    I am rejecting this response because:  Although they have terminated services, the complaints were made prior to those dates and in fact in 2024 as well.  The *** / ***** associates failed to act on the problems that were raised.  This is a violation of their duties.

    Dear Better Business Bureau,
    We are writing in response to the complaint filed by Soma ******* regarding the management of plumbing issues at School Avenue Townhomes Association, **** We appreciate the opportunity to address these concerns and provide clarification on the matter.
    Background:
    **************************** (d.b.a. **********************) was contracted to manage the School Avenue Townhomes Association, **** under an Association Management Agreement dated January 28, 2019. Our responsibilities included maintaining the property and addressing maintenance issues promptly.
    Termination of Contract:
    On April 9, 2025, we formally terminated our management contract with School Avenue Townhomes Association, **** due to significant breaches of the agreement by the Association 
    These breaches included:

    Failure to Maintain Insurance:
    The Association failed to maintain the required insurance coverages, including *************************************** Directors' and *************************************************************** Umbrella or *************************** Fidelity Bond, and Crime Policy 
    This failure constituted a breach of the agreement and allowed us to terminate the contract immediately as per Section 10(e) of the agreement 
    Insufficient Operating Funds:
    The Association lacked the necessary operating funds to sustain its operations, which persisted for a period of ten days after notice. Not enough funds to properly maintain the Association.
    This deficiency also allowed us to terminate the contract immediately as per Section 10(d) of the agreement 

    Developer's Non-Responsiveness:
    Additionally, it is important to note that the developer of School Avenue Townhomes Association, **** was non-responsive to our repeated attempts to address these issues. Despite our efforts to resolve the situation and ensure proper management of the property, the developer's lack of cooperation made it impossible for us to fulfill our contractual obligations effectively.
    Conclusion:
    We understand the frustration and inconvenience experienced by the unit owners due to the unresolved plumbing issues. However, the termination of our contract was necessitated by the Association's breaches and the developer's non-responsiveness. We regret any inconvenience caused and hope that the Association and the developer will take the necessary steps to address the outstanding issues promptly.
