I hired this company to survey a lot in dunnelllon FL in oct paying a $750.00 deposit by credit card. They took payment Dec 2nd for the balance of $750 from my credit without my knowledge or approval. When they set the corner pins the left rear corner did not have a pin set. I have made various calls to Kirk concerning this matter but nothing has been done. I can't sell this property, build a fence or clear until I have all corners marked. This is what I paid for.
Also they won't provide a hard copy of the survey or an invoice to back up payment.

    Business Response

    Date: 04/14/2023

    To Whom It May Concern,

Mr. ***** was quoted for a job on October 19, 2022. In the email that included his quote, it specifies that: “All new orders require a payment guarantee to be on file. Also, a 50% deposit is due when placing your order for any job valued at $500 or higher. The remaining balance is processed when the survey is ready to be released.” This refutes Mr. ******s assessment that we “took payment ….without my knowledge or approval.”

On December 2, 2022, the job was complete, so we charged Mr. ******s card for the remaining amount ($750) and we emailed him his survey.

In THAT email, we stated that we needed him to verify the Certified To Parties on his survey and wrote: “Please note: There is a $25 re-certification fee to make changes to the Certified To Parties once the copies have been printed and mailed, so copies don’t go out until I receive verification from you.” With the last part of that sentence highlighted in yellow.  Mr. ***** never replied to that email and, to my knowledge, still hasn’t.

Once he received his survey via email, he called the office and asked that we go out and set the corners, since none of them were located during the initial trip out to do his survey. We, of course, agreed, and sent a crew back out to set the corners, which were set on December 7, 2022.

After this, Mr. ***** called the office saying that he (or his realtor) could only find 3 of the corners that we set and that one of his corners was still not set. Kurt D***, Co-owner, informed Mr. ***** that all the corners were set (why would we set 3 and not 4?) and that we had photos showing that they were set, but even still, we sent a crew back to the property, at no charge, to flag the one corner he said he still couldn’t find. He called back and said that his realtor went out and could not find the flag and that he, himself, was too far away to look.

At this point, he was told that we would have to charge him to go back again and he got angry and hung up and then he filed a credit card dispute for the final payment of $750, falsely claiming that he had no knowledge of the payment and that he did not approve the payment. When Kurt D*** called about the dispute, he told Mr. ***** that we can send a crew back out to show him the corner, but if it was there, we would have to charge him for the trip, he said “I’m not paying ****, I’ll just let my lawyer handle this” and he hung up.

(As of the date of this writing, the credit card company saw the evidence and has returned the $750 to us).

Mr. ***** also claimed that we “refused” to send him an invoice, but Mr. ***** never once asked for an invoice until he needed an excuse to dispute his credit card charge. We would have happily sent him an invoice at any point in this project, as we do with all our clients.

Mr. ***** also claims that he “can’t sell this property, build a fence or clear until I have all corners marked”, which is all incorrect. Even though all of his corners ARE there, corners do not stop anyone from selling, installing a fence, or clearing. He is free to do any and all of these things.

At this point, until and unless Mr. ***** agrees to stop trying to steal money from us by disputing his credit card charges, we will not do anything else for him. Once he agrees to this, we will send him his invoice and his hard copies (once he tells us where he wants us to send them that is).
