date of transaction: April 30, *************************************************************** ***** and repair of all damage done by raccoon and enclose area so no further wildlife could access our attic. When he enclosed the area he did so that rain water could not exit the enclosed area. In so doing it resulted in damage to some of our interior walls and ceiling. When this was discovered he did come back and remove one of the enclosures so the water could drain. He did tell us that what he did resulted in the damage to the interior walls and ceiling and that we had a 2 year warranty and we shouldn't have to pay anything. He filed a claim with his insurance company and the insurance company failed to honor the claim. We tried to contact this company and he has not returned any of our text messages. We have gotten the repair work done at a cost of $500 and asked him for reimbursement and have not heard anything back.

We are requesting a refund of $500.  That was the cost of the repair.

Upon initial inspection of the ******** residents on April 30th, 2024, they made me aware of what they at the time thought was a possible leak in the front cloest area of their home. Above that area on the outside is where damaged soffit was located from the female raccoon and her young that had made residence in their attic. They made me aware that the fire department as well had been out the day prior to attempt to scare the raccoon out from under their solar panels. After my inspection, I drafted them a quote for the eviction of a sow (female) raccoon from their attic space, and the closing off of the entry points on their rooftop to prevent a future animal intrusion. I completed the work on their home for closing off the entry points on May 8th, 2024.

On July 15th the Kemlers reached out to me about the water intrusion in the closet. I immediately went to investigate the situation. I did remove a piece from the front area of the exclusion that I completed in May as a preventative incase this was the cause. While at their residence on the same day, I contacted my insurance company to make a claim. I also advised the ******** at that time to also reach out to their homeowner's insurance to which they promptly told me they will absolutely not contact them. Later that week on Friday the 19th I met my adjuster at their residence. He did his investigation, took pictures, and then proceeded with the claim. What their team saw from the picture they took, and the pictures I provided of my completed work of the ******** residence prior to the the complaint. I also provided my insurance company a copy of the original quote that the ******** agreed to. My insurance determined I was not at fault for their water intrusion. The attachments provided in this repsonse are of the determination letter of my insurance company and the original quote between the ******** and Integrity Wildlife Removal.

Since my insurance company has told them I am not at fault, they have attempted to contact me several times by phone call and text message. When they did the first time, I told them again that they should contact their homeowners insurance to which they did not. They have threatened I repay them $500 for repair work they contracted to be done by a so called professional company, without telling me the name of the company who did the repairs, nor have they provided a report of their own private inspector or insurance company that would show I am at fault. They have only demanded repayment.

I am rejecting this response because:  We went through a couple of hurricanes prior to this work that was done to enclose the area and never had any issue with water damage in the area in question prior to  his work.  We never had the water damage  until after he enclosed the area and have had no water damage since he opened the area.  We did not contact our insurance for several reasons. Among those reasons: our insurance rate would go up, our insurance could be dropped if we filed a claim, the deductible would be more than the repair and it was nothing other than water sitting in one place that couldn't drain.  Not OUR fault. We did notify him the day the repair work for the damage was completed because that is what he requested and he never responded.  Originally he told us we should not have to pay for the repairs.

    Sincerely,

Attached are photos of the area in question. Just as stated by my insurance agency in the report, "wear and tear to your roof
caused the damges you are claiming." Debris pile up of shingle material and grit caused a dam against my material which was installed with the intent to still allow waterflow. Because of that water damming by your roofs materials against my breathable material, it is possible that water was able to find an area on your home in the area provided in pictures that was not properly sealed by either roofers, or the builders. A licensed home inspection company, and your insurance agency should have been contacted by you to investigate the cause further prior to having interior repairs done. You have sought out seeking repairs by a proclaimed professional without providing information about said company that did it. I'm sorry for your damage, but I am not at fault.

I am rejecting this response because:  If there was debris which you state caused the damage, why didn't you remove the debris?  We had no problem before you did the enclosure and none again since you opened the enclosure.

    Sincerely,

    **** & ****,

The debris that built up against my meterials was shingle grit and other wear caused by the elements. The type of shingles used and natural weather factors are things that are out of my control. This entire situation is a simple freak accident that is in no way my fault. I have provided sufficient evidence to back up my claims. I am not sure what other answers you'd like from me. I'm sorry this has happened. However, once again, this is not my fault. Your home is not sealed correctly from the elements, and shingle debris after my install played factors with my material which neither of us could have seen happening. I ask that you please provide sufficeint evidence to back up your claim of repairs from the professional licensed company or *** indiviual hired, as well as a report from them detailing their findings as the belief the cause. Or one from your insurance like I submitted.

    Sincerely,

    ****** ****
