Received a certified mail piece from company stating my deceased father signed a contract for solar installation. This did not happen. He was in hospice care the last several months of his life and could not have signed any paperwork. This is the first communication we have received from this company as I follow all his phone calls and emails personally. Florida Electric and Solar is extremely sorry for the loss of Mr. ********* We agree that threatening legal action to a grieving family is unreasonable. However, we do hold a contract for a solar installation signed by Mr. ******** on January 23, 2025. In addition to this, there is also a signed Solar Lease Agreement with our financing partners, Palmetto Solar. We continuously attempted to contact the phone number we have on file with no connection to Mr. ******** or anyone keeping up with his phone calls. The letter received was in no way a threat, just a final notice and an attempt to keep the project moving forward.
Once again, we are extremely sorry for your loss and we apologize for the notice received. Had we been aware of his passing, you would not have been contacted in such a way. We will cancel this project and forgive any debts associated, as this is not something you should have to deal with during this difficult time.

I contracted Florida Electric and Solar install 65 solar panels on my home in the Fall of 2023. The install occurred in February of 2024, due to extended delays from company, then installers placed panels in wrong areas, which caused the drawing needing to be updated before passing inspection after failing. Within 12 months, I had an issue with solar units not generating. I scheduled the company to come out, they replaced a fuse. Not 2 weeks later, the fuse blew again. I called and reported this to their service representative. I waited a week and reached out again, to which I was told they were ordering parts. It took over 3 months to have then come out with the part and install a new connection box. During that time, I text and showed the representative that there were connect boxes for sale all over the internet. During this whole procedure, I asked about my electric bills being reimbursed, to which I was under the impression they would. I continued to send bills. Finally after a total of 5 months of being down and accruing 5 months of Electric bills along with the Solar loan charged for the install and product, being paid at the same time, I was informed that the company wanted to offer me $500 instead of the $1222.67 it cost me for my electric bills during that time. I still continued to pay the solar loan of $332.69/month which would have been over $1600. To this date, I have received nothing from them.Business Response

I am rejecting this response because:I am writing in response to Florida Electric and Solars (FE&S) reply to my complaint regarding their defective installation of my solar system and their continued refusal to honor the 10-year workmanship warranty. Their response misrepresents the extent of the defects and fails to address their contractual obligation to provide a defect-free installation.
Rebuttal of FE&Ss Claims: FE&S acknowledges that there were at least two leaks caused by their improper installation but attempts to minimize the scope of the issue. Their response omits key facts that demonstrate a systemic installation failure:
- Independent Inspection Confirmed Defective *****************
- On November 13, 2024, after FE&S removed only eight of the total 39 panels, Cardinal Roofing confirmed that 46% of the flashings under those panels were installed *****************
- These defects violate the approved installation plans, the UNIRAC FlashKit Pro installation guidelines, and Florida Building Code Section 1507.2.8, which mandates adherence to manufacturer ********************
- The Extent of Defects Remains ************
- Since nearly half of the inspected flashings were improperly installed, it is reasonable to assume that similar defects exist under the remaining 31 ************
- FE&S has refused to remove these additional panels to assess the full extent of the defective installation, despite strong evidence of a widespread ***********
- FE&Ss Justification for Not Correcting the Defects is ************
- FE&S claims that some flashings could not be installed per the manufacturers instructions due to existing nails in the shingles. This is not a valid excuse, as a professional installer should have ensured compliance without compromising installation *************
- FE&S now argues that removing and reinstalling the flashings could cause additional roof damage. However, this only underscores the severity of their initial improper installation and why they must now take corrective ************
- FE&S Has Acted Unprofessionally by Refusing to Accept a Certified Notice of ************
- On January 18, 2025, FE&S refused to accept a certified package containing a formal notice outlining the recommended way forward to resolve the ***********
- This refusal is not only unprofessional but obstructs the resolution process, demonstrating their unwillingness to engage in good faith efforts to correct their defective **********
FE&Ss Warranty Obligation and Required Resolution: FE&S provided a 10-year workmanship warranty, guaranteeing defect-free installation. Since they failed to install the flashings correctly and did not follow approved plans or manufacturer specifications, their work is defective, and they must correct it at no cost to me.
To fully resolve this matter, FE&S must take the following actions under their warranty obligations:
- Remove the remaining 31 panels to determine the full extent of the defective ******************
- For all incorrectly installed flashings, FE&S must remove the solar system and ensure the affected portions of the roof are properly repaired and **************
- Once the roof is restored, FE&S must reinstall the solar system in full compliance with UNIRAC FlashKit Pro installation guidelines and the *******************-approved ***********
- All corrective work must be performed at no cost to me, as required by their workmanship **************
Conclusion: The discovery that 46% of flashings were defective under the first eight panels is strong evidence that additional defects exist under the remaining panels. FE&Ss attempt to limit repairs to only the visibly leaking areas is unacceptable because leaks are a symptom of improper installation, not the full measure of the problem.
Until FE&S properly investigates and corrects their defective installation, I remain at risk of future leaks and additional roof damage. Their continued refusal to acknowledge the full extent of the defects, their unwillingness to engage in a comprehensive resolution, and their unprofessional refusal to even accept formal notice of defects have caused me significant financial and personal stress, including:
- Out-of-pocket expenses for solar panel removal and independent ****************
- Roof repairs due to water damage from defective ***************
- Loss of solar production, costing approximately $150 since November 2024.
- Anxiety and uncertainty over potential future leaks and additional damage to my **********
I respectfully request that the Better Business Bureau intervene to hold FE&S accountable for fulfilling their warranty obligations. If FE&S continues to refuse to properly address this matter, I will have no choice but to pursue further legal action.

