    Residential Construction project, home, which ******* A. *********, Gulf Home Builders, LLC, CRC132730, has under construction as the primary contractor. The residential construction is behind on timeline for completion. The construction agreement between owner and builder states contractor anticipated completion of work to the subject property estimated timeframe of June 21, 2024. There has been no substantive work performed toward completing the residential construction since the last inspection dated 07/03/2024, resulting in a standstill of the residential construction for 180+ days. The residential construction is not built within contract budget/ cost breakdown per contract. Project is on draw schedule, the draw requests submitted did not accurately represent the estimated costs of work performed or services provided as outlined in the estimate contained within the contract between owner and builder nor did draw requests match the actual work performed. The residential construction is not built according to plans. Plans included in the contract between owner and builder states residential construction of house and garage with garage level at -7 of finished floor level; house finish floor level of 0.0. There is a discrepancy in the design that has caused issues with the construction process therefore, the garage is below finish floor level greater than -7. As a result the build does not match the plans agreed upon by owner and builder. At current construction stage the garage is a different height than intended and this is affecting the overall appearance and functionality of the house. Builder let builders risk insurance expire. Builder locked owner out of house without notice.

    I'm responding to case #********

    My name is ******* ********* of Gulf Home Builders. I'm currently the contractor for **** & *** *******. We are at a standstill due to non-payment. Here are my responses to their complaint

    We lost 6 months in the building department due to hurricane ***. **************** was only working on new construction one day a week for roughly 8 months. We have currently lost an additional 4 months due to non-payment. 

    When we bid the job, it was based on current pricing at the time. After the storm prices kept climbing and climbing. Their contract states that they are responsible for increases. 

    Mr. ******* is upset because he has stairs going into his house. I explained to him multiple times his house elevation is determined by the engineer, not the draftsman. Every house I have built with the new flood elevation has had stairs in ****************

    Their builder's risk expired due to non-payment of their overages.

    I understand they have a budget, but I explained to them I can't finance their house.

    I am rejecting this response because:

    Regarding permits.  Mr. Jankowski is not taking into consideration when our contract was signed; the delay in his response to the bank to secure financing; nor the delay in permitting after financing was secured.

    Mr Jankowski states that the project is at a standstill due to nonpayment.  According to the accounting that Gulf Home Builders provided to Owner all bills are paid in full.

    According to the Draw Requests from our Bank all requested payments from the bank have been made.   Gulf Home Builders has not completed the work needed in order to pass the bank inspection in order to process a new draw request from our bank. Mr. ********* is asking for money outside of the contract.


     Mr. Jankowski failed to maintain the Builders Risk Insurance on our property; t is a specific line item in our contract the builder is responsible for, it is not dependent on any Owner action.

    "I understand they have a budget but explained to them I can't finane their house."   Builder signed a contract with a budget within the contract it is the Builders responsibility to stay within the contracted price.  Builder cannot charge unauthorized overages against the projcet without communication and approval from Owner.  Builder has not had open communication with Owner since the beginning of the project. Builder is asking for monies outside of the contract. Builder has incurred unauthorized overages and costs that Owner was not made aware of in a timely manner and was not asked to approve.  There are no change orders in place.

    Builder submitted plans to **************** that do not include steps.  House is not built to plans.  There are no change orders.  Owner was not notified that the house would have steps.  There is a design flaw Builder refuses to determine where the mistake was made. 

    Owner understands builder may have Financial Hardships and difficult circumstances, but Owner is not responsible for mismanagement of the project. 

    Builder locked owner out of the property, will not provide access code, and has turned off power to the property.  This behavior is unacceptable.  Builder is not taking any action towards having satisfied customers with this project.
