We initially met with Mr. ****** for a consultation in October regarding an outdoor project. We did not move forward at that time but reconnected with Mr. ****** in late December to discuss a deck renovation. My wife spoke with him on the phone twice and exchanged emails prior to receiving a contract. My wife was undecided on the final scope of the project but requested a lead time for the project. Mr. ****** responded that he couldn't provide any estimate of availability until a deposit was made. He additionally reassured my wife that the scope of the project and the decision about materials could be discussed and changed after the deposit was paid. Within 24 hours after cashing our check, my wife emailed to request a date for when the project would begin and a second site visit to review and finalize the scope of the project. Mr. ****** abruptly responded that no date would be provided until materials had been delivered to the home and he wouldn't return on site. We were very unhappy with his tone and his change in response after taking the money and we immediately (within 24 hours) asked that he simply return the deposit so we could find a different company. After requesting a cancellation, he stated the project could take place 3-5 weeks from after materials were ordered. Our records show the agreement was signed 12/30/24 and he picked up our check and deposited in on 1/3/25 and we asked the project be cancelled on 1/4/25. He is unethically enforcing a 20% cancellation fee even though no work was completed between the time he took our money and when we cancelled the project. Additionally, the initial deposit was based on a larger project proposal and Mr. ****** misled us about being able to scale back the project after a signing an agreement. We asked him in good faith to reduce this cancellation fee based on the facts of this case and he has refused to answer our calls or emails. He currently refuses to return the remaining $1655 of our deposit.Business Response

This customer has gone to all platforms to write negative reviews and give false misleading information regarding what actually happened and what their obligations were. We have been in business for over 20 years and have a very good track record and repour with most all of our customers, but every now and again we get one of these types of people that are with out a doubt bad actors. Of course we would never do anything malicious to anyone or attempt to not return funds but if we are hired and the commitment has been made, funds are exchanged and our business begins working for you in the office or in the field we can and will retain a non refundable 20% for work rendered and damages.
We don't have to explain the entire situation because you can read on almost all platforms what these people have written, but in a nut shell, we had communicated the small deck REPAIR work for almost 2 months, they finally decided to commit to doing the work, their responsibility was to purchase and provide their decking boards ( specific color and brand of composite decking), we gave them a time frame of when we could start the repair which was 3-5 weeks, but they must first have their materials on site before we start the work( doesn't this make sense? ) They wanted an exact date, and also wanted us to come back to their home nearly *********************************************************************** length for nearly 2 months. We clearly and politely stated that we could meet before the team starts work so that another trip isn't wasted and anymore time exhausted, but not Immediately the following Monday after the deposit was picked up. ( WHY NOT MEET THE DAY WE PICKED UP THE DEPOSIT? ) Why have us go out of our way again to meet with you? Why would they immediately send rude, ignorant messages to cancel to job and hire someone else? Who does this?
Yes, office work was completed for the Job log jackets, P&L projections, job drawing and layout, scheduling, and 2 trips one way 30 miles to the home already + time. 5 days of contract in hand, and 2 months of verbal commitment prior. YES we have in the contract signed about 6 different pages that they understand our process, Yes, they got mad and decided that because we wouldn't jump when they said to jump they wanted to cancel so we retained 20% THATS THE DEAL! The following documentation supports our request for a complete return of our deposit. Based on his contract we are due a full refund based on the request for a refund prior to the end of the three day grace ******* See wording in contract attached: "You, the owner may cancel this transaction at any time prior to midnight of the third business day after the date of this transaction." Please note timeline of check being cashed january 2nd and request for refund on january 4th. Mr. ****** was clear that no work would be started until contract was signed and payment received. Our request for cancellation and refund should be honored in good faith and according to his own contract.
1. Date of signed contract: December 30 (DECKING 4 ATTACHMENT)
2. Date ***** ****** was paid the initial deposit: January 2 (DECKING 3 ATTACHMENT)
3. Date that I requested he return the funds: January 4 (DECKING 3 ATTACHMENT)
4. Date he confirmed he would return the deposit: January 6 (DECKING 5 ATTACHMENT)
We cancelled the project because Mr. ****** refused to return to the house at all until the day the project was going to be started. This was despite the fact that the scope of the project needed to be changed. Documentation for his response has also been attached. I explained this would be unacceptable to us and immediately requested he return the deposit. Documentation for his response and my request has been attached.
Mr. ****** then stated he would return our deposit. However, we received a check for less than the full deposit. In our original complaint, we stated this was an unfair business practice. Since he completed no work and provided no project date, our full deposit should have been returned. Additionally, contrary to what he reported, Mr. ****** only made one site visit to our house back in the early fall. We only requested an additional visit to help finalize our project plans prio to starting, which he refused to do.
Since we filed this original complaint, we learned that even this initial check from him (deposit minus 20%) was a check which bounced at the bank. To date, we have received no portion of the deposit back.
We are requesting our full deposit be returned for these reasons. In this updated complaint, we are also stating he mailed us a bad check and to date we have received no funds back.

