Signed first contract on June 25th, 2024, signed contract agreed upon fee of 12% goes to TRA and 88% goes to me and my sister *****. This business contract stated that I would "receive timely accounting of all funds disbursed by the court, retained by the Assignee, and distributed to me, the Assignor." None of this is accounted for in a "timely accounting." This is just the first breach of contract. Instead of *** taking the 12% fee we contractually agreed upon, TRA took it upon themselves to take another 9.5% fee without textual or verbal reason stating as to why they have violated Florida state law and taken more than the 12% that the written law says they can, which is 2% + another 10%. This 9.5% equates to $5576.41 give or take, due to never receiving the timely accounting that the contract states. So, I would say the nature of the dispute is breach of contractual services, and grand theft of monies owed to my sister ***** and I. The business has never tried to resolve it, they have went above and beyond to not return emails, voice mails, or set up phone calls between accounting ***** and I. I hadnt heard from TRA until the day or day after I emailed them my Letter of Demand. Due to the breaches in each of the contracts, I am seeking the full surplus amount of $58,453.31 minus the $45,862.5 that I ($22,931.25) and my sister ($22,931.25) have received already. The total I seek is ******* (the 12% fee) and $5,576.41 (the 9.5% over Florida state law that hasn't been received) for a final total of $12,590.81. They have failed to fulfill the contract they had drawn up, and I have went above and beyond what was asked of me in this contractual relationship we had. If TRA and I can not come to an agreement, once again, of forfeiting their fee of 12% on top of the 9.5% still owed to my sister and I for the severe breaches of contract services, I will escalate this matter and contact the ***** FTC, the states ********** and a contract and/or foreclosure attorney.Customer Answer

I acquired a home on 12/11/24.The Recovery Agents contacted me on the behalf of their customer ****** ************ on 12/17/24 with the proposition to allow Ms. ****** to live in the home for free for 60 days. After negotiations, the Recovery Agents agreed to pay ******* on Ms. ****** behalf to allow her to live on the property until 1/31/25. The Recovery Agents wanted a signed lease between myself and Ms. ****** before payment can be made. This lease was signed 1/6/25.The Recovery Agents have not returned calls, refuses to return calls and has not sent payment despite myself sending all documents to receive payment. The Recovery Agents is practicing deceitful and disingenuous practices by not making payments after agreeing to do so (after their customer has been living rent free since 12/11/24).Business Response

The payment was to come from ****** directly and not from The Recovery Agents.
Mr. *** is not our client nor are we part of any agreement. Further more, ****** did pay Mr. *** directly the day after this complaint was written.

I am rejecting this response because:In response to the communication that The Recovery Agents just provided, I would like to provide some context on the deceitful and disingenuous practices that are utilized by this business. The purchase of the home came from a partition sale in *******. The Recovery Agents, specifically *** *******, reached out and an agreement was made as previously mentioned. Upon execution of the contract, The Recovery Agents would disperse the funds on behalf of their client. The text thread between myself and *** ******* has been attached along with the lease agreement that states the Recovery Agents would disperse the funds as their client was under the same impression. This is due to the agreement that the Recovery Agents and their client entered to on 1/2/2025 regarding the "Agreement and Assignment of Rights to Net Proceeds From Judicial Sale" although the client's and my agreement was separate from this agreement, their client believed that the rent payment would come from these proceeds. In the conversations with *** ******* and text thread, *** ******* even clarified what the preferred method of payment would be so that the Recovery Agents could disperse the funds. *** ******* even assured that "I sent everything to our accounting department to get you paid" (see img_8513.png). On img_8514.png, *** stated that ****** would reach out to me. When ****** reached out to me, he stated that they wanted me to negotiate a buyout of the lien on the property and that no rental payment would be made. Only then did I reach out to their client and the client made the payment and requested that I take the BBB complaint off as it stated her name.

