    ProVest LLC (ProVest) has reviewed the complaint filed by *************************** ("********************") with the Better Business Bureau relating to communication activities conducted by ProVest. ProVest, along with its wholly-owned subsidiary, ProVest Services LLC,provides service of legal process and related services, including identify verification and investigative services. ProVest takes great care to ensure that its employees follow all applicable laws and company policies and procedures as they pertain to its services, and any and all communications with consumers.  ProVest was retained by plaintiffs counsel to provide investigative services in order to attempt to identify, locate and serve process on any surviving heirs and/or any persons who may have an interest in real property of a deceased defendant named in a foreclosure action entitled **** of America, N.A. v. ***************************, et **** ***** No.EF0000612023 pending in the Supreme Court of the State of ******** for the County of Orange.  The results of ProVests investigation found that ******************** was listed as the appointed Guardian for *********************, the sister of ******************************, a possible heir.  ProVests contact with ******************* was for the sole purpose to confirm his identity so that it would allow ********************, as Guardian for ************, to properly appear in, and respond to, the foreclosure action.

    ProVest is not a law firm, does not practice law, nor does it collect debts on behalf of its clients. Further, ProVest has absolutely no vested interest in the aforementioned foreclosure action and its contact with ******************** was in no way to collect any payment or harass any surviving heirs but, rather, to ensure that a diligent effort was made to locate them in order for plaintiffs counsel to serve legal process upon them as defendants in the foreclosure action.  This practice is in accordance with, and pursuant to all relevant statutes and rules of court which require that diligent efforts be made when locating a defendant for service of process in a civil action.

    ProVest takes all complaints very seriously and strives to create a pleasant experience in all interactions it has with consumers during its efforts to locate persons who may have a legal interest in a legal action.

    ******************* ************** falsified court documents claiming he was the server for my lawsuit papers. When initially contacted, he said he was not blue to serve the papers and it should be unserved. My bank account was garnished because I did not know about the lawsuit.

    ProVest LLC has reviewed the complaint filed by ******************* (************) with the Better Business Bureau relating to service of process activities conducted by or on behalf of ProVest.  ProVest, along with its wholly-owned subsidiary ProVest ********** Services LLC, provides certain legal support services,including the management of service of process in civil proceedings.  In this instance, ProVest was engaged by plaintiffs counsel in a civil lawsuit pending in the General Sessions Court for the County of ******, ****************** for the sole purpose of effectuating service of process of a Civil Warrant upon ************, as she is the named defendant in such action.  ProVest has no vested interest in the aforementioned lawsuit and takes great care to ensure that its employees and independent contractors follow all applicable laws and company policies and procedures as they pertain to its service of process activities. 

    In her complaint against ProVest, ************ is alleging the process server falsified court documents claiming he was the server for my lawsuit papers.  In fact, the process server, ***************************,was the process server who effectuated service upon ************ on January 23,2021 at 3:28PM and filed his record of service with the Wilson County, ********* General Sessions Court.  ************ also alleges in her Complaint that When initially contacted, he said he was not blue[sic] to serve the papers and it should be unserved.  In response to this allegation, ProVest was informed by ******************** that ************ telephoned him on May 25, 2023 and during his call with her, ************ accused him of not serving her with legal documents.  ******************** informed ProVest that he told ************ he did serve her", that it would be illegal to falsify my documents, and my document regarding service was filed with the court.   ******************** further informed ProVest that *********** continued to question him during her call with him, specifically asking ******************* if he had any proof of his service. ******************** relayed to ProVest that he informed ************ that I took a GPS photo at the time I served you to document the date and time I did.  ******************** also informed ProVest that *********** replied stating she may have forgotten that she was served.

    It is important to note that ProVest is not a law firm, does not practice law, and does not seek to claim payment or collect debts on behalf of its clients.  Again, ProVest does not have any vested interest in ************** civil action.  Therefore, ************* desired outcome requesting that ProVest make a correction to a credit report is not feasible since ProVest is not a debt collector and does not report to any credit agencies.   The service of legal documentation upon *********** with regard to her Wilson County, ********* General Sessions Court civil matter was to provide ************ with the opportunity to properly appear in, and respond to, the civil action filed against her by the plaintiff in such matter.

    ProVest takes all complaints very seriously and strives to create a pleasant experience in all interactions it has and its independent contractors may have during any efforts to serve persons who may have a legal interest in a civil action.  Therefore, all efforts by ProVest and its independent contractor to serve legal process in the above-referenced civil action was in accordance with, and pursuant to, Tennessees statutes and rules of court.
