      We pay *** **** of ****** yearly but pool still not opened.after living here 20 months now.have been told many times that pool would be open.but never did open,we request partial refund of ****** ****,note pool has been completed for about 6 months now but still get excuses,lies, about opening.

      Hello, and thank you for reaching out.  

      Many factors contributed to the delay in opening the pool, and most had to do with safety and permitting.  

      The pool itself was finished about mid May 2024. It had taken about 18 months to complete. We still couldn’t fill it with water though as the fence had to be installed first, for safety reasons.  Once the fence was installed the pool was filled. We will still needed both the city of Palm Bay to sign off on the C of O for the building and then the county health department to sign off on the pool itself. The city was not that accommodating or that quick. By July 4th we thought we would be able to open it to the residents but that would not be the case. The Developer and the builder(Arch Angle) continued to work with the city on their requirements for the C of O. They insisted on a 2nd egress gate which took time to manufacturer. Then after the gate was installed, they insisted all the locks be raided to 54”(to be to code for a residential pool) That took more time to remove the gates and raise the locks.
      We finally received the C of O from the city last week and were scheduled to have the health department inspection on 10/9 at 9am but Milton has now delayed that, most likely till next week.
      The association is ready to open the pool as soon as we are given permission.
      Any portion of dues that was collected and not spent on the pool is in the operating account.
