4 year old roof has shingles blowing off. Possibly due to poor workmanship & old shingles being used. Spoke to **** ***** (the builder) on November 1 and he told me he would call the Roifing Contractor and he would call me back. I have left 3 messages and my husband has left 1 message, I have emailed him & texted him once and can not get any response. I gave several shingles blown off and more damaged shingles that need replaced.

This is in response to Complaint ID ********.  The complaint concerning the roof on a new home sold and closed with the complainant 12/11/20.  At the time of closing, the purchaser signed a statement as follows: "Purchaser hereby acknowledges that all punch list and walk thru items have been satisfactorily completed from every list prior to closing with the exception of: She wrote "none".  The statement was signed and dated 12/11/20.  Also, at time of closing, the purchaser signed for receipt of the warranty book provided with information regarding the one-year builder's warranty.  A home inspection obtained by the purchaser from Blueprint Home Inspection dated 12/3/20 covered items including the roof.  As I understand from verbal communication, the purchaser thought shingles blowing off was caused by recent storms in the area and when her insurance company was notified, the claim was denied.  Also from verbal communication, I understood a roof contractor was then contacted by the purchaser and the roof contractor told her she needed a new roof at that time.

I am rejecting this response because:
What **** ***** responded with was not true. First of all the shingles are defective and I was told by a contractor and engineer that it was poor workmanship and the shingles were probably purchased in bulk and have sat in a warehouse for a long time. Also, I never told him that insurance denied the claim, I never discussed that with him at all. Also, we had several shingles that wind had blown off before we ever closed on the house that had to be replaced &  the roof was new. I spoke to **** ***** and he told me that he would speak to the roofing contractor and call me back, after a week I called him several more times and my husband also left him a message and I texted him and he would not respond. My neighbors home was also built by SRE Homes LLC , **** ***** and they too have shingles blown up from wind. These roofs are only 4 years old and shouldnt be blowing off so easy. I also never signed anything that said I had no issues because after several visits from his peers at the fire department my home was still NOT repaired property and all items were not repaired. If he wont stand behind his work and get my roof replaced I will seek legal advice and file suit.
    Sincerely,

I am rejecting this response because:
If you look at the Inspection report clearly shows missing shingles on the roof when we closed on the home on 12/11/20, and we reported it on our form that was gave to us by **************. Also, the form signed at closing was before those ******** were replaced. The shingles used were old and if the builder doesnt want to make it right then I need the roofing contractors information so he can. The inspection report done by my home insurer shows the whole roof needs to be replaced, but since it is from poor workmanship and the nail gun turned up to high that the wind is blowing them off. My husband & I would like to meet with **** ***** & the Roofing Contractor to discuss this matter & agree on a solution. If not, I am going to file a lawsuit against **** ***** & the Contractor.

    Sincerely,
