,***** reserves the right to make changes to the products or materials if deemed necessary for proper installation. This clause allowed us to make the substitution and upgrade to the fiberglass doors.
    We have reached out to explain the circumstances and remain committed to addressing any outstanding issues at your property.

    This email is our response to your 12/3/2024 email to us and your two messages from business that you posted at the BBB web site on 12/5/2024 to answer our complaint about your business - GM Door Window and  Screen.


    1. You wrote about  GMDWS RESERVES THE RIGHT TO MAKE CHANGES TO PRODUCTS AND MATERIALS


    Below is the section of your contract that you cited as allowing you to change from our contracted order steel doors to fiberglass doors without asking for our agreement:


    You the Customer, (hereinafter The Customer') agrees that the work /0 be performed by us, GM DOOf. Window & Screen LLC (hereinafter "GMDWS"), will be exclusively what is specified on the reverse of this Estimate I Contract to be performed in accordance with the drawings and specifications and completed in a reasonable workmanship like manner. It is agreed that in the event of a typographical, mathematical or human error, the parties hereto agree to immediately adjust the same. In addition, Customer understands and agrees that ***** reserves the right to make any and all changes which, in its sole judgment. are necessary for the PROPER INSTALLATION of the materials and f or products and f or the work specified.


    This paragraph includes this sentence, noted below, requiring GM Door Window & Screen and your customer to immediately inform the other party about changes for any reason: 


    It is agreed that in the event of a typographical, mathematical or human error, the parties hereto agree to immediately adjust the same.


    You documented in your written response to our BBB complaint and in your email sent directly to us that did not immediately contact us, as your contract terms require, to adjust this contract:

    You did not follow the terms of your contract by not immediately informing us of an adjustment.
    You had four months to inform us. We signed the contract with your GM Window Door and Screen representative on 7/16/2024. The installation permit was issued by *********** to you on 10/18/2024. Your staff installed the doors on 11/4/2024.  We were first informed of your unauthorized changes on 11/8/2024 during the first inspection of your completed installation by the *************************************************** inspector when he failed your work because, you provided false documentation for steel doors by Jeld-Wen. He found fiberglass doors by Plastpro.  Also, all of the applications you filed with Cooper City were documented for steel doors installation.

    We did not give GM Door Window and Screen power of attorney over our choices.


    2.  You wrote about steel door and fiberglass door availability, sizing, and costs in both emails.


    In the documents you submitted to Cooper City you reported your measurements for the front door area to be 66 inches wide x 94 inches high and for the back door area to be 33inches wide x 94inches high.


     I researched the cost and availability of fiberglass & steel doors. I found that  both steel and fiberglass doors could be purchased. The closest height for both door areas are available in **************. The next lower height for both types of doors is  84inches.  Both types of doors must be cut down a 94 inch height to fit my doorways.   The widths were available without the need for alterations. There is other hardware needed to install both types of doors. Per contract and you told us, that we must supply door handles and locks 


    Suppliers told us that steel doors might take longer to prepare.  We told you from the start of our relationship that was no need to hurry. There were no circumstances that required fast replacement of our current steel doors.


    We dont know if your actions were intentional or a set of errors.  However, as a good business practice to protect you good reputation we request that you do the following to compensate us for the problems you  created for us:


    Credit us $500 to allow us to hire a painter to refinish the bathroom walls you damaged with your sloppy caulking.
    Your staff will repair your damage to bathroom door frame.  If you dont have a staff member with the skill to correctly repair the door frame you will  provide funds to cover the cost of a carpenters repair.  Please lets us know your decision so we can obtain a cost estimate.

    I've been trying to reach you by phone, but I havent been able to speak with you directly yet. I genuinely want to address and resolve any concerns you have as soon as possible.
    This is a family business, and I work alongside my two daughters to manage every project. We take great pride in what we do, and I am personally responsible for handling any issues that may arise after installation.
    I do understand that there was an oversight on our part regarding the style of the doors due to the opening sizes and the documents for the City Permit. While we worked to be able to have both doors ready at the same time, we inadvertently missed communicated the changes to you, but in the terms and conditions of the contract you signed it says that we have the right to make any and all changes which, in [our] sole judgement, are necessary for the proper installation of the materials and/or products and/or the work specified. Despite this, I understand that there are still aspects of the project youre not completely satisfied with, and I want to make things right.
    We offered a repair date, but it seems there has been some delay due to our communications. Were more than happy to address any outstanding concerns and offer our assistance.
    Regarding your request for reimbursement, Id like to remind you that the upgraded custom doors we installed were provided at no extra charge, and we have fully fulfilled the terms of our contract. The installation passed the City inspection, and the permit has been closed.
    I kindly ask for the opportunity to resolve this matter in person. I will be available on Wednesday, December 18th, 2024, with our technician to address any issues youd like taken care of. As we are closing for the holidays, this will be our final opportunity to complete any work this year. Its a season for peace and resolution, and I truly want to close this matter on a positive note. We have received many positive reviews from our satisfied customers, and Im hopeful that we can turn this experience into a positive one as well.

    I am rejecting this response because:


    Whether your actions were intentional or a set of errors, it is good business practice to protect your reputation by giving us adequate compensation for the problems you created for us. We asked for the following:
    Reimburse us for professional painting of the bathroom. I have no left over original paint.  The bathroom was painted in one color. The room was painted two years ago and we were told by a professional painter a copy of a formula this old will not be an exact match for a touch up as you offered. Our cost is approximately $550.00.            