"We have addressed the concerns and provided solutions to the issues you raised.
1) flashkits not under entire shingle- the solar passed local building department structural building inspection. Our engineer approved the. Flash kits as they are installed. Construction routinely requires field adjustment and accepted means and Methods to bridge the gap between what is feasible in the field for installation as to what manufactures installation guidlines are. We do not live in a perfect world. We have also verified as have you that the flashkits in question are not leaking.
It would create significant risk to attempt to move them as the shingles are less maluable and more so we do not want to remove fasteners and expose open holes in your roof.
2) FES will assume responsibility for the 2 leaks and we have provided a detailed response on course of action for repair.
We are honoring the warranty to address the roof leak.
3) we have worked thoroughly with you, we have been on site several times, I have met with you in our office and we have discussed this issue in depth. We have maintained a good faith , positive attitude towards seeking reasonable resolution to your concerns.
4) please reflect on our fair do the right thing approach to resolve this matter.
We can make the roof repaired immediately and I will continue to uphold our workmanship warranty to you.

I will not pay for an entirely new roof because thats what you want.
The leak occurred by missing a pilot hike and not putting a fastener in it in two locations.
This is not a result of the flashing failing. This was human error.
The building department approved the installing by inspecting the flashings and they signed off on the installation method.
I have also ensured your warranty would be upheld.
I have provided a resolution to every item.
I would appreciate if we could resolve the matter in a reasonable agreement.
What I am unwilling to do is provide unreasonable

I am rejecting this response because you have not addressed the issue. Attached is a copy of the notice of violation sent to Florida Electric and Solar notifying you that FE&S is in violation of code for failing to install the solar system in accordance with approved construction documents. As such FE&S failed to install the flashings correctly and thereby constitutes a defective installation. The warranty contained in our contract guarantees installation workmanship will be free of defects for 10 years. The code violation specifically proves the system was not installed correctly, i.e. with the approved plans. Therefore I want FE&S to honor the warranty by removing the incorrectly installed solar system and taking it off my property, pay Cardinal Roofing to remove and replace that section of the roof where the solar system was located and then F&ES to reinstall the solar system correctly, all at no cost to me. In return I will not ask for the $1,000 I paid to have the 8 panels removed, the $1200 cost to have Cardinal Roofing to repair the leaks, the unknown cost of repairing the Lanai ceiling damaged by the leaks, and the loss of solar production since you removed the first 8 panels. I have talked to my lawyer and he and I feel that this is a fair and equitable resolution. As I have said many times please give me a call so we can resolve this issue. Thanks in advance. This statement is not correct. We have installed the system correctly and had to adjust due to field fitment issues. Our engineer signed off on this as did the city inspector.
The flashings are not leaking. What caused the leak was a missed s**** in an attachment for a pilot hole we drilled.
This is only applicable to 1 leak location. We have offered reasonable assistance and support to correct the issue.
Davids roof warranty is in tact! We will repair the leak caused by the missed s**** in the drilled pilot hole.
Again, ****** solar warranty is in good standing. There was no production or performance issue related to Davids solar system.