To re-iterate our prior response, our legal relationship is strictly and solely with our Client: ****************.
In **************** deciding to utilize our services to claim her portion of the Surplus Proceeds from the sale in **********, our role, as stated in our contract (and communicated to our client) is to claim her Surplus Funds on her behalf.As stated in our agreement (accessible and viewable on Bay Countys Case Search), those funds are to be mailed and disbursed to The Recovery Agents, LLC to then which promptly are disbursed to our client, less that rate agreed upon therewithin.
It seems at some point, this was lost in translation, and that ************************ was to receive a payment from The Recovery Agents directly.Our agreement is only again with Ms. *************** and the only funds that would be paid from The Recovery Agents, would be to our Assignor, *****************.
If an advance is provided to our clients directly, often times our representatives, will assist in collecting payment information from 3rd Party Purchasers to aid our assignor in paying them directly themselves after they receive an advance not to be confused with The Recovery Agents, paying a 3rd Party Purchaser directly, on behalf of our client.
Our assignor, Ms. *************** again, has since made payment to ************************. Furthermore, Mr. *** is not our client nor are we part of any agreement.
With the above in mind, we apologize for any misunderstanding that may have been derived from the triangle of communication, as we work in the best interest of our assignors, to ensure a smooth and seamless move out of their foreclosed home.We are happy you received the money you set out to retrieve from the Owner of the Property, and any further business youd like to conduct with her you are welcome to do so, on your own respective terms.

Thank you for reaching out regarding your concern.Our company assists homeowner's and family's facing foreclosures here in the ****************. As you can imagine, many heirs, relatives and homeowner's facing foreclosure don't answer their phones in this hard time, due to the large volume of calls they are getting from Cash ******************* Agents, and other recovery agencies alike.
It seems for whatever reason your phone number was sourced under another individual's name facing foreclosure here in the State of ******* not correlated to you from what we understand. (***********************)
****** is set to have equity owed back to him held in Broward County Court Registry after the Sale on August 1st, 2024. We were looking to get in contact with him, and it seems your number (phone number with one digit off from the owner's number here in *******) was pulled from that 3rd Party Provider.
We pride ourselves in our data sourcing, as we're the leader in this industry - which tells me it's very likely you have been getting many other phone calls from other companies as well.
On July 17th, 2024 you're contact was marked as a Wrong Number in our system and notated "DNC - Do Not Contact" to be compliant with your request, and it's standard protocol for that number to then not be contacted.
So you are aware, you're contact has been removed from our internal system entirely, so you don't run into any further issues.Please keep in mind, you will no longer be contacted by the Recovery Agents, however, note, that you may receive phone calls from other entities - to which that of course is out of our control.
Our best piece of advice if you have nothing to do with the **** Family located here in *************, simply block the phone calls as they come in, and that should help significantly.
The Auction Date in ************** is on August 1st, 2024, so expect an influx of calls that day from a variety of agencies and buyers alike. (Excluding The Recovery Agents)

I am writing to file a formal complaint regarding the services provided by The Recovery Agents. For a foreclosure and probate case, the property address, the name of the deceased, and the date of death are among the most critical details. Shockingly, The Recovery Agents managed to get all of these wrong on multiple occasions. These errors are not minor; they are fundamental to the case and have significant legal implications.In February, I sent an email highlighting critical inaccuracies in the correspondence regarding the property foreclosure. These included: (1) A glaring error in the provided address for the property in question. Given that this is a property-related case, I urged them to exercise greater diligence in ensuring the accuracy of essential information. (2) Misrepresentation of my role as the remainderman, a position that has not changed, contrary to the language used in the correspondence. I clarified that I am the remainderman, not "was." (3) Inconsistent statements in the affidavit regarding my relationship with ******. I am not an "heir" due to a lack of familial connection. The document inconsistently referred to me first as a family friend and subsequently as ******'s sole heir. The correct legal terminology for my roles is "personal representative" and "sole beneficiary."Additionally, there has been a continuous lack of follow-through on commitments, causing substantial delays. What should have been resolved months ago remains unresolved nearly a year later. On May 7th, I was assured that the probate paralegal, *****, would reach out to me within a few days. Despite follow-up confirmation last week, I still have not received any communication from her.The repeated failures and alleged negligence have eroded my confidence in their ability to handle my case competently. I have decided to terminate our agreement effective immediately due to the harm caused by their incompetence.Business Response

The Recovery agents, LLC.Do not take no for an answer and continue harassing phone calls even after being asked to be taken of the list, put on a do not call list, or being told we are on the national do not call registry... We have received upwards of three calls a day from harassing agents from this company over a property in ******* previously owned by my deceased mother but since she reversed mortgaged it is owned by and currently under litigation by **** of new york mellon trust company and I want nothing to do with this property at all and told the agents this over and over (I ask what company is calling every time to make sure it's the same harassing company) to no avail.... if they continue contacting me after this the next step is legal actionBusiness Response

You informed our representative ***** on October 27th, 2023 at around 4:00 PM to no longer contact yourself regarding Case # 2022-**-003136-O, otherwise you would file a complaint with the BBB.
I notated in our system to no longer call this file, as ***** brought this to my attention, at 4:06 PM. Not another phone call was made on that case, and we subsequently closed the Case in our system on October 30th, 2023.
Your number has been removed from our system, and as that Case is closed as well, you won't ever receive calls from us of course in the future under any circumstance.
We apologize for the inconvenience, as we know leading up to the auction clients can anticipate to receive hundreds of phone calls. We can assure you we were only attempting to reach you with good intention, regarding recovering the remaining equity in the home after the sale.
With that in mind, please contact Orange County Clerk of Courts directly if you'd like to claim the: $1,293.29 held in Court Registry after the sale took place on October 30th, 2023 of your mother's estate.

