    I am rejecting this response because: The company never told us that the tree had to be removed, only that the fence had to be cleared which it was. They should have never started the job if they weren't going to be able to finish it before the tree was removed. I should have been told to remove the tree when they quoted it. The company **** me the $250 that they extorted from me to finish the job.

    Our company dealt with a property management company and when we made our initial visit we explained that the property needed to be cleaned and cleared before we could do the work and our original signed contract states "Fence line to be clear of any debris and cleaned before fence installation." (See "Signed Contract #*****). In the attached "2024-11-18 Email from ******************* & Notice to Owner" the property management company even states in their email that the property needed to be cleared beforehand. When we work with someone other than the homeowner we file a "Notice To Owner", this is the letter that the consumer is speaking of (attached), it is simply a notice to protect our company and the consumer. On 11/20/24 the property management company stated that the property was cleaned and ready for the work. Our installer went out to complete the work and there was an uprooted tree that had not been cleared so that installer was unable to complete the entire job on the first trip. The property management was made aware that there would be a additional charge of $250.00 for a return trip charge to set up to install the back fence area, this fee was originally $350.00 but we agreed to discount the fee and only charge $250.00 (See "Signed Change Order #*****). The consumer should have cleared the uprooted tree prior to our company going out the first time to install the fence and there would not have been an additional trip & set-up fee for a second day/trip for completing the installation where the uprooted tree was located.

    The "Signed Contract #*****" (attached) clearly states "By others: Permitting, engineering, "tree" and brush removal, land clearing and grading, locating privately owned utilities." The tree was not removed prior to our first installation date, therefore, there was an additional trip charge to set up and install back fence area after the tree was removed.

    I am rejecting this response because: The business did not tell me the tree had to be removed. If it needed to be removed then they should have never started the job. They stole $250 from me!