******* *******ealing was completed Jan 6th, but still waiting for city to inspect.- FE&S sent a window company to quote windows on Jan 5 and after they went SILENT.- Text thread with Owner, CCO, project Manager and many others started before A/C work about projects in efforts to get windows, ecostella and other things moving. Lots of misleading info and promises for the projects. - After A/C was installed FE&S went silent again. With multiple attempts to call, email and text.- Threated legal last week and they finally emailed back stating windows were never in contract so said cost is around $28,000 but will only make me pay around $13,000. - I responded that I wanted what was originally offered (13 windows) and NO out of pocket. - They responded that Owner agreed to the deal and they would re-quote windows and get the project moving (along with *********). *********************ow been receiving electric bills even higher than normal. - I have asked that they assess me system and have someone come out to check the system...They vanished and not returning calls - I was supplied an "APP" called **************** which has shown from the date of installation a "Net Export" positive, yet it does not align to my electric bills which are the same as they always were. Now I am paying for both electric and a solar loan. This app I believe this "App" has shifted it algorithm to falsify the readings. - The App supplied by Florida Electric and Solar I believe is set to make one think their system is working correctly and used as a leveraging tool for this company to point at Duke or other companies as the issues when it is their fault. This company lied to me. They set up my system which has failed to perform at the level promised and promoted. While FES may claim in this complaint that my system is producing what was promised.FES promised in writing that my system was properly sized for my actual consumption. IT IS FAR FROM THIS REQUIREMENT.
They promised that they had probably assessed my consumption and that the solar system they were installing was going to cover 112% of my overall needs. The solar system they installed has only been able to meet 35% of my consumption.
FES promised that my new electric bill would only be $35 dollars per month as a Duke connection fee.
THIS TOO WAS A COMPLETE LIE AND MY BILLS CONTINUE TO EXCEED $300 plus per month.
All and all FES lied and provided a false claim. They made promises which as far from reality .
rhey did reach out to me and make a claim that they would solve it. But that I needed to buy more pancakes from them and spend another $30,000.
So they want me to spend another $30,000 to make up for their mistakes.
The only resolution I am willing to except is total payoff of my current system. At this point it seems I need to take the next step and file a complaint with
********.gov and continue to outline my case as FES in my view committed complete fraud.

Upon further investigation, your system was actually not miscalculated by our sales representative.
The issue is actually that your consumption is more than it was the prior year.
If you look at the screenshots of your total 12 month production, your system produced ****** kWh over the last 12 months. Your agreement and proposal both say we are estimated to produce ****** kWh.
This means your system is actually producing more than we had sold you on.
The reason why your bill is higher than just your customer charge, is because you are using significantly more energy than you did last year.
We cannot control or be held responsible for the amount of electricity our customers consume. We can only be held responsible for the amount of electricity that your solar panels produce.
We accurately sized your system based on the kWh you provided to us via your utility bill at the time of sale. It is very clear on both the contract and sales proposal what your system is expected to produce.
Your system is producing more than what was anticipated, so it is unfair to be making claims that we did not deliver what is on your contract or sales proposal.
We are happy to offer you a significant discount on additional panels to cover your new utility consumption.
We always do our best to make our customers happy any way that we can and would love to work towards a solution to meet your new demand for electricity, but upon further review, it is clear we have successfully fulfilled our contractual obligation.

I am rejecting this response because:This business continues to spin this to their favor without settlement.
the over all claim goes back to their claim that 112% of my energy needs would be met and that I would only be paying a $35 per month connection fee to Duke.
It was clearly communicated to FES before any contracts were signed or agreements weee made that it would not be accurate if they only use the history from Duke to assess my power needs.
the home had been vacant so to a foreclosed for nearly 8 months which it was clearly communicated that this would happen.I supplied bills and history showing that my energy demands were much higher.
FES assured me that they took this into consideration and that they even needed to reduce my system size because it exceeded my energy demands by so much.FES assured me they had taken all energy demands into consideration and that the number and need for the panel production would meet my demands.
THIS IS FAR FROM THE TRUTH!
FESs system design only meets 35~38% of my overall energy demand. AgainFES assured me that they had taken all factors into consideration when installing my system.
The current production level FES continues to state as sufficient is a result of a COMPLETE LIE and failure on their part. They did everything possible to simply rip me off and gain a sale.
To dateI still have $400 per month electric bills as well as a solar system payment.
I have submitted two settlement solutions to FES and they have refused both and only stated that their solution is to buy my panels from them at another $20,000 out of my pocket
My offers where to either:
- install enough panels to meet my energy demands
- Refund me for all expenses at a rate of 65% of the overall cost since the system is at least producing 35%
AgainFES refused both of these.
in Addition the owned ***** has threatened my with a defamation of character lawsuit for writing bad reviews and filing this BBB claim.
All and all, FES continues to argue a completely invalid point to spin this.
That made all the mistakes here and led me to believe they had completely done their due diligence to meet my energy needs. By believing then, we are here today. Otherwise I would have never bought from them.