On 1/31/2022 I was contacted by The Recovery Agents about surplus on my home that had been auctioned. In the beginning the line of communication was very good. After a few months I would call, text and email with no response. When they did respond they said it was all the courts problem. They would say I would receive my money soon then a few more months go by then nothing. They notified me over a year later that the court finally released the money and I would be receiving it 5 business days after they got the check. After 7 days of no communication from them I contacted them and was told I would receive the money in my account today which is 5/5/23 and there is no money. I called them and they say that their bank account is locked because theyre trying to send out too much money at once and they have no idea when it will be taken care of. Also I have asked 4 times for them to give me an exact amount of what they received of my surplus. The amount that they say Ill be receiving and the amount of surplus that was on my original contract is different. If the amount of the contract is correct there is a $7000 difference. I should not have to wait over a year for the money they originally said would only take a couple months. Now I have no idea when Ill receive the money per them.Business Response

The property in question sold on 1/31/2022. The property owner had multiple heirs, the complainant was the spouse of the decedent, and the decedent had multiple lineal decedents. The judge in this case did not want to rule without clear authority and case law in the absence of a probate order. *** worked tirelessly behind the scenes to bring this case to an end. The discrepancy in the amounts paid results from subordinate lienholders, parties who were owed money by the decedent, who the judge ordered paid prior to TRA receiving any funds. In ****************** contract it specifically states that: "Assignor understands that Assignee cannot guarantee that it will obtain the Surplus, as other parties may have a superior claim to the Surplus. In the event, Assignee is unable to obtain the Surplus, Assignor will pay nothing to Assignee." In this case both the plaintiff, *********** and the **** ************** **************************** had superior claims to the surplus funds. Luckily, their claims were small and we were still able to receive funds and disburse them to ************** and the decedents lineal decedents. ************** has been paid in full and provided with a complete accounting of the courts ruling and TRA's fees.Initial Complaint

I was entitled to a surplus payment from the sell of my great aunts home in the amount of $56,000. I have completed all necessary paperwork and provided all documentation and the company stated I would receive my funds by 10/20/2022. I have not received my payment and the company is refusing to give me a straight answer about my money and refusing to release it. We had a great relationship vis emails and phone calls prior to time to disburse the money to me and now there are issues. They have stolen the money and I want to speak with the owner of the company. If not I will have to take other actions. The Recovery Agents is a mortgage and HOA foreclosure surplus recovery business. We collect surplus funds on behalf of homeowners and homeowners heirs that have gone through foreclosure and the property has sold for more than what was owed on the property. In this case, the homeowner was the Estate of *******************************, deceased. ******************** represented to us through the attached signed affidavit that he was the sole heir to the estate of ****************. We have now come to understand that there are multiple other entitled parties who may have a superior claim (being direct relatives of ****************) and in fact ******************** may not be entitled any of the surplus funds. We are going to be working the case back through the court system, Pinellas County case 19-007028-CI in order to ensure appropriate distribution of the funds. ******************** and his significant other were made aware of that fact multiple times including on 10/24 and 10/28 at which point we let him know we would not be able to disburse the funds at this time. While this is an unfortunate situation, ******************** was not truthful into his relationship with the estate and that has caused the issue. This agency was used to recover an inheritance I was entitled to and when I finally got my deposit information they tacked in various hidden fees that were never disclosed or discussed with me. They attached a service agreement and charged me 12% consulting fees and 12% based off the full payout because they sent me $2,000 in cash advances. When I called to get a better understanding of why all these hidden fees, they said it was in the service agreement. Its not clear in the agreement their fees and they also told me they wouldnt be able to give a payout amount until they received the check from the ****** county Clerk. I was able to find out the check amount from the court directly, so I believe they were trying to hide that information in order to take their outrageous fees. Im very upset as this was inheritance from my father passing away last year. They literally took half of my check.Business Response