    Prove with verified receipts from your vendor Bargain Doors of Ft. Lauderdale what you paid for the fiberglass doors as compared to written a verified estimate from them for steel doors.  Credit us for the difference less your labor cost. Otherwise, use the following information known to both of us. We paid you a total of $9827.00 less *******, the job value you submitted to the *******************************. This amount is $3900.00




    My research found:
    1. Contractor ******* ****** and GM Door Window & Screen, LLC. violated Florida Statutes chapter 501, Consumer Protection. Deceptive and Unfair Trade Practices 501.2077(e) , Violations involving Senior Citizens.
    My wife is 70 years old and I am 75 years old..


    2.  These doors are replacements for the original solid steel doors installed by the builder.  They are not upgraded or custom. They are  common, solid, plain six panel doors available from many door vendors as steel or fiberglass. They have no special features such as glass or peep holes. We supplied door handles and locks as required by your contract.  We  never wanted elaborate, upgraded doors.  We did not contract for upgraded custom doors.  I have attached photos of the doors you installed.


    After your first inspection failure, I decide to look at doors being sold to the public.  I  spoke with the staff and owner of your vendor  Builders Bargain of Ft. Lauderdale, **..  The owner and his staff told me that both steel and fiberglass are readily available as pre-hung manufactured units as single doors and double doors.   Builders Bargain told me that they charge the same price to the trade as to the public. The owner came to my home to give me the correct documentation for the doors that ******* had installed.


    The 33 inch wide manufactured doors are commonly available and  appropriate. However, both the front and back door openings require 94 inch high doors. Heights of 84 inch and  96 inches are available. All  manufactured doors, no matter what material, have to be cut down to 94 inches for the homes in my development. These cuts are an additional charge to the buyer.


    3.   I contacted Broward County to issue a complaint against her license. The County directed me to contact the **********************************************  The **************************************************; searched for her license in their database. They told me that ******* ****** is an unlicensed contractor. They told me that I should  email my complaint to their unlicensed contractor department at ************************* I have attached copies of her license listing in the Broward and State of Florida databases.


    We are waiting for an offer of adequate compensation  from GM Door Window & Screen, LLC. and their contractor ******* ****** before we have to register complaints with the two licensing organizations and consumer protection agencies.


    We hope that our complaints and documents sent to the BBB about GM Door Window & Screen, LLC. and their contractor ******* ****** are available to the public to review before, selecting this firm. We strongly suggest that the reader review this firms contract form before signing it and giving them any money.  Please see the copy that we placed in the BBBs files.  The firms contractor and owner utilizes the first paragraph to justify their actions.  They write in their emails to us and the ****** that those words allow GM Door Window & Screen, LLC. to do anything it wishes. We ordered, contracted, and paid for steel doors. However, their contractor installed fiberglass doors. This firm uses their contract  to justify their deceptions.

    We will complete the repairs to the bathroom door frame as previously agreed.Additionally, we are willing to offer you $400 as a gesture of goodwill and a token of our professionalism, reflecting our commitment to maintaining positive relationships with our customers.

     -Door Material and Pricing
    The costs of custom fiberglass doors, including the required adjustments for the 94-inch height, is $6,069.00 compared to the cost of the custom steel doors, including the required adjustments for the 94-inch height, which is $3,932.00. This means the fiberglass doors are 55% more expensive than steel doors.

     -Licensing and Permitting
    We would like to clarify that GM Door Window & Screen, LLC., and our contractor ******* ******, hold an active license in **************. Without an active license, we would not have been able to obtain the required permit from *********** for your project.

     -Response to Florida Statutes Claim
    We understand your concerns about Florida Statutes Chapter 501, specifically 501.2077(e), which addresses deceptive and unfair trade practices involving senior citizens. However, it is unlikely that our actions constitute a violation of this statute for the following reasons:
    Intent to Deceive or Defraud: The statute typically focuses on intentional acts of deception, fraud, or exploitation. The installation of a different door was an honest mistake of miscommunication, not an intentional effort to mislead or harm you.
    Improved Outcome for the Customer: The fiberglass doors installed are of higher quality and more expensive than the steel doors originally ordered. Furthermore, you were not charged any additional amount for this upgrade, indicating that no financial harm or deception occurred.

    We had impact Windows were installed on 11/21/20. We were given a full 10 year manufactures warranty (enclosed is a copy of the contract). July of this year 2023 we noticed a crack in the middle of the lower frame window on the inside pane. I promptly called GM Window and Screen Company and I was told to send a picture and they would get back to me. Nothing has been done I never received a call or email back and it has been over one month!

    Mr. ******:

    As per our conversation yesterday, I am attaching a copy of the Contract Terms and Conditions that you signed for the work we did at your property. Highlighted are the concerning parts of the glass warranty. Stress cracks are a naturally occurring result of the glass expanding and contracting while it settles on place after the window is installed. They tend to show up more in newly-installed windows that in older windows. Seasonal factors, like dramatic overnight temperature changes, are a common cause of cracks as well. Your windows have been installed since February 22, 2021. Its been 2 years and 6 months, enough time for your windows to settle.

    We want to clarify that we receive your notification on Jul. 14th. It has not been a month as you said on your BBB review. We were waiting for the manufacturer response in order to get back to you. As I mentioned it was not fair that you made a review without first checking with us directly as we are still working to find a solution for you.

    GM in this case is dependent upon the relevant manufacturers guarantees. We, are not contractually obligated to satisfy this issue. Nonetheless, we are willing to help you with the labor cost of removing and replacing the glass. You will only need to pay for a new laminated piece of glass. Please let me know which window is the one with the crack, in order for us to send to you the quote for the new glass.
