After a free visit I agreed to a one month trial for $360. I was told by **** that there was no need to read the fine print. I made it clear I only wanted 1 month. I then was billed a 2nd month and called to confirm cancelation. I was told it was being looked into. Then a 3rd month I was billed. I have tried to communicate with the business and being ignored. I have also asked for confirmation of no additional charges.

I went in for the complimentary session on 8/15/23. I was interested in coming back a couple of times and was told that I had to join some sort of membership or something. I was asked to pay $360 up front a few sessions for some reason. I don't even know why I did,I am not very good a saying no, I try to be nice. I was told that I could cancel anytime without any issue so I felt ok in agreeing to the membership thing. Not long after that day, I had a medical emergency and would not be able to use the sessions in addition to not being able to afford them with the new medical bills that I am responsible for. I cancelled and asked for a refund, the next day they charged another $360 on my credit card. I disputed the charges on my credit card and contacted them and asked for my money back and explained my situation. I was told that they would work with me but would have to wait for the funds to be returned to them by the credit card company. I waited and waited and nothing. Now they will not return my calls nor will they respond to my emails. I have an email where the manager said he would refund my money but here we are. He and the company ghosted me. As it turns out, based on what I received from the credit card company in response to my dispute, I apparently signed a contract that can only be broken if I am dead or they go out of business. Other than the free session, I never received any service from Stretchzone. I had never even seen that "contract" before my credit card company forwarded it to me. I was just told to sign a little signature pad on the desk. I never received a copy of this "contract" and was not fully told of its terms. I do not see how it can be legal for them to force someone to sign a "friendly" "contract" that allows them to steal from their customers and not provide a service. This is wrong and predatory and abusive. No company should be allowed to trick someone to sign any sort of agreement that can only be cancelled by death or dismemberment.

I am rejecting this response because: As is clear in the email communication that I provided, the manager, *****, has communicated to me that I would be refunded. It is unacceptable that your business would lie to customers in this manner and not even honor your contract terms. This is theft and breach of contract. I received no service, I have a disability preventing me from receiving service. How is it that you do not honor the contract nor the word of the manager.

    Sincerely,

***********************, Owner Stretch Zone Athens. Our Gm has been dealing with *********** on this for 6 months.  She came in for the free consultation obviously she liked it because she signed a 3month contract and bought more sessions. Some time after that  in the second month of her contract she claimed she was in an accident and couldn't use the sessions and wanted the contract canceled, which we did. Then she demands her money back for all the sessions she didn't use. Our GM reached out to her multiple times, we did not ghost her as she claims, we have proof of multiple emails, texts and phone calls. When we occasionally got her on the phone to discuss this matter my employee was only met with shouting and incoherent rants. He repeatedly asked for doctors note verifying her accident and if she was able to come into the studio to use the sessions she paid for. She never produced the doctors note and then decide to do a charge back on her credit card. She lost that appeal with her CC company because they verified it was a legal and legitimate contract. So she's angry and lashing out. In one of her rants she admitted it was not an accident but an assault and then she was involuntarily hospitalized for a period of time. She claims all of this but has still offered no proof. She then proceeds to leave this negative complaint and one on ****** also. We cancelled her contract as she asked, she also claims that our GM would refund her second month, which he has no power to do without my authorization. *********** has been open for 2 years with multiple 5star reviews and had a 5.0 rating until her unjust and negative review hit last week. I then reached out to her and asked her to remove these negative reviews and I would refund her 2nd month of the contract and also stated I could not refund the first month but would be happy to allow her to let a family member or friend use those sessions. She refused. We have tried to work with her to no avail, as far as we are concerned this matter is closed, we will respond to her negative reviews publicly and move on.

I am rejecting this response because: I informed this man of the reason I needed to cancel, because I am unable to allow anyone to touch my body after an assault that took place right after I visited stretchzone and signed what I thought was a just a membership thing because I had been told that I had to join the membership to use their service. I have spoken with the manager and was told that I would be refunded and I did not yell or scream and I do not appreciate that characterization of me. I cannot believe that this is how assault victims are treated by stretchzone. Why on earth would I ever send a friend or family member to this place that has revictimized me over and over and over now?  The contract says that if there is a medical condition that prevents a person from using the service then they will issue a refund for those services that were not received. But they will not even honor their own contract. If they do not believe that PTSD is a medical condition, then they need to revisit their understanding of medical conditions and disabilities.

    Sincerely,
