    Sunshine gas was contracted to install a propane tank on my property. They requested a $2100.00 deposit and never did the work. Never returned calls or emails and there office address was an empty office.

    I spent $600.00, receipt attached, to pay for the complete underground **** out location of my water service line and my waste water line; doing so, resulted in a needed third relocation of my Indian River County approved, in ground 500 gallon liquid propane tank, preventing damage to my water and sewer lines. In the event I didnt take this action, Sunshine Gas, LLC would have attempted to install my aforementioned in-ground liquid propane take in line with my water service and sewer line. Sunshine Gas, LLC has refused to meet me halfway, refunding me my requested $300.0 for my $600.00 additional cost; please note, our contract attached does not address the issue of incomplete underground ****-out or the cost associated with same.

    On May 13, 2022, *********************** was given a quote for $5919. This price included a $428 discount because he was originally working with an electrical contractor we do alot of business with and gets special pricing. He ended up not going with that contractor but we still honored that discounted pricing. 

    On June 9, 2022, *********************** requested a total price of $5500 for the job, plus an additional $72 for a small add-on. This was a further $419 discount. Sunshine Gas agreed to this, for a total of $847 total discounted from our normal price for this project. 

    On June 19,2022, *********************** signed our quote (attached), which includes terms and conditions stating "Sunshine Gas, LLC is not responsible for replacing sod, landscape, or underground pipes that might be damaged due to excavation. We will do our best to preserve them". 

    Between October *****, 2022, *********************** and I discussed via the attached email, his additional cost of $600 for having his private lines ****ed. I advised that "******* law says we must call 811, which we have, and each "service" has ****ed their respective responsibilities. Private underground line ****ing would not be included in our scope of work. I put a link at the end of this email to 811's info on this. We do use reasonable care not to damage these private facilities."

    On October 20, 2022, *********************** emailed me to say "I met with ****** today; we discussed several concerns; we both agreed, its in everyones best interest to get the tank installed sooner than later. In the interest of expediting installation, we will absorb all $600.00 of our out of pocket cost for full length sewer and water service **** outs, if Sunshine will absorb additional LP service length, to the generator, due to water and sewer service interference."

    The tank location was revised, due to the ****ing of private lines showing water running underneath our proposed installation area. The tank was then installed on November 16, 2022 without incident. It should be noted, that there were additional water lines running underneath the new tank location that had not been ****ed by either 811 or **************************** private company. These lines were not damaged, despite being un****ed. ************************ then paid for the tank install portion of the project on November 16, 2022, and made the final payment when we returned on November 18, 2022. 

    In the 76 days between *********************** agreeing to cover the $600 cost for private line ****ing and the day he filed the complaint, no further attempt was made by him to discuss the cost again. I was very surprised upon receiving the complaint letter, because I thought the issue was closed on October 20, 2022 when he said "we will absorb all $600.00 of our out of pocket cost for full length sewer and water service **** outs". I feel that an $847 discount to begin with was more than fair.

    Dear Sirs,

    According to ************* Law, Procedure Chapter 556, Underground Facility Damage Prevention and Safety, excavators are fully responsible, not only to dig with caution, but they must mark out underground facilities, prior to excavation. Although Sunshine Gas, LLC. called the Sunshine State One Call of *******, ***** Sunshine Gas, LLC., they refused to reimburse me $600.00 for my out of pocket cost, to have underground facilities fully marked out, in the area of excavation, they, Sunshine Gas, LLC., selected. The unenforceable and illegal disclaimer, that Sunshine Gas, LLC. is not responsible for damaging underground facilities, is in violation of ******* Law Procedure ******* above referenced. The contracted and agreed price for the project, is not in question. Closing complaint ID ********, based on a nonsense reply, from Sunshine Gas, LLC., not addressing their violation to above specified law, is very disappointing. I paid, as Sunshine Gas, LLC. correctly states, thousands of dollars, as per contract, prior to their refusal to properly mark out their proposed excavation site or to reimburse me, for my $600.00 out of pocket costs, trapping me to proceed with this job. It was not until months after the job was completed and paid for, did I learn they were in violation of ******* State Law Procedure *******. Please forward this correspondence to Sunshine Gas, LLC. In the event BBB elects to close this complaint, I will follow up with a small claims action against Sunshine Gas, LLC.. Thanking you in advance for reevaluating this injustice, with the pertinent facts, not irrelevant, nonsensical information.
