      Albertelli Law is currently holding $51,090.65 in excess proceeds as a result of a mortgage foreclosure tied to a property at *******************************************. I am entitled to these funds and they have refused to release them to me. I have been pursuing the funds for the last 2 years. They refuse to answer my calls or respond to my ******************

      We dispute the complaint and submit the following to provide a ****** understanding of the circumstances and our interactions with the Complainant. 

      Albertelli Law is a law firm that, in part, represents lenders and mortgage servicers in multiple jurisdictions across ******************  The Complainant, *******************************, is not a client nor a direct consumer of the Firms services. The complaint appears to stem from a non-judicial foreclosure that the Firm handled for one of its clients.  The Firm completed a foreclosure on a property then owned by a relative of *******************************, a ***********************. ******************************* was not a party to, nor was involved in the underlying foreclosure proceedings.  After the foreclosure sale and distribution of proceeds to lienholders, there remained a surplus of funds that would be paid to the former property owner.  Before the Firm could distribute the funds to ***********************, he unfortunately passed away.  No probate has been opened that established who are his heirs nor who is entitled to the surplus funds.  The surplus funds have been securely held pending such determination.  During such time, ******************************* requested the total amount of the funds from the Firm.  However, when the requests were made no documentation was provided that shows ******************************* is the person solely entitled to the full amount of surplus. A full distribution to ******************************* prior to establishing who is entitled to the funds could deprive those who are otherwise legally entitled to the funds.  In fact, doing as the complainant requests could open the Firm up to claims from the other heirs. ******************************* eventually submitted an affidavit of heirship for *********************** listing himself, a brother and a sister who is deceased. Under Texas law, the heirs of the deceased sister are entitled to her distribution of *********************** estate. At this time, the Firm is unaware of who the heirs are of the deceased sister as no probate was opened on her estate and no affidavit of heirship has been provided.  The Firm has a duty to ensure that the funds are properly and prudently held and distributed.  Upon the determination of who is entitled to the funds, the Firm will fulfill its obligation to distribute the funds to the heirs.

      As such, the Firm disputes the complaint as 1) ******************************* is not a client, a consumer of our services, nor has had any business dealings with our Firm, and 2) the Firms retention and safeguarding of the funds has been appropriate as it has not been established who is entitled to the funds.  We thank you for your time and attention to our response.

      On November 7, 2023, I received a debt collection notice from Albertelli Law requesting that I respond to the notice. On November 7, 2023, I responded to the notice by paying the amount requested on the notice.On December 1, 2023, I received a ***** package from Albertelli Law with a refunded check for the exact amount I sent. The check that was sent back was dated November 8, 2023. Along with the check was a notice dated November 30, 2023, stating that the amount sent was not the correct amount owed and that the eviction would proceed.On December 1, 2023, I called the number listed on the notice that was sent on November 30, 2023, and the number was disconnected. I also called the number listed on the notice received on November 7, 2023, and was told that was not the correct number as it was for foreclosures. The lady on the phone gave me the number for the evictions.On December 4, 2023, I received an email from Albertelli Law stating that a response to my questions that I sent to the landlord would be responded to.On December 6, 2023, I emailed the attorney to let them know I was still awaiting a response.On December 7, I left voicemails for the attorney at the office and on the cell number listed in the previous email. I finally received a call back and the attorney stated they were filing a writ of possession. I then received an email with the same information. I responded that I had not received an answer to my questions.As of today December 8, 2023, the attorney still has not given me the requested information.
