    This company cut a branch off a tree at a house next to mine on 6/06/2023. I did not sign any permission form for them to be working on my property and they parked their huge and heavy truck and equipment on my driveway. They were on my driveway for over an hour. After they left, I realized all the damage that they caused. They stained all my driveway with black oil (came from the truck and equipment), they broke an expensive lid cover for the fiber optic service and cracked the concrete in all my driveway. I live in a gated community and the house prices range from $700k - $950K. The total damage that they caused me is over $5k. I am preparing a lawsuit against this company since this is unacceptable. I also filed a formal complaint with the ********************* and I also contacted my HOA committee to prohibit the access of this company ever again in my community. As of today, no one from this company has contacted me at least to say sorry about this situation and/or give me a solution. This company has no integrity, professionalism, or accountability for their actions. PLEASE be aware; you do not want to be in my shoes. (I was not even a client of theirs).

    The work was completed on June 6, 2022. We were working for the homeowner next door to the complainant. We were hired for trimming and cleaning up storm damaged trees from a storm that came through. There was one specific broken limb hanging over the complainants truck. The limb was hanging in the tree and if let loose it would have damaged his truck.  Our client went next door and asked him to move his truck and obtained permission for us to access his property and driveway to remove the dangerous limb. The complainant agreed to it. 

    There were some small spots of oil that somehow leaked from our equipment on the driveway (which we have since fixed). The complainant sent a message through our website that night stating that we did damage to his property. The following morning, as soon as we printed his message, we promptly called him to work on getting any issues resolved. He informed us about a few small spots of oil on his driveway and a cracked plastic ******* box that was in the ground. We assured him that we would get these issues corrected in a timely manner and he seemed to be ok at that time.

    One of our managers went to his property that morning and got pictures of the cracked ******* box and the oil spots on the driveway. We have documentation via text messaging with the complainant stating that we would take care of these matters and we stayed in communication with him up to Friday 6/9/23. We had a pressure washing service scheduled for Monday 6/12/23 to clean the oil spots off the driveway and we were in the process of purchasing the ******* plastic box that was cracked so we could replace it. We called the complainant to verify his address because the pressure washer had the incorrect address and he stated that he did not want us back on his property and he was getting an attorney. 

    We have been in contact with our client (the complainant's neighbor) and he confirms that we DID have permission to access his property and driveway to remove the dangerous storm damaged limb that was hanging over where he parks his truck.

    We moved expediently and stayed in contact with the complainant to get these matters resolved as quickly as possible and to his satisfaction. Then all of a sudden we were shocked to get a BBB complaint from him.

    He never once mentioned that we cracked his driveway and there is no evidence of us doing so.

    We are still willing to do our part to resolve these matters and turn this situation around to a pleasant one. Please let us know if we can be of any further assistance.

    I am rejecting this response because:

    You are a liar and you did not do anything to resolve the issues that you caused me. You promised to clean the oil and replace the lid that you broke (none of this has been cleaned or resolved by you), you never showed up, and you missed the deadline that you put in order to resolve the issues. Also, later I found that that my driveway is all cracked since the truck was too heavy and the motion of the piston levels used to secure while it was parked. Lastly, you claimed that you did not have the correct address and this claim I found unbelievable since you were here days before with your client that is my neighbor. As of today I have incurred legal costs, stress and property damage caused by you. At this point I want $1,000 from you in order to fix the issues. Otherwise, I will continue the legal battle and also I have contacted my HOA in order to include them also as a claimant.

    The oil would have already been cleaned and the lid to the ******* box would have been ordered. However, the claimant told us to stop all remedies, not to step back on his property and that all future communication would be through his attorney. We feel that we were moving along expediently and in a timely manner with the solutions to getting this resolved. The date of the neighbor's service was on June 6, 2023. We were notified of the oil and cracked ******* box lid on June 7, 2023 and immediately got in contact with the claimant to assure him we were moving forward with correcting the matters. The pressure washing service was scheduled for June 12, 2023.

    As far as the cracks to the driveway are concerned. This was something new and was not brought to our attention until the complaint was filed with the BBB. We did not crack his driveway. You can look at the pictures and tell that the cracks are old and existing, just by the color and how dark they are from algae growth and dirt. A fresh crack would have the look of fresh grey concrete. Also, we have attached pictures from March ******************************************************************** 2021.

    We spoke to a representative with ******* regarding the cracked lid. Since the lid has been repaired by the homeowner, they are ok with that. If the homeowner desires, he can contact them to come out and replace the lid at no charge. As far as the oil spots in the driveway, our pressure washing company was going to charge us $200 to clean the entire driveway. We are willing to cut a check to the claimant for the $200 and he can use a company of his choice to clean his driveway.

    We are not Liars and we take our company reputation seriously. We have been in business for over 47 years and have an A+ rating with the BBB. We are an honest and professional company. We ask the claimant to either accept the $200 or allow us to have the driveway pressure washed so the matter can be closed.

    Only the treatment to remove the oil spots will cost me $250. After that, I need to acid wash my driveway and then pressure wash it. I will need at least $400 to have this done.
