I hired 30a landscaping LLC to do maintenance yard work on my house in Florida. I hired them to do landscaping and tree removal and then they also offered maintenance services. I do not live in Florida so I was not aware they were not maintaining my property as agreed. They listed a scope of services I know never happened, they charged a finance charge (it was being deducted from a checking account) raised their prices with no notice . They were just charging my credit card monthly but not providing the services. I have photos to prove my claim. I have contacted my bank to dispute the charges . Recently there was another issue with the back flow preventer they installed in December . I asked them if I can have a copy of the receipt of this part so I can contact the company to see if there is a warranty on it . The owner refused to provide it . He told me it’s my problem now and things break and to look for the serial number . I would need a receipt of when this was purchased etc . I had to pay more money to repair it on top of the money they charged me for services that never happen . I had tried to come to a settlement earlier but to no avail. I was then accused of harassment for asking for a receipt. Please note they has been reaching out to me prior about the charges I was disputing. This is all very unprofessional. I should not be charged for services that never happened. If I have paid for something I should be able get the receipt for it to see if it’s under warranty. They are claiming I disputed the amount for the larger invoice therefore I have no claim against this part which is completely untrue. I have stated this repeatedly. I was not disputing the landscaping bill. But I should now as there was an issue . I have included some pictures and texts . They said in writing their service covers 38 times a year and then said it’s not a binding contract . There is no way they did the work. I had a renter and she never saw anyone.

We have discussed everything that you’ve brought up.  Right away, we sent a log to you of the service dates at your home. You disagreed with us. Your renter works and isn’t usually there when we get there.  You live in a heavily forested area that requires a lot more leaf attention than the two weeks per month that we went there. Our agreement is 26 trips a year, not 38. The invoices state that. We clearly notify every customer that we charge a fee for card payments. And we notified all of our customers of our recent price increase. That’s the only increase we’ve had in 20 years.  We  did not install your backflow preventer.  The broken backflow was brought to our attention 2 months after we stopped workIng for you.
We’ve disagreed on every point.  We asked what you wanted from us and didn’t get an answer. Although, we kept getting more and more emails.  So we asked to stop being harassed.
I wish this had worked out differently.

I am rejecting this response because: you did not come 26 times in 13 months by your own records . You did not come every two weeks by your own records . You did not come the last three months as the branches and the piles of leaves continued to accumulate in the same place seen in the pictures. . You told me you installed the back flow preventer last week and refused to give me the information I needed to check on the warranty  . I tried to work something out months ago but you refused. I have not been reaching out and harassing you. I was responding to your emails!

    Unbelievable.

    Sincerely,

    Business Response

We are doing the best we can. We’re supporting our families which amounts to a lot of people. It is only in our interest to maintain and build our business.

Weather and other circumstances makes it impossible to come on the same day each two weeks. I’m not sure what the dates are that you’re referring to that we weren’t there an average of every other week. Just show me, that’s all I’m saying.

To verify a warranty of any part, you will need to take the serial number from the part itself and show the manufacturer or any distributor. Your current service provider can do that.

I am rejecting this response because:

I understand and I have a family to support as well. I just can’t afford to pay for services that did not happen. You sent me a breakdown but I had to ask more than once and you were not going to send it. The breakdown does not account for 26 times in a 12 month period . If you can’t come due to weather or other circumstances I understand but you should not charge me. That’s not fair. You did not come all on some of the times that you noted on what you sent and some of the dates don’t match up. I asked for the contact information of the company and/or the distributor to see if there is a warranty  and you would not provide it.  It’s in our emails this request .  I had to pay to repair this part and its brand new. You then  accuse me of harassing you. You reached out to me recently and I followed up to see if you want to work out something fair . I don’t want to pay for services that never happened. I never received any letter stating your price  increase or processing fees . No other vender I work with charges this fee to process a payment from my checking account .. You communicate by email and there is no email from you about this  . The only way I received the invoices is because I asked for them  . I asked towards the end of last year because I needed these invoices for my taxes. When I looked at the invoices and the scope of services there are things that could not or did not happen.  I don’t live in Florida so I did not know until I got there at the end of last year how bad it was . How is this right?

    Sincerely,
