Near the middle of October ******************************** question regarding a divorce from my current wife with our 12 year old son involved. We were married 12/31/2010 & have been separated (not legally) since Nov. 1st, 2023 when I moved to the state of *******. My "spouse" had expressed that she was filing for a divorce in the state of ******* so I immediately started researching divorce attorneys in *******. That's when I came across the law firm I am filing a complaint against. I was immediately connected to ***** ******* on my first call to the firm. We engaged in about a 15 minute phone call where I expressed all of my concerns, including but not limited to the fact that she resides in *********** reside in ******* & have been for over 6 months. ***** assures me that he could definitely help me with my issue at ********* were "off to the races". The company acquired a retainer in the amount of $3,000.00 from me, then asked for an additional $2,000.00 which I obliged to.After he contacted my spouses attorney, he explained that it should be a pretty cut & dry divorce as it sounded like we both wanted the same thing out of this, which is to part ways. GREAT!Then I would say about 2ish weeks later he expressed that my spouse was filing in ************ could no longer assist me.He was provided with this information from the start (via our first phone call) so I feel it wrongful of him to take on my case knowing they/he didn't practice in the state of ********I do have specific dates/times/emails that were exchanged between ********** just not at the moment. I'm happy to provide if needed.

      Business Response

      Date: 04/02/2025

Mr. ******** contacted our office for a free consultation on October 23, 2024. During this consultation, Mr. ******** stated that he was a resident of *******, County of ********, as he had lived in *************** ******* since December 26, 2023.
Mr. ******** stated that his wife had an attorney in ******* and that she was filing the Petition for divorce. We discussed the fact that he was a ******* resident, and that Gwinnett County Superior Court would be the proper location for the filing of a divorce per Georgia law. However, if he was filing, per Geogia statute he would need to retain a Florida attorney to file in ******* because ******* would not have jurisdiction over her. As our firm does not practice in *******, we would not be able to help him if this was a Florida legal matter.  After a call with his spouse on October 25, 2024 whereby she provided her attorneys contact information, a call with her legal counsel was set for November 8, 2024. During this call, her counsel confirmed that the divorce was being filed in ******* and that the Florida long-arm statute allowed defendants to be pulled into ******* for such legal matters.
Mr. ******** was immediately contacted and informed of the results of the call. Research was done to confirm that the case would have to occur in *******. The counsel provided to Mr. ******** at this point was that he would need to have a Florida lawyer advise him if the Florida long-arm statute did indeed allow Florida to have jurisdiction over him. Because, as he already knew, The Siemon Law Firm, P.C. does not practice in ******* and could not counsel him on Florida statute

Mr. ******** Paid a $3,000 retainer, He was billed for the time spent on this case and said money was subtracted from his retainer, all unused funds were refunded to him in accordance with the retainer agreement.
