    On April 16, 2024 I contracted Adams Seawall Repair to repair a soil erosion problem at my seawall.They stated that they would inject Terra-Loc Geo-Technical Hydrophobic Polyurethane Resin every two feet along the 40' area as designated. This repair came with a 30 year warranty. Stated in the contract was a statement that if any adjustment was required, that I would have to pay them $980 plus the cost of any material that exceeds a 5 gal. jug of material that they would bring.I noticed in early April that the soil was eroding at the same place they said they injected the foam. I don't know how long this was eroding after the repair because I only noticed it in early April. This is less than a year from when they repaired it. This is unacceptable. I paid them $4000 for the repair and it didn't even last a year. I have called the company and left messages for ****** to call me back on several occasions. He will not call me back, he will only communicate through email or text. He wants me to give him $980 before he will even send somebody out to look at the problem. I have never heard of such business practices! I am not willing to pay him $980 up front for a repair that cost $4000 and didn't even last a year. I guess he expects that a person should pay him nearly $1000 every year that he did not fix the erosion problem. This sounds like shady practices to me. I would like him to repair the seawall right without a fee of $980. I am eighty years old and on a fixed income I cannot afford to be taken advantage of like this.

    To whom this concerns, 

    Mr. Johnson admits he signed and agreed to a contract which clearly stated that any additional work would require a $980 deductible. We never asked for the deductible to be paid prior to us looking at his yard. He said he had a soft spot and wanted more material pumped.

    We offer a warranty, not a guarantee. The scope of work performed may require an additional "top off" of material due to the nature of the process and how the material acts. It was never conveyed to Mr. Johnson verbally or in writing this process was a one and done situation. However I would like to point out that in the history of this company and hundreds of completed projects, we have only performed two warranty requests.

    I would also like to point out that per the contract, the warranty is actually void due to the two hurricanes that took place after our work (which is very likely the cause of the changes in his soil). However, we were still going to honor the warranty deductible because we did have sympathy for Mr. Johnson's situation. 

    Mr. Johnson has berated the ladies in our office and has posted false Google reviews. This is why we will only communicate with Mr. Johnson via email, so we can have records. We have spoken to council regarding his defamation and the decision is pending if we proceed. 

    The desired settlement is rejected and the offer to provide a warranty service is reversed. Warranty is void per the contract.

    I am rejecting this response because:

    The contract clearly states “This guarantee applies to the injection locations “ contrary to what Mr Adams stated that it was not a guarantee.See attachment.

    Also, see other attachment with a photo of Mr. Adam’s email which clearly states that I send $980 and when payment clears he will send somebody out to assess repair.

    mr. Adams is not telling the whole truth in his response.

    Being a man of my word I assumed Mr. Adams was too when I asked him a couple of times “ if this was a 30 year warranty, right?” He said “yes”

    At this point, I would prefer him to refund my money and I will find someone else to do the job.

    ps…I tried to attach 2 files, one was photo of the guarantee as stated in the contract. The other was a photo of the email stating that I needed to send him money before he would come out.

    I am rejecting this response because: Adams Seawall "Warranty" is not a good warranty/guarantee (see Attachment) because it leaves them an out for honoring the warranty for almost every possible occurrence, i.e. storms, dry soil, drought, soil shrinkage, etc. etc. Also stated in the contract is the following statement: "Customer agrees that there are no warranties, express or implied, made by Adams Seawall Repair concerning the work contemplated by this agreement."

    The two attachments are proof that Mr. Adams was not telling the whole truth in his last reply. One is a copy of the term "guarantee" in the agreement and the other is a copy of the email from Mr. Adams stating that I send him $980, and when that payment clears he will come out to my house. I have never dealt with such business practices as that. 

    You may close this complaint as "Settled Unsatisfactorily" or "Not Settled", whatever terms BBB uses,  so that future customers may read it. I would caution all future customers to read every word in the agreement before they contract Adams Seawall Repair to do work for them. If they read the agreement, they will see that it really is not much of a warranty at all. It leaves Adams Seawall Repair almost every opportunity to NOT honor the warranty. In my opinion, they do not use good business practices.