Staining 1 coat is $1650 ea additional coat is $750 ( priming / sealing same )
Personally I would try to go with an inexpensive composite for both rooms just because of the durability, maintenance,the finish smoothness, and the area you live in to be up to date and for a far more realistic return on the investment. I wouldnt do the expensive lines of composite " my opinion)

Why on earth would we begin work without materials onsite? If your materials are onsite and ready to be installed we could very simply discuss whatever it is you need to go over before the work starts but you have refused this for some reason. We do not have cancellations in fact we haven't had a cancellation for anything in over 10 years.
Also, just to clarify so that you are aware we have had more than enough communication over the last few weeks to understand our promptness to communicate with you, we were hired because you felt we were the most qualified to service your home and to do business with, our office has already begun working for you once you forward your agreement forms to us, in regards to creating your Job Log, P&L, tentative scheduling, 2 trips to the home, sales person, admin, and cost of acquisition. We also base our income off of jobs that are sold. Who would you like your Cancellation Check made out to?

The customer submitted their signed agreement on the 30th, our company began office work and job logs at that point, the check was collected a day or so later. The customer only asked if we would like to return the payment on the 4th, due to their own lack of commitment to follow through on their obligations of acquiring specific materials. Which of course as a business we would prefer to work through any type of hurdles especially after we already have expenses and labor associated. I personally was out of town until the 6th which is when they decided to actually request a refund, this was 6 days after the agreement was signed. NOT 3 as they are misleading, also they are misleading by saying we haven't responded to any phone calls or emails. This is a lie on their part, they have not made any phone call attempts only emails that we have quickly responded to. This customer is trying their best to spin and create a false narrative of the entire situation. Also, they were in a contract with a completely separate business ( Heavywood construction group, and they are giving false and misleading reviews for Hardrock landscape construction,
On my contract he even points out that a customer may cancel at anytime before midnight of the 3rd day which is true Of the contract not the check being picked up or cashed! All the wife did was ask if we would, if you read her email and our communication with them and read the contract scope / agreement it clearly lays out what is expected of them and when we could schedule the work, after they have secured materials. This person has went to the absolute extreme and I would rather make an example of them.

Note we have been shadow banned online and possibly by this customer so we have not had any callas or business since this situation with them, I informed them immediately of the bank situation with ****** depleting our business account, and we have been diligently working thorough this as a crises, we have by no means not been forthcoming and upfront with this person! But we will absolutely return the amount we initially sent them but we will not send the additional 20% because of the expenses and penalty that it acquired by canceling after the 3days ( 6 to be exact) and also the shakedown of our other business that has nothing to do with the business they were contracted with.
It would be nice if someone from the BBB would just contact myself rather than all of this email and attachment nonsense.

I am rejecting this response because:Mr. ****** clearly stated nothing could be confirmed or started until an initial contract was signed and a deposit was paid. He picked up the check on Thursday (January 2). I emailed him on Jan 3 (Friday) to request a timeline for the project and asked if we could schedule a time to meet at the house. He waited until Jan 4 (Saturday) to respond. After reviewing his response on Jan.4, which I found incredibly unprofessional in tone and content, I immediately asked for the deposit to be returned. It is not our fault that he waited another full day before responding to my email which was sent less than 24 hours from when the took our money. I requested a full refund because he would not have completed any work or made any plans within the short time frame of January 2 to January 4 which was a Saturday. Especially when he wouldnt even respond to my email on January 3. The project was cancelled because he stated he had no intention of returning until the day the project started. I explained this reasoning to him and asked for a refund because he had done absolutely no work. His subsequent responses have been incredibly unprofessional in tone. He sent us a bad check. And his response to our BBB complaint implied he harbors a discriminatory bias toward people who have our last name (refer to his original response). We are requesting our full refund because this owner is withholding money for work he has not done. This is a fair request and we are happy to provide documentation of timeline if so requested.

Within 24 hours after cashing our check, my wife emailed to request a date for when the project would begin and a second site visit to review and finalize the scope of the project. Mr. ****** abruptly responded that no date would be provided until materials had been delivered to the home and he wouldn't return on site
( IT WAS AN EMAIL RESPONSE SIMPLY STATING THAT ONCE THE MATERIALS ARE ON SITE IT WOULD BE A 3-5 WEEK WINDOW TO HAVE A CREW ONSITE FOR THE WORK, AND THAT ONCE WE MEET FOR THE " LIFT AND RELAY OF DECKING WORK" WE COULD HAVE A MEETING AT THAT POINT, BECUSE THERE TRUELY WOULD BE NO REASON TO MAKE A 3RD TRIP TO DISCUSS SOMETHING THAT WAS DETAILED NOT ONLY IN THE PROPOSAL BUT IN PERSON AT THE 1ST VISIT, AND VERBALLY OVER THE PHONE WITH THE SPOUSE, THE CUSTOMER UNDERSTOOD COMPLETLY WHAT THE WORK WOULD ENTAIL WHICH IS WHY THEY GAVE THEIR DEPOSIT)
. We were very unhappy with his tone and his change in response after taking the money and we immediately (within 24 hours) asked that he simply return the deposit so we could find a different company. After requesting a cancellation, he stated the project could take place 3-5 weeks from after materials were ordered.
(ON 1/6/2025 THE CUSTOMER REQUESTED THAT THE CHECK BE RETURNED AND CANCEL THE **** THIS IS ALMOST 7 DAYS FROM THE SIGNING OF THE AGREEMENT, WHICH OUR BUSINESS HAD ALREADY STARTED OFFICE WORK ON, CREATING JOB LOGS, P&L, AND OTHER RELATED TASKS)
Our records show the agreement was signed 12/30/24 and he picked up our check and deposited in on 1/3/25 and we asked the project be cancelled on 1/4/25. He is unethically enforcing a 20% cancellation fee even though no work was completed between the time he took our money and when we cancelled the project. Additionally, the initial deposit was based on a larger project proposal and Mr. ****** misled us about being able to scale back the project after a signing an agreement. We asked him in good faith to reduce this cancellation fee based on the facts of this case and he has refused to answer our calls or emails. He currently refuses to return the remaining $1655 of our deposit.
( OUR AGREEMENT STATES CLEARLY ON PAGE 11 PARAGRAPH 8 CANCELLATION OF AGREEMENT SHOULD THE CUSTOMER CANCEL PRIOR TO START OR AFTER TO BE ACCESSED 20% OF THE PROJECT IN LIQUIDATED DAMAGES) THE CUSTOMER IS STATING THAT WE HAVE RETAINED 20% FROM THE FULL SCALE JOB WHICH THEY AGREED TO DO, THIS WOULD BE A $3,385 FEE, WE ONLY DID A 20%FEE OF THE SMALLER JOB WHICH WAS ONLY $8,275 WITH A FEE OF $1,655 TO COVER OFFICE EXPENSE, TIME SPENT, WASTED COST OF ACQUISTION, FUEL, SALES CALL, ETC. THE CUSTOMER HAS BEEN REFUNED $3,345. THEIR INITIAL DEPOSIT WAS $5,000 ,THEREFORE JOB AGRREMENT OF $8,275 - DEPOSIT OF -$5,000 -20% CANCELLATION FEE THEY WERE REFUNDED $3,345
FURTHERMORE THIS CUSTOMER HAS INSISTED ON ATTEMPTING TO USE EXTORTION/ BLACKMAIL METHODS TRYING TO LEVERAGE OUR OTHER BUSINESS TO GET THEIR WAY WHEN THEY HAVE SHOWN MULTIPLE TIMES DISHONESTY, AND MISLEADING INFO ON MULTIPLE PLATFORMS! THIS PERSON CANCELED 7 DAYS FROM THE DATE OF ENTERING OUR AGREEMENT TERMS WHICH IS 4 DAYS PAST THE CANCELATION TERMS ON THE CONTRACT PAGE 10. HE HAS PROVIDED THE CONTRACT FORMS AND TERMS THEY ARE ALL THERE IN BLACK AND WHITE WITH SIGNATURES ON MULTIPLE PAGES
